Jayana Tanae Webb case: Philadelphia DA refiles murder charge against woman accused of killing 2 troopers, pedestrian

PHILADELPHIA (WPVI) — A Philadelphia judge has dismissed third-degree murder charges against the woman accused of killing two Pennsylvania state troopers and a pedestrian in a crash earlier this year.

Jayana Webb, 22, of Eagleville, appeared before a judge Wednesday for a preliminary hearing in the March 21 crash.

The third-degree murder charges were dropped due to lack of evidence, according to the judge. She is still facing charges of homicide with a vehicle with DUI, involuntary manslaughter and other related offenses.

“I think at the end of the day the judge made the right decision based on the law. This shouldn’t have ever been charged as a murder case,” said Webb’s attorney, Michael Walker.

Shortly after the hearing, the Philadelphia DA’s Office refiled third-degree murder charges in the case.

Authorities say Webb was driving on I-95 southbound in the area of milepost 18 near the Stadium Complex just north of Broad Street when she struck and killed 33-year-old Martin F. Mack III and 29-year-old Branden T. Sisca.

The troopers were helping a pedestrian, identified as 28-year-old Reyes Rivera Oliveras, get into the back of their cruiser when the crash happened. Oliveras also died in the crash.

Nine witnesses testified during Wednesday’s preliminary hearing.

Before the fatal crash, Webb was reportedly driving about 110 mph and was pulled over by the two troopers. It was revealed in court that the troopers left Webb when they got a call for a pedestrian on the highway.

Then 15 minutes later authorities say Webb crashed into the troopers and the pedestrian.

Webb told troopers she looked down at her phone to see which exit she was taking when she heard a “boom.”

Her blood alcohol concentration was .211% and Webb was seen on surveillance video swerving.

The preliminary hearing ended with much disappointment amongst the family and colleagues of fallen Pennsylvania State Police Troopers Mack and Sisca.

Webb’s attorney said he could understand why they might be upset.

“They want a court proceeding to represent them very well and represent the lives of the people that perished, and I’m not sure that’s what they feel they got,” said Walker.

Webb’s bail was set at $600,000. She had been held without bail since her arrest.

Deadly Nebraska crash: At least 2 dead, 19 injured after cars slam into pedestrian crowd

Authorities in Lincoln, Nebraska responded to a mass casualty incident Sunday evening where at least two people are dead and many others are believed to be injured after multiple vehicles crashed and rolled into a crowd of people.

Two female victims were declared dead at the scene, both believed to be occupants of the vehicles, and 19 others have been hospitalized, the Lincoln Police Department said.

“One is in critical condition. The other 18 people are believed to be in non-life-threatening condition at this time,” the police said.

Videos posted online show a large fire formed from the wreckage near the intersection of South 52nd Street and O Street, outside the Barnes & Noble’s Bookstore, while people, several dizzied and stumbling, were fleeing the area. The contents of the videos have not been independently verified.

Lincoln Fire & Rescue officials are reportedly on the scene clearing the fire and assisting victims.

Initial reports indicate the incident occurred after a car reportedly ran a red light, struck another vehicle and the two cars hit the crowd.

The incident appears to have taken place near the Americruise event, hosted by the Midwest Association of Car Enthusiasts (MACE).

“Every Memorial Day Weekend, hundreds of cars, bikes, and trucks flock to Lincoln, NE to cruise down O Street to show off their rides and do some hooning!” a description for the event read.

Several victims have been treated on the scene while others reportedly drove themselves to the hospital.

“We want to remind everyone the police won’t be a stranger to this event so PLEASE cruise at your own risk and be cautious to those around you! There will be large crowds all along O street, and we don’t need anyone in a wreck or worse in the hospital!” the description continued.

Brittallia Semaan arrested: Woman accused of killing pedestrian, carjacking 2 drivers in New Castle, Delaware

NEW CASTLE, Delaware (WPVI) — Delaware State Police have arrested a woman accused of killing a pedestrian and injuring several other people during a double carjacking rampage on Sunday.

The incident started around 9:30 a.m. when police say 30-year-old Brittallia Semaan carjacked the driver of a Chevrolet Trax on the 4000 block of New Castle Avenue (Rt. 9). Police say a 67-year-old man, a 66-year-old woman and two juveniles were inside the vehicle at the time.

The 66-year-old woman sustained minor injuries after she was hit while Semaan was fleeing the scene, according to police.

The suspect then fled to the area of Rt. 9 and Boothhurst Boulevard where she struck and killed a 48-year-old New Castle County man. He has not been identified.

Semaan is then accused of driving to the Brandywine Valley SPCA where police say she struck a 19-year-old woman in the parking lot. The victim sustained non-life-threatening injuries.

After fleeing that scene, police say Semaan struck a Maserati head-on while traveling on Rt. 141.

A 34-year-old man and a 26-year-old woman in the Maserati were not seriously injured.

After the crash, a 62-year-old man driving in a Ford Explorer stopped to render aid but was subsequently carjacked by Semaan, according to police.

“He confronted her and she was told to exit his vehicle. As she did, she entered the driver’s side and began fleeing the scene with a 77-year-old female in the front seat passenger’s seat still inside,” said Master Corporal Heather Pepper with the Delaware State Police.

With the female victim still in the car, Semaan then fled to the area of Hamburg Road where police say she crashed into a Honda Odyssey.

The 52-year-old woman in the Honda Odyssey and the 77-year-old female in the Ford Explorer were not seriously injured.

Police say an off-duty Wilmington police officer and a former law enforcement officer, who witnessed part of the incident, apprehended the suspect at the final crash scene until troopers arrived.

A motive for the rampage is still being investigated.

Semaan has not been formally charged.

Newark Officer Hit a Pedestrian With His Car and Took Body Home, Prosecutors Say

A Newark police officer has been charged with reckless vehicular homicide after prosecutors said he hit a pedestrian with his personal car and briefly took the body home, where he discussed what to do with it with his mother.

The Newark Police Department officer, Louis Santiago, was off duty on Nov. 1 when his Honda Accord drifted into the northbound shoulder of the Garden State Parkway around 3 a.m., the Essex County Prosecutor’s Office said in a news release on Wednesday. His car struck Damian Z. Dymka, 29, a nurse from Bergen County.

Neither Mr. Santiago nor the passenger in his car, Albert Guzman, both 25, called 911 or rendered aid to Mr. Dymka, the prosecutor’s office said. Instead, Mr. Santiago left and returned to the scene multiple times before loading the victim into the Honda and driving to his home in Bloomfield, N.J. The two men then discussed what to do with the body with Mr. Santiago’s mother, Annette Santiago, 53, according to the prosecutor.

Mr. Santiago eventually returned to the scene, the prosecutor’s office said. Mr. Santiago’s father, a lieutenant in the Newark Police Department, also called 911 to report that his son had been in an accident.

When the state police arrived, they found Mr. Dymka’s body in the Honda’s back seat.

Mr. Santiago, Mr. Guzman and Ms. Santiago have been arrested, charged and released on conditions, the office added.

In addition to vehicular homicide, Mr. Santiago faces charges including leaving the scene of a deadly accident, endangering an injured victim and two counts of official misconduct.

Mr. Guzman and Ms. Santiago each face charges including hindering apprehension and conspiracy to desecrate human remains and tamper with physical evidence.

News of the charges was reported earlier by the news site NJ.com and The New York Post.

The release from the prosecutors office did not name Mr. Santiago’s father or indicate when he had called 911. It also did not say when Mr. Dymka died or why he had been in the shoulder of the Garden State Parkway in the middle of the night.

The Essex County Prosecutor’s Office and the Newark Police Department could not immediately be reached for comment early Thursday morning.

Mr. Dymka was a nursing supervisor at the Preakness Healthcare Center in Wayne, N.J., according to the center’s website.

U.S. probing fatal Tesla crash that killed pedestrian

WASHINGTON, Sept 3 (Reuters) – U.S. auto safety regulators are investigating a July 26 fatal crash in New York involving a Tesla (TSLA.O)vehicle that might have been using an advanced driver assistance system, they disclosed on Friday.

New York City police confirmed on Friday an ongoing investigation into the July 26 death of a 52-year-old man attempting to fix a flat tire on his vehicle on the Long Island Expressway when he was struck by a Tesla.

A National Highway Traffic Safety Administration (NHTSA) spokeswoman told Reuters on Friday the agency was aware of the “July 26 incident involving a Tesla vehicle on the Long Island Expressway in New York, and has launched a Special Crash Investigation team to investigate the crash.”

NHTSA’s probe into the New York crash was first reported by Reuters.

Tesla did not immediately respond to a request for comment.

The U.S. investigations come amid increased scrutiny of Tesla’s Autopilot and other driver assistance systems. Tesla’s Autopilot handles some driving tasks and allows drivers to keep their hands off the wheel for extended periods.

Last month, NHTSA said it opened a formal safety probe into Autopilot after 11 crashes involving Tesla models and emergency vehicles.

On Wednesday, NHTSA identified a 12th crash involving a Tesla vehicle using an advanced driver assistance system that struck an emergency vehicle in Orlando, Florida.

On Friday, NHTSA released an updated list of special crash investigation crashes that it is reviewing, in which advanced driver assistance systems are suspected of being used including the New York crash involving a 2021 Tesla Model Y as well as a crash in Florida.

NHTSA has opened 33 investigations into Tesla crashes involving 11 deaths since 2016, in which use of advanced driver assistance systems was suspected. NHTSA has ruled out Autopilot use in three of those non-fatal crashes.

Pedestrian struck dead in Cumberland County

A pedestrian is dead after being hit by a vehicle Friday night. Emergency Dispatch Services said the call to the scene came in around 7:40 p.m. to the intersection of Airport and Whitmer roads in Southhampton Township. The coroner was called to the scene. No one else was hurt and the driver stayed on the scene.
