DaBaby charged with felony battery for alleged attack on rental property owner

DaBaby has been charged with felony battery for an alleged attack on the owner of a rental property he was using to shoot a music video.

Gary Pagar claims he was physically assaulted when he tried to stop the rapper’s entourage from shooting the video on his Los Angeles property in December last year.

According to TMZ, the incident occurred when DaBaby (real name Jonathan Kirk) and his team were renting out a mansion managed by Pagar, who says he was told Kirk and his friends would only be using the property for vacation purposes.

Pagar has claimed that the rapper’s management team agreed to a 12-guest limit as outlined in the property’s rental agreement, but at one point during their week-long stay, Pagar said he noticed more than a dozen people were inside the house.

On December 2, Pagar said he stopped by the property and found in the region of 40 people on site, including a film crew who appeared to be shooting a music video for ‘Play U Lay’, a track by DaBaby’s artist Stunna4Vegas.

Pagar then claims that after he approached Kirk to try and shut down the shoot, someone in the rapper’s crew attacked the property owner. Although Kirk allegedly ordered the crew member to stop, Pagar alleges that Kirk then punched him in the face, knocking out a tooth.

Pagar filed a lawsuit against Kirk in February, which claims that he suffered serious injuries from the attack. Another member of the rapper’s team, Thankgod Awute, has also been charged with felony robbery.

DaBaby took to Twitter to respond to Pagar’s claims, writing: “Y’all keep beliving [sic] these type of people & helping em assassinate my character y’all might as well get a rope & help him hang my black ass on a tree.”

This is the latest in a long line of legal woes the rapper has been involved in over the last year.

Last week, Rolling Stone obtained security footage of a 2018 incident where Kirk shot and killed a man named Jaylin Craig at a Charlotte-area Walmart, which the rapper has consistently claimed was in self-defence.

The newly published security footage shows the lead-up to the shooting and its aftermath and appears to potentially contradict the rapper’s version of events.

He was then involved in another violent altercation last month, this time between himself and Charlotte rapper Wisdom, a recent signee to Kirk’s Billion Dollar Baby Entertainment roster.

That same month, a shooting took place at DaBaby’s home in North Carolina, leaving one person injured. While the shooter and the victim have not been named, a spokesperson from the Troutman Police Department said it was an “isolated incident” and that there was no further threat to the community.

In February, the brother of singer/rapper DaniLeigh sued DaBaby over an alleged unprovoked physical attack on him at a bowling alley in Los Angeles.

The musician, 30, has been charged by the L.A. County District Attorney’s Office for allegedly striking property owner, Gary Pagar, after he attempted to shut down his video shoot.

The incident, which happened in early December, reportedly left Pagar with serious injuries, as reported by TMZ.

An associate of the rapper named Thankgod Awute – who prosecutors claim was DaBaby’s ‘cohort in crime’ –  has also received felony robbery charges stemming from the event. 

DaBaby – born Jonathan Lyndale Kirk – rented Pagar’s Los Angeles mansion for a week in order to shoot a music video. 

In a lawsuit filed by the property owner last February, he alleged that the rapper and his management team agreed to keep the number of guests to 12 during his stay, as per their rental agreement.

Pagar claims that after he realized there were more than 12 people at the property, DaBaby’s team falsely assured him that they would not be staying for long. 

However, when Pagar visited the property on December 2, he found that the rapper was shooting a video with ‘upwards of 40 people’ at the mansion, which violated the original lease agreement. 

While trying to resolve the situation, Pagar was allegedly assaulted by a member of DaBaby’s crew, who pushed him to the ground, as seen in the video of the incident.

DaBaby – who’s been involved in countless physical altercations over the years – then allegedly punched Pagar in the mouth, knocking out his tooth. 

The violent incident is one of many in the rapper’s history. Last weekend, he appeared to have swung his fist at a member of his own team.

The incident, which saw him appearing to swing at Wisdom, his signed artist, happened backstage at Colonial Life Arena in Columbia, South Carolina, where DaBaby was scheduled to perform for Spring Jam 2022. 

Earlier this month, the rapper also shot someone in the leg, after alleging that they wandered onto his property, as per TMZ. No arrests were made at the time.

He’s also been embroiled in a bowling alley altercation with his ex-girlfriend DaniLeigh’s, 27, brother Brandon Bills earlier this year, with law enforcement sources saying they were investigating DaBaby for assault with a deadly weapon at the time.

Meanwhile a recent video of the rapper surfaced last weekend, showing him fatally shooting 19-year-old Jaylin Craig during a 2018 confrontation at a Walmart in North Carolina.

DaBaby was charged with carrying a concealed weapon after the shooting, but did not receive a murder charge as he claimed self-defense and reported that the victim had pulled a gun on him.

Rolling Stone published surveillance footage of the incident, sparking a debate in regards to self-defense.

Report – DaBaby Hit With Felony Battery Charge for Alleged Attack

DaBaby has been hit with a felony battery charge by the Los Angeles County District Attorney’s Office stemming from an alleged attack that happened during a music video shoot last December.

According to a report on TMZ, published on Saturday (April 30), the Billion Dollar Baby Entertainment honcho was charged with felony battery for allegedly punching the property owner of a home he was renting in Runyon Canyon, Calif.

The alleged victim, Gary Pagar, is suing DaBaby, claiming he punched him in the mouth and knocked a tooth out back in December. The man alleges that this happened because he attempted to stop the North Carolina rapper from shooting a music video on his rental property because he exceeded the guest limit of 12 people, which violated the terms of the lease and COVID-19 restrictions.

Pagar claims in his suit that the “Rockstar” artist had repeatedly violated the agreement during his week-long stay, so he decided to check the property out on Dec. 2. When he arrived, Pager claims that Baby had 40 people at the home with an entire film crew.

When Pagar attempted to shut down the video shoot, he claims he was shoved to the ground by an unknown man, which was caught on video.

The unknown man could be Thankgod Awute who prosecutors claim was DaBaby’s partner-in-crime, according to TMZ. He was hit with a felony robbery charge.

Pager then claims that DaBaby got out of a car, chased him back into the home, and advised him against calling the police. Pagar claims that this was when he was attacked and left with a bloodied mouth and missing tooth. Eventually, someone at the scene did call the police and DaBaby and his crew allegedly left, allegedly taking Pagar’s phone and “valuable kitchenware” with them.

Pagar also claims in his suit that DaBaby fled without paying the full amount of the bill and allegedly left thousands of dollars worth of damage, including a destroyed security camera that was installed inside the home.

DaBaby is facing several legal cases, including one from DaniLeigh’s brother, Brandon Bills, who is suing him for an altercation that happened at a bowling alley earlier this year.

DaBaby continues to be in the news for all the reasons not connected to his music.

The rapper is now facing criminal charges over an incident where a guy, who was trying to stop him and his entourage from shooting a music video at his property, suffered injuries after getting beaten. The incident happened in early December last year and DaBaby has been charged with felony battery by the L.A. County District Attorney’s Office.

The incident reportedly left the guy, Gary Pagar with serious injuries and he decided to file a lawsuit in February, according to TMZ. The music video shoot was for DaBaby’s artist Stunna 4 Vegas’ song where Jake Paul makes a cameo.

TMZ reports that DaBaby and his team had rented out a massive pad in the area that Pagar manages and a rental agreement for a week long stay was signed where it was mentioned that no more than 12 people could stay at the property. When Pagar became aware that more than 12 people were there, he complained to DaBaby’s team and they assured him that they wouldn’t stay for too long.

But then Pagar decided to pay a visit himself on Dec. 2nd and found that there was an entire crew, close to 40 in number, filming a video. When he tried to talk to DaBaby about it, someone allegedly attacked Pagar which was caught on video. DaBaby told the person to back off but then himself sucker punched Pagar, knocking off his tooth, the lawsuit alleges. Pagar then went to authorities with his complaint.

Earlier this week, a video surfaced where DaBaby allegedly shot and killed a man inside a Walmart, an incident where he had previously claimed self-defense and no charges were eventually filed.

DaBaby’s Fatal 2018 Walmart Shooting – Unseen Video Surfaces

Unseen video of DaBaby’s deadly 2018 shooting at a North Carolina Walmart has surfaced.

Tonight (April 24), Rolling Stone posted previously unreleased security footage of DaBaby’s 2018 altercation that left 19-year-old Jaylin Craig dead. The “Rockstar” rapper, born Jonathan Kirk, reportedly faced a charge of carrying a concealed weapon following the shooting, but was never prosecuted for Craig’s death.

The new video, which contains no sound, begins with DaBaby appearing to be confronted by two individuals: Jaylin Craig and Henry Douglas. A physical altercation breaks out between DaBaby and Douglas after Baby punches Douglas. Craig can be seen appearing to brandish a weapon in the background, but then tucks it away.

DaBaby and Douglas’ brawl leads to another camera angle, which shows them both struggling upright against each other. Craig then walks over to them, appearing to reach for a weapon a second time before attempting to break the rappper and Craig apart. DaBaby’s then-girlfriend Mariah Osbourne confronts Craig, appearing at one point to raise her right hand up to his face as Baby and Douglas continue to struggle.

The footage then breaks to the previous angle and shows DaBaby sliding on the ground into frame with a firearm in his right hand. He then adjusts the hood of his hoodie that was on his head and appears to fire the gun. The footage does not show Craig being hit, only DaBaby appearing to shoot the firearm. As previously mentioned, the Kirk rapper has continually maintained his self-defense claim in the years since the shooting.

“If them gunshots ain’t go off, nigga, my fuckin’ daughter could’ve got hit, son could’ve got hit, me,” he said in a video on social media just days after the incident. “Fuckin’ lawyers telling me not to say something and shit, fuck all that. Two niggas walk down on you and your whole muthafuckin’ family, threaten y’all, whip out on y’all, nigga, let me see what y’all gon’ too.”

Craig’s family, on the other hand, has a very different perception of their son’s death.

“We never hid from nobody,” Craig’s mother, Horsley, told Rolling Stone. “We never [heard] from nobody. Y’all knew our names from a news clip. But nobody ever asked us what was Jaylin like. Nobody.”

“This is stressing me out right now because every time you turn on the radio, you hear [DaBaby],” Craig’s father, Curtis, said. “You can’t even listen to the radio. I think about my son constantly. We all are going through the same stuff. Every time we talk about it, we think we are getting somewhere, and nobody is trying to help us. Every lawyer we talked to, they look into this case [and say] ‘Okay, we are going to get back with you.’ We don’t hear nothing [back].”

While DaBaby was never prosecuted for the death of Craig, he was charged with a carrying a concealed weapon. DaBaby did not have a permit for the weapon. In March of 2019, the charge was suddenly dropped after, “a key civilian witness was unavailable,” according to Rolling Stone via a county representative.

However, the charge was later brought back on DaBaby by the state and he was sentenced to 12 months of unsupervised probation, along with a suspended 30-day jail sentence.

Rolling Stone received the following response from the District Attorney’s office in response to the question of why Kirk didn’t receive any harsher charges: “[We] reviewed the police investigative file and agreed with the Huntersville Police Department’s decision not to charge Mr. Kirk further, as prosecutors could not prove beyond a reasonable doubt that the defendant did not act in self-defense.”

According to a local Fox46 station in North Carolina, a report they ran in March of 2019 after speaking with Craig’s parents claims that the security footage was not shown in court.

DaBaby has already appeared to respond to the footage surfacing. “The niggas preying on me can’t fuck wit the people praying for me!” he wrote in a tweet.

XXL has reached out to DaBaby’s team and Walmart corporate for comment.

The video surfacing comes on the heels of DaBaby reportedly being involved in a shooting at his North Carolina home earlier this month. The rapper reportedly shot a man in the thigh who trespassed on his property.

DaBaby was on a NC property when a man was shot for trespassing, police say

A 26-year-old man allegedly climbed the fence surrounding the property and was shot, according to an incident report from the police department. No charges were filed in the shooting as of Thursday night.

According to CNN affiliate WSOC, the person was shot on a football field outside a mansion belonging to DaBaby, whose real name is Jonathan Kirk. Although police would not confirm to CNN that DaBaby owns the home, they said he was present when the shooting occurred. Troutman Police did not release the name of the shooter.

“I can confirm the shooting did not occur inside the residence and that Mr. Kirk was on the property,” police chief Josh Watson told CNN in an email. Watson said the investigation is in “an ongoing status” and he was not able to provide further information.

Around 8 p.m. ET Wednesday, police arrived at the residence and found a man suffering from a non-life-threatening gunshot wound, TPD said in a statement.

The victim was transported by Iredell County EMS to a medical facility to treat his injury, the statement said.

A manager for the rapper declined to comment Thursday.

The eight-time Grammy-nominated rapper is a North Carolina native.

DaBaby made headlines last summer when he made false and disparaging comments about gay men and HIV during a performance in Miami. The comments were quickly condemned by fans, LGBTQ+ groups and other celebrities, including Elton John, Dua Lipa and Madonna, and DaBaby later apologized.

The town of Troutman is located around 35 miles north of Charlotte.

CHARLOTTE — Singer Danielle Curiel, also known as DaniLeigh, is facing two assault charges stemming from altercations late Sunday and Monday morning with rapper DaBaby, the Charlotte-Mecklenburg Police Department confirmed late Monday.

DaBaby, whose legal name is Jonathan Kirk, told responding officers late Sunday that Curiel assaulted him, and he was advised to pursue charges against her the following morning at the magistrate’s office. However, officers were called to the same uptown address Monday morning, and Kirk stated that Curiel assaulted him a second time.

The rapper and Charlotte native posted to Instagram Live alerting fans that he was calling the police.

“Man, y’all come get her,” he said on Instagram Live.

Sunday’s incident began with an argument between the two entertainers that was streamed on Instagram Live. In the clip, which was shared widely online on Monday, Kirk can be seen feeding the couple’s infant daughter, while Curiel claimed that he has been an absentee father and is now trying to force her out of his Charlotte apartment, Rolling Stone reported.

In an Instagram Stories post published a short while later, Kirk appealed for a rapid police response in the hopes it would defuse the situation.

“I don’t want no charges pressed or nothing. I just want her peacefully removed, which they need to hurry up [and] do as we speak. I ain’t even want that behavior on display but it’s OK, man this too shall pass, it’s all good,” he wrote.

Meanwhile, Curiel hurled insults and accusations at Kirk in a profanity-laden Instagram Stories post of her own, but no arrests or removals were made Sunday night, Rolling Stone reported.

CMPD told Kirk to go to the magistrate’s office to pursue charges. On Monday morning, officers were called to the same location for reports of a disturbance and Kirk told officers that Curiel had assaulted him again.

Channel 9 was there Monday afternoon and captured the scene outside an apartment complex of a woman who appeared to be Curiel talking to police.

After police investigated, Curiel now faces two counts of simple assault for the incidents on Sunday and Monday.

On her Instagram Story, Curiel documents a relationship between the two artists and that they share a baby girl.

The dispute between the two seems to have played out over the past 48 hours, with Curiel’s posts claiming that Kirk told her to get out. Kirk’s post said he has video of her beating on him — evidence that he said he will not post on social media.

“I am a father. That’s the only reason why she is around me,” Kirk said in his Instagram Live. “If anything else is going to come to light it will come to light. I’m not participating in none of the foolery, man.”

In one of Kirk’s latest Instagram posts, he posted a statement saying he’s focused on his new music project, and that he “does not want to press charges” and that he just wanted Curiel to be peacefully removed.

No other details have been released at this point.

50 Cent Brings out DaBaby for Rolling Loud Performance Following Controversy, Fans Show Support

DaBaby made his return to Rolling Loud three months following his controversial rant in Miami, thanks to his presumed mentor 50 Cent.

Fans of the North Carolina rapper were in for a special treat on Thursday, Oct. 28, when Fif brought the “Suge” rapper out to perform on Day 1 of the festival’s New York installment at Citi Field in Queens — although he wasn’t a part of the official lineup.

TMZ reported that unidentified source say Rolling Loud organizers approved DaBaby’s involvement despite his prior flap, although his portion of the performance was allegedly cut from the livestream of the event.

Fif has shown DaBaby tons support in the weeks following the scandal. During an interview with E! News, the “Power” creator seemed confident that the “BOP” emcee would eventually land back in the media’s good graces.

“Like, they didn’t notify him that he’s turning into a superstar,” Fif said at the time. “There’s no artist development. There’s no strong A&R in this, definitely no media training. Remember they canceled Chris Brown like five or six times.”

Social media comments about the guest appearance also seemed to be mostly positive, although at least one was subtly barbed. “Dababy performed at rolling loud without saying homophobic statements for no reason, clearly he’s improving,” wrote one Twitter user.

Another person commented, “Even tho said some ignant ass sh-t at Rolling Loud, DaBaby make sum quality gym music.”

Still, DaBaby doesn’t appear to be out of the woods with everyone just yet. “The tweet that Boosie just posted about Lil Nas is 1000x more harmful and disrespectful than anything DaBaby said at Rolling Loud.” They added, “I want him to truly prove he cares about the LGBTQ+ community and stand up for Nas and denounce Boosie’s BS.”

As previously reported, the 29-year-old, whose real name is Jonathan Lyndale Kirk, went on a bizarre and misinformed rant about HIV/AIDS during his July set. “If you didn’t show up today with HIV, AIDS, or any of them deadly sexually transmitted diseases, that’ll make you die in two to three weeks, then put your cellphone lighter up,” he said during his performance.

That backlash included mounting criticisms on social media, loss of several future performance bookings and brand partnerships. The “ROCKSTAR” rapper ultimately offered up multiple apologies and met with various members of the LGBTQ community for a discussion around his comments.
