Alec Baldwin has been formally charged in ‘Rust’ shooting

Actor and producer Alec Baldwin has been criminally charged in connection with the 2021 fatal shooting on the set of the movie “Rust,” the Santa Fe County, New Mexico, district attorney’s office told CNN Tuesday.

The charges against Baldwin and the set’s armorer, Hannah Guiterrez Reed, include two counts of involuntary manslaughter, the DA’s office said. Attorneys for both defendants previously insisted their respective clients are innocent.

“Negligent use of a deadly weapon charges were also filed against ‘Rust’ assistant director David Halls, who has pleaded no contest and has entered into a plea agreement that is pending approval,” according to a media statement issued by the DA’s office.

“Today we have taken another important step in securing justice for Halyna Hutchins,” District Attorney Mary Carmack-Altwies said in a statement to CNN on Tuesday. “In New Mexico, no one is above the law and justice will be served.”

Carmack-Altwies told CNN earlier this month she would charge Baldwin and the film’s armorer with involuntary manslaughter, accusing them of failing to perform safety procedures that could have prevented the accident that resulted in the death of cinematographer Halyna Hutchins.

Hutchins was struck and killed by a live round of ammunition fired from a prop gun being held by Baldwin, who maintains he did not pull the gun’s trigger.

Director Joel Souza was also shot and injured.

Baldwin did not take firearm training on the “Rust” movie set seriously, prosecutors said in probable cause documents outlining evidence in the case.

“A training session for at least an hour or more in length was scheduled, but the actual training consisted of only approximately 30 minutes as according to (armorer Hannah Gutierrez) Reed, Baldwin was distracted and talking on his cell phone to his family during the training,” the document states.

Gutierrez Reed is also charged with involuntary manslaughter, with prosecutors stating she did not insist on Baldwin’s safety training, did not check each round loaded into the firearms, and did not follow appropriate safety protocols in storing ammunition.

“Gutierrez Reed was reckless in her responsibility to ensure set safety with the firearm. She failed to correct Baldwin from committing the dangerous and reckless safety violations by pointing the weapon at/towards people and by having his finger on the trigger,” according to the probable cause statement against Gutierrez Reed.

“The photos and videos clearly show Baldwin, multiple times, with his finger inside

of the trigger guard and on the trigger, while manipulating the hammer and while drawing, pointing, and holstering the revolver,” prosecutors said.

Repeated FBI testing on the weapon determined it could not fire without the trigger being pressed. In interviews with CNN and ABC Baldwin has claimed he did not pull the trigger.

CNN has reached out to representatives for both Baldwin and Gutierrrez Reed.

Baldwin has maintained he was not aware the gun he fired during a rehearsal contained a live round. In a statement to CNN on Jan. 19, his attorney called the prosecutors’ decision “a terrible miscarriage of justice.”

“This decision distorts Halyna Hutchins’ tragic death and represents a terrible miscarriage of justice. Mr. Baldwin had no reason to believe there was a live bullet in the gun – or anywhere on the movie set,” Baldwin’s attorney Luke Nikas said in his statement.

“He relied on the professionals with whom he worked, who assured him the gun did not have live rounds. We will fight these charges, and we will win.”

An attorney for Gutierrez Reed said he believes jurors will find his client not guilty.

“We were expecting the charges but they’re absolutely wrong as to Hannah – we expect that she will be found not guilty by a jury and she did not commit manslaughter,” attorney Jason Bowles said in a statement to CNN earlier this month when the indictment was first released.

“She has been emotional about the tragedy but has committed no crime.”

Baldwin and Gutierrez Reed each face two counts of involuntary manslaughter so that a jury can decide which specific count may be more appropriate, Carmack-Altwies previously told CNN.

If convicted, “they will only be sentenced to one count,” the prosecutor said.

In either case, a conviction is punishable by up to 18 months in jail and up to a $5,000 fine, prosecutors said.

But one count would involve a firearm enhancement, or an added penalty, because a firearm was involved. In that case, the crime could be punishable by up to five years in jail, prosecutors said.

The public post came just hours after Boston-born Hilaria was ridiculed for slipping into an ‘offensive’ Spanish accent while asking photographers to leave her kids alone in wake of Alec’s charge.

Last week, sources claimed Alec is ‘trying to stay strong’ for his kids after being charged with involuntary manslaughter over the death of Halyna Hutchins.

Fighting to clear his name: As for his legal woes, Alec has repeatedly denied any wrongdoing over Hutchins’ passing and insisted that Assistant Director Dave Halls said he was being handed a ‘cold’ gun – meaning it was unloaded and safe (seen in 2019)

The cinematographer was killed when a prop gun went off during rehearsals on the set of the upcoming Western movie in October 2021 and now the 64-year-old actor – who is married to Hilaria Baldwin and has Carmen Gabriela, nine, Rafael Thomas, seven, Leonardo Ángel Charles, six, Romeo Alejandro David, four, Eduardo Pao Lucas, two, and daughters Ilaria Catalina Irena, three months with her – but is said to be ‘focused’ on his children and ‘leaning’ on his wife as they come to terms with the charges.

An insider told People: ‘They were prepared for all outcomes, but nothing can quite prepare you for this. They are really leaning on each other and trying to keep their focus on the kids. Hilaria has been Alec’s rock throughout all of this, and to see him so distraught is heartbreaking for her. She is doing whatever she can to support him and they’re doing their best to stay strong for the kids.’

The film’s head armorer, Hannah Gutierrez-Reed, faces the same charge, and both face a maximum of five years in prison if found guilty.

Santa Fe’s District Attorney Mary Carmack-Altwies said the charges will be filed by the end of the month.

She added in a statement: ‘Actor and producer Alec Baldwin and armorer Hannah Gutierrez-Reed will each be charged with two counts of involuntary manslaughter.

‘After a thorough review of the evidence… I have determined that there is sufficient evidence.

‘On my watch, no one is above the law, and everyone deserves justice.’

Assistant Director Dave Halls has agreed a plea deal on the charge of negligent use of a deadly weapon. He will receive six months probation and a suspended prison sentence.

Alec has repeatedly denied any wrongdoing and said Dave said it was a ‘cold’ gun – meaning it was unloaded and safe – when he handed him the weapon.

Hannah was not present when the incident occurred, but the actor previously suggested she bare some responsibility as it was her job to prepare and check the props.

The ’30 Rock’ star previously insisted he did not pull the trigger when Halyna was shot, but the FBI tested the weapon and later issued a report which concluded it would not have fired if someone hadn’t pulled the trigger.

Halyna’s death was previously ruled an accident but her family filed a wrongful death lawsuit against Alec and others involved in the production.

The lawsuit was settled last October, and it was agreed filming would resume on ‘Rust’, with the cinematographer’s widower, Matthew Hutchins, on board as an executive producer.

Matthew previously said he has ‘no interest’ in apportioning blame for his wife’s tragic death and wants to pay tribute to Halyna’s ‘final work’.

In a statement, he said: ‘We have reached a settlement, subject to court approval, for our wrongful death case against the producers of ‘Rust’, including Alec Baldwin and Rust Movie Productions, LLC. As part of that settlement, our case will be dismissed.

‘The filming of Rust, which I will now executive produce, will resume with all the original principal players on board in January 2023.

‘I have no interest in engaging in recriminations or attribution of blame (to the producers or Mr. Baldwin).

‘All of us believe Halyna’s death was a terrible accident. I am grateful that the producers and the entertainment community have come together to pay tribute to Halyna’s final work.’

Alec also sued four crew members – Hannah, Dave, Sarah Zachry and Seth Kenney – claiming they failed to safeguard the film set.

On Thursday (19 January), the family of Halyna Hutchins released a statement in response to the news that Alec Baldwin, among others would be charged with involuntary manslaughter for her death.

Hutchins, 42, was shot by Mr Baldwin, who was starring in and producing the movie, during a rehearsal inside a church on the set on 21 October 2021.

In a message delivered through lawyer Brian Panish, the family thanked the Santa Fe sheriff and the District Attorney “for concluding their thorough investigation and determining that charges for involuntary manslaughter are warranted for the killing of Halyna Hutchins with conscious disregard for human life”.

They later went on to state that the announcement is a “comfort for the family”.

He was admitted to the hospital with a gunshot wound in October 2021 and was discharged soon after.

Ms Hutchins, director of photography for the Western film Rust, died on 21 October 2021 after being shot by a gun held by actor Alec Baldwin, who’d believed it was filled with dummy rounds instead of gunpowder and a projectile.

Who is Hannah Gutierrez-Reed, the armourer charged in the Rust on-set shooting?

Hannah Gutierrez-Reed is the armourer who is also facing charges of involuntary manslaughter over the October 2021 fatal Rust shooting.

As the head armourer on the film set, Gutierrez-Reed’s job was to “set up” the guns. She was the crew member who placed the firearm on the cart that discharged after Baldwin picked it up, firing the bullet that fatally shot Halyna Hutchins.

The 24-year-old is the daughter of Hollywood armourer Thell Reed. Reed is well-known in the industry for having taught Brad Pitt and Val Kilmer “realistic gun handling”. He also worked on Quentin Tarantino’s 2012 movie Django Unchained as the quick draw expert.

After an exhaustive inquiry lasting more than 15 months, Alec Baldwin and two others have been charged over the fatal shooting of cinematographer Halyna Hutchins on the set of Rust,

Mary Carmack-Altwies, the district attorney for New Mexico’s first judicial district, announced the charges on Thursday.

Baldwin and the film’s armourer Hannah Gutierrez-Reed will each be charged with involuntary manslaughter, while first assistant director David Halls has agreed to plead guilty to the charge of negligent use of a deadly weapon.

The charges will be filed by the end of the month, Ms Carmack-Altwies said in a statement.

Alec Baldwin is set to be charged with two counts of involuntary manslaughter in connection to the on-set death of Halyna Hutchins, the Santa Fe District Attorney has said.

New Mexico First Judicial District Attorney Mary Carmack-Altwies said on Thursday that Rust armourer Hannah Gutierrez-Reed will also face two charges of involuntary manslaughter.

“Maybe Alec Baldwin will be lucky enough to share a cell with Michael Avenatti,” Mr Trump Jr tweeted on Thursday in response to the announcement.

Mr Avenatti, a disgraced lawyer, was sentenced to 14 years in prison last month and ordered to pay $11m in restitution after he was found to have embezzled millions from four clients, CNN reported.

“There was such a lack of safety and safety standards on that set… There were live rounds on set,” she told CNN.

“Nobody was checking those or at least they weren’t checking them consistently. And then they somehow got loaded into a gun handed off to Alec Baldwin. He didn’t check it.

“He didn’t do any of the things that he was supposed to do to make sure that he was safe or that anyone around him was safe. And then he pointed the gun at Halyna Hutchins and he pulled the trigger.”

Ms Carmack-Altwies described the production as “a really fast and loose set”.
