Trump withdraws second case against New York attorney general

Comment

Former president Donald Trump on Tuesday withdrew a second lawsuit against New York Attorney General Letitia James (D) related to her office’s fraud probe of his business practices.

A stipulation of voluntary dismissal signed by Trump lawyer Alina Habba and a lawyer for James’s office was filed with a federal appeals court in Manhattan. No reason was given for the withdrawal.

Trump first filed the lawsuit in federal court in Syracuse, N.Y., claiming James was violating his rights and that of his company by pursuing a politically motivated investigation. After a judge in May found “no evidence” that James had acted with bias, Trump appealed the ruling.

Tuesday’s withdrawal of that appeal was the second time in five days that Trump had abandoned litigation against James, who is pursuing a $250 million lawsuit against Trump. It accuses the former president, three of his grown children and executives at his company of flagrantly manipulating property and other asset valuations to deceive lenders, insurance brokers and tax authorities into giving them better bank-loan and insurance-policy rates and to reduce their tax liabilities.

On Friday, Trump — who has announced a bid for the presidency in 2024 — withdrew a separate lawsuit filed in Florida that had sought to bar scrutiny by James of his revocable trust. A one-page filing in a federal district court provided no reason for that withdrawal, either.

Days earlier, U.S. District Judge Donald M. Middlebrooks had fined Trump and Habba almost $1 million for what was ruled a frivolous lawsuit brought against his 2016 presidential rival, Hillary Clinton, and others.

In his 46-page judgment, Middlebrooks cited the lawsuit against James as among those that demonstrated “a pattern of abuse of the courts” by Trump.

New York Supreme Court Justice Arthur Engoron has set an October trial date for James’s major civil case against Trump.

The lawsuit, which could cripple the Trump Organization’s ability to do business in New York, accuses the family-run real estate, golf resort and hospitality business of purposely deceiving lenders, insurance brokers and tax agencies to get preferable loan rates and reduce its tax liabilities by using bogus asset valuation figures from 2011 to 2021.

The Trump lawsuit that was withdrawn last week in Florida had alleged that James had “repeatedly abused her position as Attorney General for the State of New York to pursue a vendetta against President Trump” — a claim similar to what Trump asserted in the New York case withdrawn Tuesday.

Middlebrooks, in his judgment published late Thursday, wrote that Trump is a “prolific and sophisticated litigant who is repeatedly using the courts to seek revenge on political adversaries.”

“He is the mastermind of strategic abuse of the judicial process, and he cannot be seen as a litigant blindly following the advice of a lawyer. He knew full well the impact of his actions,” Middlebrooks wrote. “As such, I find that sanctions should be imposed upon Mr. Trump and his lead counsel, Ms. Habba.”

Trump, Habba and the Habba Madaio & Associates law firm are jointly liable for $937,989.39, the court found.

Trump news latest: Trump reacts as Jan 6 panel withdraws subpoena

January 6 panel unveils report, describes Trump ‘conspiracy’

Former president Donald Trump has gloated against “political thugs” in a new Truth Social rant as he said he did “nothing wrong” after the House select committee investigating the Jan 6 attack announced it would be withdrawing a subpoena against him.

In a statement on Truth Social, Mr Trump wrote: “Was just advised that the Unselect Committee of political Thugs has withdrawn the Subpoena of me concerning the January 6th Protest of the CROOKED 2020 Presidential Election.”

“They probably did so because they knew I did nothing wrong, or they were about to lose in Court. Perhaps the FBI’s involvement in RIGGING the Election played into their decision. In any event, the Subpoena is DEAD!”

The panel will be dissolved upon the new Congress taking office on 3 January.

The withdrawal of the subpoena comes ahead of Mr Trump’s finances falling under the spotlight later this week when the House Ways and Means Committee is expected to release the former president’s tax returns on Friday.

Jan 6 committee releases another tranche of transcripts

The House select committee investigating the attack on the US Capitol on January 6 2021 has released another batch of interview and deposition transcripts.

Included in the latest release are some big names from Trumpworld, including Donald Trump Jr, Kimberly Guilfoyle, and Stephen Miller.

There are also White House insiders that turned against Trump including Stephanie Grisham and Alyssa Farah Griffin, and notably Ray Epps, a pro-Trump attendee of the January 6 rally who marched on the Capitol and was accused of working for the FBI by rightwing conspiracists.

Here’s the full list of what was released today:

The Independent will bring you highlights from these extensive interviews with key players relating to the events surrounding the Capitol riot.

Trump only realised his schedule was public weeks before leaving office, Jan 6 committee told

White House staff began distributing a bizarre statement claiming then-president Donald Trump was spending his days making “many calls” and having “many meetings” in lieu of releasing a detailed daily schedule after Mr Trump discovered the decades-old practice during the final weeks of his term in office, a former press aide to Mr Trump has said.

The amusing revelation is a sign of just how little Mr Trump understood (or, more accurately, cared) about the inner working of his job nearly four years after being sworn in.

Trump launches new attack on FBI citing stale claims

Donald Trump took to Truth Social on Thursday morning to launch a new attack against the FBI – citing many of his favourite baseless claims.

“So, if the FBI illegally suppressed all of the really bad information on the Biden family (laptop!) at a level never seen before, (’it was Russian disinformation,’ they said), while at the same time not letting the many positive things accomplished by ‘Trump’ get out to the public, but would instead put out ‘bad stuff,’ that would be the very definition of the Government’s RIGGING of an Election,” he thundered.

“Pollsters projected this Scam made a difference of Millions of votes. What are the CONSEQUENCES?”

‘Stop the steal’ organiser pushes blame onto far-right allies during Jan 6 testimony, transcript reveals

The organizer of the rally that preceded the Capitol riot reportedly threw his MAGA-world peer Charlie Kirk to the wolves during a meeting with the House Select Committee investigating the Capitol riot.

Ali Alexander, who organised “Stop the Steal,” told the House Select Committee during a closed-door deposition last year that right-wing media figure and Turning Point USA founder Charlie Kirk was among those at fault for the riot.

Biden won’t speak freely near Secret Service

President Joe Biden was so disturbed by the Secret Service’s handling of text messages sought by the House January 6 select committee that he stopped speaking candidly in the presence of special agents assigned to his protection detail, a new book on the Biden White House has revealed.

The agency has been sharply criticised by lawmakers and others after text messages sent by agents on the day of the attack vanished during a scheduled software update — even after the Secret Service was instructed specifically to preserve them.

Cassidy Hutchinson, the former aide to Mark Meadows, has revealed in her testimony to the Jan 6 House committee how the ex-chief of staff routinely burned documents in his office.

A fresh batch of transcripts released by the committee investigating the Capitol riots on Tuesday revealed Ms Hutchinson’s testimony from May in which she had told the committee that she saw Mr Meadows burn documents in his office fireplace around a dozen times – about once or twice a week – between December 2020 and mid January 2021.

Russia withdraws officers from Kherson

KYIV, Ukraine (AP) — Russia’s military leadership has withdrawn its officers in the Russian-annexed city of Kherson across the Dnieper River in anticipation of an advance of Ukrainian troops, the Institute for the Study of War think tank said Sunday.

To delay the Ukrainian counteroffensive as the Russians complete their retreat, Moscow has left newly mobilized, inexperienced forces on the other side of the wide river, it added.

The troop movements come as the Ukrainian military said its forces have continued their counteroffensives in the Kherson and Zaporizhzhia regions.

On Saturday, Russian-installed authorities in Ukraine told all Kherson residents to leave immediately ahead of the expected action by Ukrainian troops to take back the city.

Kherson has been in Russian hands since the early days of the eight-month-long war in Ukraine. The city is the capital of a region of the same name, one of four that Russian President Vladimir Putin illegally annexed last month and put under Russian martial law on Thursday.

On Friday, Ukrainian forces bombarded Russian positions across the province, targeting pro-Kremlin forces’ resupply routes across the Dnieper River and preparing for a final push to reclaim the city.

The ISW think tank also said Sunday that Russia’s latest war strategy of targeting power plants in recent days appears to be aimed at diminishing Ukrainians’ will to fight and forcing Ukraine’s government to spend additional resources to protect civilians and energy infrastructure. It said the effort was unlikely to damage Ukrainian morale but would have significant economic impact.

The Ukrainian military said Sunday that Russian forces are now mostly on the defensive, but are keeping up offensive attacks on Ukraine’s energy infrastructure and on several towns in the eastern Donbas area.

Nine regions across Ukraine, from Odesa in the southwest to Kharkiv in the northeast, saw attacks again targeting energy and other critical infrastructure over the past day, the Ukrainian general staff said. It reported a total of 25 Russian air strikes and more than 100 missile and artillery strikes around Ukraine.

Ukrainian counteroffensive forces in the Kherson and Zaporizhzhia regions, meanwhile, targeted Russian-held facilities, notably in the town of Nova Kakhovka, and carried out 17 air strikes in the overall campaign, according to the Ukrainian general staff.

In a Telegram post Sunday, the Ukrainian military claimed to have destroyed 14 Iranian-made Russian drones over the past day.

Russian S-300 missile strikes overnight hit a residential neighborhood in the city of Mykolaiv, injuring three people, according to the Ukrainian military’s southern command. Two apartment buildings, a playground and a warehouse were damaged or destroyed, it said in a Facebook post. The reports could not be immediately verified.

Elsewhere, Ukraine’s security service said Sunday it has detained the longtime chief of a major aircraft engine factory, accusing him of collaborating with Russia by supplying military equipment for Russian attack aircraft.

Viacheslav Bohuslaiev, president of the Motor Sich plant in Zaporizhzhia, and another top factory official were charged with collaboration and “assisting the aggressor state.”

The Ukrainian security service SBU said in a statement that the two are accused of colluding with a Russian arms maker close to the Kremlin to supply Ukrainian-made engines and spare parts to Russian forces. The SBU described a complex scheme using intermediaries in three countries to evade sanctions against Russia.

Motor Sich is one of Ukraine’s leading manufacturers and has been a key maker of aircraft engines since Soviet times. Its facilities have been repeatedly targeted by Russian strikes during the war. Engines made by Motor Sich were used to equip Russian helicopters before supplies were halted following Russia’s 2014 annexation of Ukraine’s Crimean Peninsula.

Magnus Carlsen Withdraws From Sinquefield Cup

On Monday, GM Magnus Carlsen surprised the chess world by announcing that he was withdrawing from the 2022 Sinquefield Cup, tweeting his decision at the beginning of round four.

At the start of the round, Carlsen’s clock was started against GM Shakhriyar Mamedyarov, but Carlsen never showed up to the board and was forfeited after the 10-minute arrival window expired.

Carlsen was on 1.5/3 after losing in the previous round with White against GM Hans Niemann. According to the tournament regulations, because he didn’t complete 50 percent of his games, Carlsen’s previous results will be annulled from the tournament standings; however, the FIDE rating adjustments from these three games stand.

This is first time that Carlsen has withdrawn from a major event, and many commented that such a withdrawal from a tournament in progress for anything other than health reasons is virtually unprecedented in top-level chess. To find a precedent, one may look as far back as the 1967 Sousse Interzonal where Bobby Fischer withdrew after 10 rounds due to arguments with the organizers.

Online chess fans and commenters were quick to speculate. GM Hikaru Nakamura theorized that Carlsen withdrew because he suspected Niemann of cheating in their game the previous day, saying: “I think that Magnus believes that Hans probably is cheating.”

In an interview after the game, Niemann mentioned that he prepared based on Carlsen’s use of the g3 Nimzo-Indian against GM Wesley So in London 2018. However, this game does not exist. It is possible that Niemann was referring to a Carlsen-So rapid game played in Kolkata, 2019.

In his post-game interview, GM Ian Nepomniachtchi shared his thoughts on the Carlsen-Niemann game, calling it “more than impressive.”

After the round began, the Grand Chess Tour announced that they are taking additional anti-cheating precautions, including a 15-minute broadcast delay and increased radio-frequency identification (RFID) checks.

Asked for comment, Chess.com Chief Chess Officer Daniel Rensch stated: “Chess.com does not discuss Fair Play matters publicly, and as such, we decline to comment on the happenings at Sinquefield Cup and/or any speculations made by the community.”

Team Carlsen declined to comment.

Update: An earlier version of this article stated that Chess.com had not been able to locate any other modern game by Carlsen in the g3-line of the Nimzo-Indian. However, by transposition there was a Carlsen-So rapid game played in Kolkata, 2019.

Will Zalatoris withdraws from TOUR Championship due to back injury

Will Zalatoris has withdrawn from the TOUR Championship with two herniated discs in his back.

Zalatoris had previously withdrawn from last week’s BMW Championship during the third round. He tweaked his back on the third hole Saturday and attempted to play through the injury, but after vigorous stretching and attempted manipulations, he withdrew after the fourth hole. He was just four strokes off the lead at the time.

The 26-year-old entered the TOUR Championship at No. 3 on the FedExCup, set to begin three strokes behind Scottie Scheffler in the Starting Strokes format.

If all 29 players complete 72 holes at East Lake, Zalatoris will finish No. 30 on the FedExCup. The 30th position will receive $500,000 in FedExCup bonus money. No other player’s Starting Strokes will be impacted by Zalatoris’ WD.

Zalatoris will also miss the Presidents Cup next month as he rehabilitates and recovers; he stands No. 7 on the United States Team Standings and was expected to receive a Captain’s Pick.

Zalatoris’ agent Allen Hobbs released the following statement Tuesday:

“After Will’s withdrawal from the BMW Championship on Saturday, his medical team determined that the source of his back pain is two herniated discs. Unfortunately, this means that Will is unable to play this week at the TOUR Championship. He is also very disappointed that he will not have the opportunity to play in next month’s Presidents Cup, where he was hoping to play for Captain Love and represent the United States.  Will would like to thank his fans, sponsors, the TOUR, and his team for all of their support. He is fully focused on getting healthy and back onto the course as soon as he is able.”

The Wake Forest alum earned his first TOUR title at this month’s FedExCup Playoffs-opening FedEx St. Jude Championship, defeating Sepp Straka on the third playoff hole at TPC Southwind. Zalatoris had previously recorded four career runner-up finishes on TOUR, including three at major championships. The 2021-22 season marked his first as a TOUR member; he competed in 2020-21 on Special Temporary Membership.

China unexpectedly cuts 2 key rates, withdraws cash from banking system

SHANGHAI, Aug 15 (Reuters) – China’s central bank unexpectedly cut a key interest rate for the second time this year and withdrew some cash from the banking system on Monday, to try to revive credit demand to support the COVID-hit economy.

Economists and analysts said they believe Chinese authorities are keen to support the sluggish economy by allowing a widening policy divergence with other major economies that are raising interest rates aggressively.

The People’s Bank of China (PBOC) said it was lowering the rate on 400 billion yuan ($59.33 billion) of one-year medium-term lending facility (MLF) loans to some financial institutions by 10 basis points (bps) to 2.75%, from 2.85%.

In a poll of 32 market watchers last week, all respondents had forecast the MLF rate would be left unchanged and 29 had predicted there would be a partial rollover. read more

“The rate cut surprises us,” said Xing Zhaopeng, senior China strategist at ANZ.

“It should be a response to the weak credit data on Friday. The government remains cautious about growth and will not let go.”

New bank lending in China tumbled more than expected in July while broad credit growth slowed, as fresh COVID flare-ups, worries about jobs and a deepening property crisis made companies and consumers wary of taking on more debt. read more

The PBOC attributed its move to “keep banking system liquidity reasonably ample”. And with 600 billion yuan worth of MLF loans maturing, the operation resulted a net 200 billion yuan of fund withdrawal.

Market participants have largely priced in the partial rollover as the banking system was already flush with cash, with interbank money rates hovering at two-year lows and persistently below policy rates.

“Now with hindsight, today’s 10-bp cut may be seen as ‘front-loading’ before the policy room gets narrower going forward as the PBOC sees structural inflation pressure,” said Frances Cheung, rates strategist at OCBC Bank.

The PBOC reiterated it would step up the implementation of its prudent monetary policy and keep liquidity reasonably ample, while closely monitoring domestic and external inflation changes, it said in its second-quarter monetary policy report.

“Despite the warning of inflation risk and flush liquidity condition, the dominating downside risks under the COVID spread and property-sector rout prompted the PBOC to cut rates to stimulate demand,” said Ken Cheung, chief Asian FX strategist at Mizuho Bank.

China’s 10-year treasury futures jumped more than 0.7% in early trade following the rate decision, while yields on sovereign bond for the same tenor fell about 5 basis points.

The central bank also injected 2 billion yuan through seven-day reverse repos while cutting the borrowing cost by the same margin of 10 bps to 2.0% from 2.1%, according to an online statement.

The PBOC lowered both rates by 10 bps in January.
