Tory Lanez Won’t Face Two New Witness Tampering Charges, Judge Rules – Rolling Stone

Prosecutors attempted to add two new witness tampering charges to Tory Lanez’s felony assault trial on Monday but were shut down by the judge who said they waited too long.

Los Angeles Deputy District Attorney Kathy Ta entered her motion for the new charges on Monday, citing California Penal Code 136.1, which makes it a crime to attempt to dissuade a witness.

“It’s based on testimony by both the victim and Ms. (Kelsey) Harris,” about “statements the defendant made in the car, offering them a million dollars” to stay silent about the shooting that wounded Megan in both feet on July 12, 2020, Ta told the court.

Judge David Herriford responded by asking why prosecutors waited so long considering Megan made the underlying allegation early in the case. Ta said she wasn’t sure how Harris was going to testify, but given that she did appear to corroborate Megan’s claim during her turn on the witness stand, they decided to file over the alleged “$1 million bribe.”

Lanez’s defense lawyer George Mgdsyan objected Monday, saying prosecutors had known since September what Harris’ testimony likely would be, and the court agreed. Herriford said the late addition placed the defense in a “difficult position” in terms of planning and response time.

“I think it’s unfair at this juncture, so I would deny that motion,” the judge said.

Lanez, whose legal name is Daystar Peterson and is a citizen of Canada, pleaded not guilty to three felony charges in the high-profile case including assault with a firearm causing great bodily injury; concealing a loaded, unregistered firearm in a vehicle; and the recently added count of discharging a firearm with gross negligence.

If convicted as charged, the Alone at Prom rapper faces 22 years and eight months in prison and subsequent deportation.

Earlier on Monday, prosecutors were unable to locate an important witness and asked the court for an extra day to present their case or permission to re-open their presentation after defense rests. While the witness was not named, a source told Rolling Stone that prosecutors were referring to Megan’s former bodyguard Justin Edison.

Over the weekend, Megan’s lawyer Alex Spiro said Edison went “missing” ahead of his expected testimony in the case. “He was set to testify. He’s somebody who’s always plugged-in, on the grid, responsive, and as he’s set to testify in a violent crimes case, he goes missing,” Spiro said.

In his opening statement last week, Deputy District Attorney Alexander Bott told jurors that Edison would take the stand, and state he visited Lanez’s house a day after the shooting and heard the rapper confess to being the triggerman.

“As the court can see, there has been significant due-diligence with respect to this witness,” Ta argued on Monday, asking for more time.

Judge Herriford signaled he would allow prosecutors to refrain from resting their case as they searched for their witness. “Alright, let’s see how far we can get,” he said.

Prosecutors then re-called two prior witnesses before handing the reins to Peterson’s defense. LAPD Officer Sandra Cabral returned to the stand first to introduce police bodycam footage showing the police stop after the shooting. Jurors saw video of Harris being handcuffed, crying and asking, “Megan, you okay?” as Megan limped away to an ambulance, also in handcuffs.

Cabral said she didn’t see Tory Lanez’s “demeanor” as he was handcuffed and stood with his head down, facing a wall.

On cross-examination, defense lawyer George Mgdesyan asked if Cabral recalled hearing Lanez also express concern for Megan, saying, “Meg-o, you’re gonna to be OK, you OK?” Prosecutors objected to the question, and the judge agreed it was improper, so the officer didn’t answer.

Prosecutors then recalled a D.A. investigator to ask about the so-called diss track targeting Megan that Harris released in November 2020 titled “Bussin Back.” They highlighted the lyrics, “You know it wasn’t me,” and “All you had to do was clear your best friend name,” apparently to further combat the defense theory that Harris could have been the shooter.

Mgdesyan later called Megan’s former stylist Eric Culberson to the stand to testify about the party he attended at Kylie Jenner’s house with Megan, Harris and Peterson ahead of the shooting.

Culberson, known professionally as EJ King, corroborated Harris’ prior testimony that Megan and Harris left Jenner’s house alone in a Cadillac Escalade with Peteron’s driver before they allegedly returned to retrieve Peterson a short time later. When she testified last week, Megan said she didn’t leave the party until she was able to convince Peterson to join her.

The stylist also said he never heard Megan or Harris claim that Tory carried a gun, and that he did not see a firearm at any point the night of the alleged shooting.

NFL suspends Miami Dolphins owner and strips team of draft picks in tampering and tanking probe

The investigation, led by former US Attorney and SEC Chair Mary Jo White and lawyers from the Debevoise law firm, determined that the Dolphins violated anti-tampering rules on three occasions, the NFL announced in a news release Tuesday. The investigation also found that the team did not intentionally lose games, known as tanking, but noted that Ross repeatedly suggested that the team should prioritize its draft position over winning games during the 2019 season, the release said.

As punishment, the Dolphins will forfeit their first-round pick in the 2023 draft and a third-round pick in the 2024 draft. Ross is suspended through October 17, six games into the 2022 season, and fined $1.5 million, the release said.

“With regards to tampering, I strongly disagree with the conclusions and the punishment,” Ross said in a statement posted on the Miami Dolphins Twitter account. “However, I will accept the outcome because the most important thing is that there be no distractions for our team as we begin an exciting and winning season. I will not allow anything to get in the way of that.”

The investigation found that the Dolphins had “impermissible communications” with Brady in 2019-20 while he was a member of the New England Patriots and again during and after the 2021 season when he was under contract with the Tampa Bay Buccaneers, according to the NFL release. Those second discussions focused on Brady “becoming a limited partner in the Dolphins and possibly serving as a football executive,” and also included the possibility of playing for the Dolphins, the investigation found.

The league found Dolphins Vice Chairman Bruce Beal spearheaded the contact with Brady and fined him $500,000. The Dolphins had no comment when asked about Beal’s actions.

Further, in January 2022, the Dolphins had “impermissible communications” with the agent of Payton, who at the time was the New Orleans Saints head coach and has since retired.

“The investigators found tampering violations of unprecedented scope and severity,” NFL Commissioner Roger Goodell said in a statement. “I know of no prior instance of a team violating the prohibition on tampering with both a head coach and star player, to the potential detriment of multiple other clubs, over a period of several years. Similarly, I know of no prior instance in which ownership was so directly involved in the violations.”

The investigation also examined whether the Dolphins intentionally lost games in the 2019 season to improve their draft position, known as tanking. The Dolphins ultimately finished the 2019 season with a 5-11 record and earned the fifth pick in the 2020 NFL draft.

The NFL investigation found the team did not lose games intentionally nor did any member from the club, including Ross, instruct then Dolphins coach Brian Flores to lose games, according to the release. However, the investigation found that Ross repeatedly expressed his belief that the team’s draft position should take priority over the win-loss record.

In February, Flores told CNN that Ross explicitly told him he would give him $100,000 for each game Flores would lose. Ross denied the accusations at the time, calling the claims “baseless, unfair and disparaging.”

The investigation found that people had “differing recollections about the wording, timing, and context” of the claimed offer, according to the NFL news release.

“However phrased, such a comment was not intended or taken to be a serious offer, nor was the subject pursued in any respect by Mr. Ross or anyone else at the club,” the release states.

Goodell said in a statement that the comment, even if made as a joke, risked damaging the integrity of the game.

“Every club is expected to make a good faith effort to win every game,” he said in a statement. “The integrity of the game, and public confidence in professional football, demand no less. An owner or senior executive must understand the weight that his or her words carry, and the risk that a comment will be taken seriously and acted upon, even if that is not the intent or expectation. Even if made in jest and not intended to be taken seriously, comments suggesting that draft position is more important than winning can be misunderstood and carry with them an unnecessary potential risk to the integrity of the game.”

He praised Flores, who was fired earlier this year and has sued the Dolphins, the NFL and other teams alleging racial discrimination, for continuing to try to win games. The NFL and teams have denied the allegations.

“The comments made by Mr. Ross did not affect Coach Flores’ commitment to win and the Dolphins competed to win every game,” Goodell said. “Coach Flores is to be commended for not allowing any comment about the relative importance of draft position to affect his commitment to win throughout the season.”

Flores and attorneys say he was proved correct

In a statement, Flores expressed his disappointment in what he says is the NFL investigation downplaying Ross’s comments on tanking.

“I am thankful that the NFL’s investigator found my factual allegations against Stephen Ross are true,” Flores said. “At the same time, I am disappointed to learn that the investigator minimized Mr. Ross’s offers and pressure to tank games especially when I wrote and submitted a letter at the time to Dolphins executives documenting my serious concerns regarding this subject at the time which the investigator has in her possession.”

His attorneys, Douglas H. Wigdor and John Elefterakis, expressed similar disappointment in the investigation’s assessment of Ross’s comments.

“We are certainly disheartened that the investigator, and apparently the Commissioner, excused highly inappropriate comments that go to the heart of the game’s integrity regarding tanking as being in jest especially when there was a letter written by Coach Flores at the time demonstrating the gravity with which these comments were received by Coach Flores,” they said in a statement.

“The punishment announced today is obviously inadequate and disheartening. Unfortunately, it remains clear that the NFL cannot police itself, which is why we look forward to continuing to push the legal process, prove all of Brian’s claims, as well as those of a class of black executives, coaches and candidate, and force real change upon the NFL.”

Meanwhile, Ross in his statement said the investigation had cleared the Dolphins of tanking.

“The independent investigation cleared our organization of any issues related to tanking and all of Brian Flores’ other allegations,” he said. “As I have said all along, these allegations were false, malicious and defamatory, and this issue is now put to rest.”

NFL suspends Dolphins owner, strips team of 2023 first-rounder for Tom Brady, Sean Payton tampering

Six months after former Dolphins coach Brian Flores accused team owner Stephen Ross of essentially bribing him to lose games for a better draft position, the NFL has temporarily stripped Miami of both Ross and premium draft picks, NFL Media reports. Commissioner Roger Goodell informed the franchise Tuesday that a league investigation found Ross at least hinted at prioritizing draft picks over a winning record in 2019, and that he impermissibly had repeated communications with both Tom Brady and Sean Payton while trying to recruit the big names to his team. As a result, Ross has been fined $1.5 million and suspended through Oct. 17, while the Dolphins must forfeit their 2023 first-round pick and 2024 third-round pick for “violating the integrity of the game.”

The NFL investigation found that the Dolphins did not intentionally lose games in 2019, when the team finished 5-11, and could not support Flores’ notable claim that Ross offered him $100,000 for every loss that season: “(There) are different recollections about the wording, timing and context (of the remark). However phrased, such a comment was not intended or taken to be a serious offer, nor was the subject pursued in any respect by Mr. Ross or anyone else at the club.” It did, however, confirm that Ross repeatedly suggested to Flores, team president Tom Garfinkel and general manager Chris Grier that 2020 draft positioning should trump a better 2019 win total. Ross’ comments, Goodell wrote, “even if made in jest … carry with them an unnecessary potential risk.”

More than the tanking allegations, the NFL in its Tuesday ruling harped on the Dolphins’ contact with Brady and Payton, citing “tampering violations of unprecedented scope and severity.” The investigation, led by former U.S. Attorney Mary Jo White, found that Ross and the Dolphins had “impermissible communications” with Brady on two different occasions — first in 2019, as early as August of that season, while the quarterback played for the rival Patriots; and again during and after the 2021 season, before Brady retired, and later returned, to the Buccaneers. “Those discussions … focused on Brady becoming a limited partner in the Dolphins and possibly serving as a football executive,” the investigation found, “although at times they also included the possibility of his playing for the Dolphins.”

The NFL investigation revealed Ross and the Dolphins also illegally contacted Don Yee, the agent for Payton, in January while the longtime Saints coach was still employed by New Orleans: “Miami did not seek consent from New Orleans to have these discussions, which occurred before Coach Payton announced his decision to retire as head coach of the Saints,” the NFL said. “Following that announcement, Miami requested permission to speak to Coach Payton for the first time, which New Orleans declined to grant.”

While serving his suspension, Ross is not permitted to be present at the Dolphins’ facility or represent the club at any team or NFL event. He is also prohibited from attending any league meetings prior to the annual NFL owners meeting in 2023, or any league committee communications. Bruce Beal, the Dolphins’ vice chairman, has also been barred from attending any league meetings for the remainder of the 2022 season, and fined $500,000.

Ross since released his own statement regarding the punishment, downplaying the tampering charges while celebrating a victory over Flores’ allegations of tanking: “The independent investigation cleared our organization on any issues related to tanking and all of Brian Flores’ other allegations. As I have said all along, these allegations were false, malicious and defamatory, and this issue is now put to rest. With regards to tampering, I strongly disagree with the conclusions and the punishment. NBA investigating Philadelphia 76ers for possible tampering centered on James Harden, P.J. Tucker, Danuel House deals, sources say

The NBA has opened an investigation into the Philadelphia 76ers for possible tampering and early contact centered on the franchise’s summer free agency class of James Harden, P.J. Tucker and Danuel House, sources told ESPN on Friday.

One of the central elements of the league’s probe includes questions on Harden’s decision to decline a $47.4 million player option for 2022-23 and take a pay cut on a new two-year, $68 million deal, sources said. Around the league, there have been questions about whether there’s already a handshake agreement in place on a future contract — which would be in violation of collective bargaining rules.

Sixers president of basketball operations Daryl Morey has already begun answering questions from league attorneys, sources said. The investigation is expected to include interviews with team personnel and the organization turning over electronic correspondence and phone records to league investigators. Teams weren’t allowed to have conversations with agents or players on free agency deals prior to the opening of free agency at 6 p.m. ET on June 30.

Harden is guaranteed $33 million for the 2022-23 season and holds a player option on 2023-24 that would allow him to become a free agent and negotiate another new deal.

NBA investigating Philadelphia 76ers for possible tampering centered on James Harden, P.J. Tucker, Danuel House deals, sources say

The NBA has opened an investigation into the Philadelphia 76ers for possible tampering and early contact centered on the franchise’s summer free agency class of James Harden, P.J. Tucker and Danuel House, sources told ESPN on Friday.

One of the central elements of the league’s probe includes questions on Harden’s decision to decline a $47.4 million player option for 2022-23 and take a pay cut on a new two-year, $68 million deal, sources said. Around the league, there have been questions about whether there’s already a handshake agreement in place on a future contract — which would be in violation of collective bargaining rules.

Sixers president of basketball operations Daryl Morey has already begun answering questions from league attorneys, sources said. The investigation is expected to include interviews with team personnel and the organization turning over electronic correspondence and phone records to league investigators. Teams weren’t allowed to have conversations with agents or players on free agency deals prior to the opening of free agency at 6 p.m. ET on June 30.

Harden is guaranteed $33 million for the 2022-23 season and holds a player option on 2023-24 that would allow him to become a free agent and negotiate another new deal.

Jan. 6 committee notifies DOJ that Trump tried tampering with one of its witnesses, Cheney says

The House select committee investigating the attack on the Capitol on Jan. 6 revealed that they told the Department of Justice that former President Donald Trump contacted one of its witnesses who hasn’t publicly testified yet.

“After our last hearing. President Trump tried to call a witness in our investigation. A witness you have not yet seen in these hearings,” Rep. Liz Cheney, the vice chair of the committee, said on Tuesday.

“That person declined to answer or respond to President Trump’s call and instead alerted their lawyer to the call. Their lawyer alerted us. And this committee has supplied that information to the Department of Justice,” she added.

A spokesman for Trump did not respond to requests for comment.

The Tuesday hearing marked the latest round of testimony that depicts Trump as a president determined to hang onto power after the conclusion of the 2020 presidential election — no matter the cost to American democracy.

The committee showcased fresh testimony from several key witnesses, including former White House counsel Pat Cipollone, who told the panel’s investigators that they repeatedly told Trump the election wasn’t stolen and it was time for the president to concede.

Trump has continued to make false claims about the 2020 election two years after he lost to President Joe Biden. Trump has yet to rule out another run for president in 2024.
