Houston taqueria customer shoots robber: Grand jury to determine whether armed man will be charged for Eric Washington’s death

HOUSTON, Texas (KTRK) — A grand jury will decide whether an armed taqueria customer, who shot and killed a robber last week in southwest Houston and is now being hailed a hero, will be criminally charged.

Investigators said the 46-year-old customer, who police have not identified because he’s not under arrest, turned himself in and is cooperating with detectives.

The 46-year-old’s attorney sent Eyewitness News the following statement:

“My client, who wishes to remain anonymous, was dining with a friend at El Ranchito Taqueria and as it has been seen on video, a robbery suspect entered the restaurant, and pointed a weapon at my client and the other customers demanding money. In fear of his life and his friend’s life my client acted to protect everyone in the restaurant.

In Texas, a shooting is justified in self-defense, defense of others and in defense of property. The customer has met with the Harris County District Attorney’s Office and Investigators with HPD homicide. He fully intends to continue cooperating with the ongoing investigation.

When the investigation is complete, this case will be presented to a Grand Jury. We are confident that a Grand Jury will conclude that the shooting was justified under Texas Law. This event has been very traumatic, taking a human life is something he does not take lightly and will burden him for the rest of his life. For that reason, he wishes to remain anonymous. Due to the overwhelming coverage, we ask the media and the public to respect his privacy.”

University of Houston Law Center Professor Sandra Guerra Thompson said even if he is indicted, a jury likely would not convict.

“When a person uses force during an armed robbery, they have very heightened protection under the law,” Thompson explained. “I know that there are a lot of questions about the use of a gun because it wasn’t a real firearm, but that really doesn’t make a difference because it was used as a firearm and a person would reasonably believe that they were facing an immediate threat of deadly force.”

The suspect can be seen on video taking control of the taqueria and pointing what looks like a gun at customers.

Suddenly, one customer starts shooting, even moving closer to the suspect as he keeps firing shots.

He puts what looks like the customers’ stolen money back on the table, then appears to realize the suspect’s gun wasn’t real.

On Monday, the medical examiner identified 30-year-old Eric Eugene Washington as the robbery suspect who was killed.

Records show Washington had an extensive criminal history and was out on bond during the would-be robbery.

Records show that in 2015, Washington was convicted on a lesser charge of aggravated robbery with a deadly weapon and sentenced to 15 years in prison in connection to the shooting death of 62-year-old Hamid Waraich, a cell phone store owner. Houston police also charged two other men.

According to records, Washington was released on parole in 2021 and charged with assaulting his girlfriend in December 2022.

Waraich had a fiancée and three sons who reacted strongly when contacted by ABC13.

“If the guy who sopped Eric was around 10 years ago, maybe I’d still have my dad,” Aman Waraich, the son of the store clerk that was killed, said.

“Eric was an evil criminal that took joy in harassing and robbing innocent families. The individual at the taqueria is a true hero!” Sean Waraich, the victim’s other son, added. “He did the right thing in stopping the robber and in protecting the community from a dangerous perpetrator.”

WATCH NOW: Police shoot suspected robber at Dick’s Sporting Goods | Crime and Courts

SCHERERVILLE — Police shot and wounded a suspected robber Saturday afternoon at the Dick’s Sporting Goods store, according to the Lake County Sheriff’s Department.

Sheriff Oscar Martinez Jr. said Schererville Police spotted three suspects around 4:30 p.m. as officers arrived at the retailer in the 100 block of Indianapolis Boulevard in response to a call of a robbery.

Martinez said one of the suspects driving a getaway car rammed a Schererville Police patrol vehicle.

Fearing for their safety, Schererville Police opened fire and struck one of the suspects, Martinez said.

The sheriff said the wounded individual was taken to a Region hospital for treatment. The other two were taken into custody.

No police officers or civilians were harmed in the incident, Martinez said.

Some two dozen law enforcement officers from Schererville and surrounding communities also responded to the scene at the busy Shops on Main shopping center.

Yellow crime-scene tape and police SUVs blocked access to a huge swath of the parking lot adjacent to Indianapolis Boulevard and Main Street beginning around 5 p.m. and continuing well into the night. Multiple ambulances also were at the store.

Several shoppers coming and going out of nearby retailers stood in the rain to watch police officers chat in small groups outside Dick’s in the aftermath of the incident.

Schererville Police Chief Pete Sormaz declined to immediately say exactly what happened in and around the sporting goods store.

“It’s an isolated incident, this situation. The investigation is ongoing. We’re trying to get all the pieces together,” Sormaz said. “Right now the outer perimeter, the businesses, everything is safe. It’s just isolated to the Dick’s parking lot right here.”

Crime-scene investigators from the Lake County Sheriff’s Department arrived at Dick’s shortly after 6 p.m.

Sormaz said Schererville Police will provide more information about the incident after the investigation is complete, likely sometime Sunday.

California liquor store owner shoots would-be armed robber

An elderly convenience store owner in California is being hailed as a hero after he shot at a would-be robber who ran out of the store screaming his arm was “shot off.”

Shocking surveillance footage from Norco Market & Liquor at the 2800 block of Clark Avenue in Norco, Calif., showed a masked assailant entering the business at about 2:47 a.m. with an AR-15-style rifle pointed at the 80-year-old store owner.

The suspect yelled, “Freeze, hands in the air,” but within seconds, the quick-thinking store owner pulled out his own rifle from under the counter and immediately shot once at the robber, hitting him in the arm.

Video footage further showed another man getting out of a black BMW SUV, but he stopped and got back inside the vehicle once he saw the first suspect run out of the store repeatedly screaming, “He shot my arm off!” 

The three suspects involved in the attempted robbery were all caught, with the suspect who was shot in the hospital in critical but stable condition.

Riverside County Sheriff’s officials arrested three suspects— Justin Johnson, 22, of Inglewood, Calif., Jamar Williams, 27, of Los Angeles, and Davon Broadus, of Las Vegas, Nevada— at a local hospital.

The primary suspect, a 23-year-old man, remained in critical but stable condition at the hospital, officials said. His identity is being withheld pending his release from the hospital.

“In this case, a lawfully armed member of our community prevented a violent crime and ensured their own safety, while being confronted with multiple armed suspects,” Riverside County Sheriff’s said in a press release. “This investigation is active and ongoing and no additional information will currently be released.”

Employees at Norco Market & Liquor said the owner was watching the store cameras as the SUV pulled into the parking lot. Once he saw the first assailant get out of the SUV and pull a mask over his face, the owner immediately went for his rifle. 

The 80-year-old store owner did not hesitate to defend himself and his business when the suspect entered with his rifle pointing directly at him.

“He just prepared himself … and he stood right here, aimed and shot,”  store manager Marnia Tapia told Fox11. 

The two other suspects frantically drove off after the suspect who was shot ran shouting, “He shot my arm off,” into the car.

Employees said the owner was not at the store on Monday, but Fox11 reported the man suffered a heart attack right after the shooting. He is expected to recover and will be discharged from the hospital sometime Monday night. 

Sheriff’s officials said the SUV used in the attempted robbery was stolen and numerous stolen firearms also were found inside the vehicle. 

Johnson, Williams and Broadus were booked into the Robert Presley Detention Center in Riverside for robbery and conspiracy. They are being held in jail in lieu of $500,000 bail. 

The primary suspect also will be booked at the facility once he is released from the hospital, officials said.

Chicago shooting: Godfrey Hotel guest exchanges gunfire with would-be robber in River North: CPD

CHICAGO (WLS) — A hotel guest traded gunfire with a would-be robber in River North Sunday night, Chicago police said.

Police said a man was staying at the Godfrey in the 100-block of West Huron Street when just after 11:30 p.m. an unknown person knocked on his door.

The 53-year-old victim opened the door and a man forced his way into the room, took out a gun and demanded the victim’s property, police said.

The suspect then began firing shots at the victim and the victim returned fire, police said.

The would-be robber fled the scene and the victim was left with a graze wound to the head, police said.

The victim was treated at the scene by the Chicago Fire Department and refused further medical attention.

Some people staying at the hotel said they’re shaken up by the violence. Nate Montgomery was in his room just a few doors down when he heard the shots.

“I was lying in bed just watching TV and I heard kind of a ‘tap tap tap tap tap’…and then I heard some loud voices and it definitely alerted me,” Montgomery said. “I did not realize it was gunshots to be honest with you.”

Many hotel guests had no idea anything had happened.

“I was very shocked to find out because nobody said anything,” said hotel guest Athena Belluso. “Like I came down into the lobby and nothing was said.”

Meanwhile, hotel general manager Todd Van Winkle made some brief remarks to assure guests the hotel is safe and this was an isolated incident.

“The safety and security of the hotel’s guests and employees are always a top priority for us,” Van Winkle said. “The hotel team is fully cooperating with the Chicago Police Department in their ongoing investigation.”

Police recovered a weapon from the scene. No one is in custody.

Fontana suspected bank robber dead after police shooting outside Wendy’s fast-food restaurant, officials say

FONTANA, Calif. (KABC) — A suspected bank robber is dead after a confrontation with police that ended in a shooting outside a popular fast-food restaurant in Fontana Thursday afternoon, officials said.

Officers responded to the 15100 block of Summit Avenue just before 1:30 p.m. for reports of an armed bank robbery at Bank of America, according to the Fontana Police Department.

The agency says witnesses saw the suspect flee the bank and go across the parking lot into a Wendy’s restaurant, and when responding officers arrived, they confronted the suspect as he was coming out of Wendy’s.

At some point during the confrontation with police, an officer-involved shooting occurred fatally injuring the suspect, officials said.

It’s not clear what sparked officers to open fire.

The suspect, who has not been identified, died at the scene. A handgun was recovered, according to police.

“The suspect could have taken hostages, and that’s something that the officers were concerned of when he actually made it into the restaurant,” said Fontana police officer Daniel Romero. “We were very lucky in today’s incident. Everything went our way. Any little thing that could have changed, could have caused an innocent person to get hurt.”

No officers were injured in the incident.

The investigation is ongoing.

‘Black Panther’ Director Ryan Coogler Mistaken for Bank Robber

Bank of America has apologized to the director Ryan Coogler after he was assumed to be a bank robber and briefly handcuffed by the police while trying to withdraw money from a branch in Atlanta in January.

Mr. Coogler, best known for directing “Black Panther,” had handed a teller a withdrawal slip on Jan. 7, asking for more than $10,000, with a note on the back asking her to “be discreet when handing him the cash,” according to a police report.

Mr. Coogler also had his California state ID card as well as his Bank of America card when he approached the teller. Both Mr. Coogler and the teller are Black.

The teller “received an alert notification” from Mr. Coogler’s account and quickly advised her manager that he was trying to rob the bank branch in the Buckhead section of Atlanta, the report states.

The police were called and when they arrived they found an S.U.V. parked in front of the bank.

The driver identified Mr. Coogler as a movie producer and said he was waiting for Mr. Coogler while he was making a transaction inside the bank. A woman who was a passenger in the S.U.V. gave the same information.

The officers were given a description of Mr. Coogler that matched the description of the man who was reported to have been trying to rob the bank, the police said.

The officers said they detained the driver and passenger and placed them in a patrol car. They then removed Mr. Coogler from the bank in handcuffs and determined that he was not a bank robber, according to the police report.

The police confirmed that the episode resulted from a “mistake by Bank of America and that Mr. Coogler was never in the wrong,” according to the report, which adds that Mr. Coogler was immediately taken out of handcuffs and that the two others were taken out of the patrol car.

All three were “given an explanation of the incident as well as an apology for the mistake by the Bank of America,” the report states.

In body camera video released by the police, Mr. Coogler was shown sitting handcuffed in the back of a police car.

He explained that he had been withdrawing money to pay a medical assistant who works for his family. He said that he had passed a note asking for a discreet withdrawal because he doesn’t feel safe when he withdraws cash to pay her and has to wait as the bills are passed through a counting machine.

“I’m trying to get money out of my own account,” he told the police in the video. The teller “never said it was a problem,” Mr. Coogler said, adding that he had used his bank card and PIN and had given her his ID.

Mr. Coogler, who was wearing a cap, sunglasses and a mask, said that he was waiting for her to bring his money when he heard the sound of guns being taken out from their holsters as the police arrived.

“She got scared when a Black dude handed her a note,” Mr. Coogler said. “I don’t know what else to say.” He added, “If she was scared, she’s got to admit that.”

In a separate video released by the police, the teller told investigators that Mr. Coogler kept pointing to the note and, even though he handed her his ID, her “stomach started turning.” On her computer, the withdrawal was flagged as a “high-risk transaction,” she said. She said she told her manager, “I don’t feel comfortable about this transaction.”

The manager suggested they talk to the customer, but she was worried he might have a gun, she said, and so she called 911. She added that, as a pregnant woman: “I have to protect myself. I have to protect my child.”

In a statement on Wednesday, Mr. Coogler said, “This situation should never have happened.”

He added that Bank of America “worked with me and addressed it to my satisfaction and we have moved on.”

Bank of America said in a statement: “We deeply regret that this incident occurred. It never should have happened, and we have apologized to Mr. Coogler.”

In addition to directing “Black Panther” (2018), Mr. Coogler also directed the “Rocky” spinoff “Creed” (2015) and “Fruitvale Station” (2013), which is about the fatal shooting of a Black man, Oscar Grant III, by a white police officer on a subway platform in Oakland, Calif., in 2009.

In 2019, “Black Panther” became the first Marvel film to secure an Oscar nomination for best picture. It was nominated for seven Academy Awards and won in three categories, including best original score and best costume design.

ATLANTA — Black Panther director Ryan Coogler was mistaken for a bank robber at a metro Atlanta Bank of America and detained, police reports show.

The incident unfolded on Jan. 7, 2022 at the Bank of America at 1280 West Paces Ferry Road, when police responded to reports of a man trying to rob the bank.

According to an Atlanta Police Department report, a Bank of America employee called police after Coogler passed him a filled-out withdrawal slip with a note written on the back asking tellers to be discreet with the transaction.

When officers arrived on scene, Coogler was still inside the bank. Officers brought him outside and handcuffed him as they investigated.

TRENDING STORIES:

Officers determined that Coogler was attempting to withdraw a cash amount valued over $10,000 dollars. The bank teller received a notification from Coogler’s account and told her manager that he was trying to rob the bank.

Officers determined that the incident was a mistake by Bank of America and Coogler was released. Two people who Coogler was with were also detained and released, but never handcuffed.

Bank of America apologized to Coogler and he was allowed to go on his way.

Bank of America issued a statement confirming the incident, writing:

“We deeply regret that this incident occurred. It never should have happened and we have apologized to Mr. Coogler”

Channel 2 Action News received a statement from Coogler’s public relations team:

“This situation should never have happened. However, Bank of America worked with me and addressed it to my satisfaction and we have moved on,” said Coogler.

Coogler directed the original Black Panther, which was the highest-grossing film of all time by a Black director. He has been in Atlanta directing the Black Panther sequel, “Black Panther: Wakanda Forever.”

The incident occurred sometime in January but was revealed by TMZ on Wednesday morning. Coogler, 35, walked into the bank wearing a green hoodie, black beanie and sunglasses.  

He passed the cashier a note which read: ‘I would like to withdraw $12,000 CASH from my checking account. 

It remains unclear why he needed the money, or why two others had driven him there in an SUV to retrieve it. 

‘Please do the money count somewhere else. I’d like to be discreet.’

The note spooked the cashier, who was described in the police report as a ‘pregnant black woman’. 

She called police claiming Coogler was a bank robber. 

Police arrived and detained two people who were waiting for him in an SUV parked outside. 

TMZ reports that they then went inside the bank and placed Coogler in handcuffs too. 

Once they realized it was a misunderstanding, they let him go. 

Coogler was furious about the mistake and demanded the badge numbers of the cops involved, according to the report. 

The movie director has been in Atlanta for the last several months filming the sequel to Black Panther, Black Panther: Wakanda Forever. 

He lives in California. Coogler told Variety this morning: ‘This situation should never have happened. 

‘However, Bank of America worked with me and addressed it to my satisfaction and we have moved on.’  

The production has been besieged by cast injuries and vaccine rows. 

Letitia Wright, who will reprise her role as Shuri, was severely injured while filming in August last year in Boston. 

It is unclear what exactly happened, but the actress suffered a concussion and fractured shoulder while performing a stunt on-set. 

In a note to the cast and crew in November last year, Kevin Feige, Louis D’Esposito and Nate Moore of Marvel Studios called it a ‘frightening’ accident. 

The sequel is due to be released on November 11, 2022. It will no doubt be a box office hit, following on from the record-breaking success of the first movie.  

Fans are eager to see how the story will playout in the absence of Chadwick Boseman, the franchise’s beloved central star who died from cancer in August 2020.
