Santa Claus rally, FTX fallout, and restart of Keystone top week ahead

Investors are poised this week to see whether Christmas miracles really do come true with hopes for a Santa Claus rally. Thus far, the Nasdaq is down 8.7% over the past month, while the S&P 500 and Dow are lower by 4.5% and 3.3%, respectively.

While Sam Bankman-Fried’s next court date is not until Jan. 3, 2023, investors will nonetheless be focused on FTX this week after co-founder Gary Wang and former Alameda Research co-CEO Caroline Ellison both entered guilty pleas in federal court. Both are said to be cooperating with authorities.

Initial public offerings this week could include biotech Coya Therapeutics, health tech Nava Health MD, wealth and asset manager Prestige Wealth and marine bunkering facility provider CBL International.

Tuesday brings economic data, including the Federal Housing Finance Agency’s monthly home price index, which is expected to fall by 0.30% since last month but is still expected to be up by 9.1% year over year.

Last month, William Doerner, the supervisory economist in FHFA’s Division of Research and Statistics commented: “The rate of U.S. house price growth has substantially decelerated. This deceleration is widespread with about one-third of all states and metropolitan statistical areas registering annual growth below 10 percent.”

Tuesday will also see the Case-Shiller home price index. Observers expect the measure to fall by 1.2% month over month. House prices are falling as high mortgage rates deter buyers from entering the market. Mortgage rates remain nearly double what they were a year ago, despite falling for six weeks straight.

To cope with high inflation and higher costs, UPS will raise delivery fees on Tuesday. Investors will be watching this closely to see how elastic shipping demand is.

Tuesday also marks the deadline for certification of new versions of the Boeing 737 Max, the -10 and -7, and retrofitting existing planes; however, as part of the spending bill passed by the Senate last week, Boeing has been granted an exemption and will no longer have to make the safety changes.

The Department of Energy’s deadline for bids to refill the Strategic Petroleum Reserve (SPR) will expire on Wednesday. President Joe Biden announced the release of 15 million barrels in October.

SpaceX is expected to launch two rockets on Wednesday. Both missions will use SpaceX Falcon 9 rockets. Clemson QB DJ Uiagalelei expected to transfer to Oregon State in attempted career restart, per report

It looks like DJ Uiagalelei is turning in the orange and purple of Clemson for the orange and black of Oregon State. Uiagalelei appears poised to join the Beavers for the 2023 season via the transfer portal, according to ESPN, after a career that did not go as expected with the Tigers.

Uiagalelei, a five-star prospect in the Class of 2020, was benched for Cade Klubnik during Clemson’s ACC Championship Game victory over North Carolina. He entered the transfer portal two days later. This after Uiagalelei was pulled during a number of games throughout the season as Clemson’s offense consistently struggled to find its footing.

There had been speculation that Uiagalelei would transfer to UCLA, Washington or Oregon late in the season, but Washington and Oregon saw Michael Penix Jr. and Bo Nix return for 2023, and Kent State’s Collin Schlee transferred to UCLA. There was even some speculation — including a 247Sports Crystal Ball prediction earlier in the week — that Uiagalelei would end up at Hawaii.

Instead, it’s another Pac-12 program that will look to help the former five-star prospect live up to his potential. Uiagalelei’s decision will come just days after his brother, five-star 2023 EDGE Matayo Uiagalelei, committed to rival Oregon on National Signing Day.

Best move for all parties

The No. 10 player in the 2020 class, Uiagalelei was expected to be the next superstar QB for Clemson, following in the footsteps of Deshaun Watson and Trevor Lawrence. He did not live up to the hype. Through two seasons with the Tigers as a starter, DJU struggled to find consistency as a passer. He completed only 59.8% of his passes for 6.6 yards per attempt, and he finished the 2021 season with more interceptions (10) than passing touchdowns (nine). While he rebounded in 2022 with 22 touchdowns and only seven interceptions, the speculation of possibly being replaced by Klubnik in 2023 seemed to weigh on him late in the season. He completed only 10 of 34 attempts over his final two games.

Now, Uiagalelei gets a fresh start in the Pac-12 with the Beavers. He’ll be playing in the same state as another transfer quarterback who needed a fresh start out West and found one in Bo Nix out of Auburn. Meanwhile, Clemson can move on to Klubnik. Many Clemson fans will argue that Dabo Swinney waited too long to make the move, and it’s possible that if Uiagalelei had returned in 2023, he’d still be the starter and the Tigers would’ve risked losing Klubnik to the transfer portal.

DJU is an upgrade for Oregon State

While Uiagalelei is unlikely to ever live up to the hype surrounding him out of high school, it’s not as if he isn’t a talented player. Now he’ll be playing in an offense under Jonathan Smith that, frankly, is better equipped to take advantage of his talents. While Uiagalelei did himself no favors at Clemson, the Tigers’ scheme deserved a considerable share of the blame, too.

At Oregon State, Uiagalelei joins a team that went 10-3 this season despite losing starting QB Chance Nolan to an injury five games into the season. Nolan was replaced by Ben Gulbranson, who performed admirably but was not a difference-maker Uiagalelei could be.

Pac-12 is deep at QB league

Now, plenty of people — myself included — were saying the same thing about the ACC in 2022, and we saw how that worked out for Uiagalelei, Clemson and the conference as a whole. Still, the Pac-12 will have reigning Heisman Trophy winner Caleb Williams back next season. Nix is back at Auburn, and Penix is at Washington. Schlee isn’t a household name, but he put up big numbers at Kent State, and the Bruins also have a five-star freshman in Dante Moore coming to Brentwood.

Add Uiagalelei to the mix — with Cam Ward at Washington State, Jayden de Laura at Arizona, Drew Pyne at Arizona State and Sheduer Sanders at Colorado — and the Pac-12 looks to have some considerable QB depth.

BAE, U.S. in Talks to Restart M777 Howitzer Production After Ukraine Success

PLC said it was considering restarting production of the M777 howitzer, as the big gun’s performance on Ukrainian battlefields revives interest in the weapon.

BAE said several countries had expressed an interest in buying M777s, production of which is currently being wound down. The inquiries come after Ukrainian forces have been using the artillery piece to deadly effect against Russian troops in recent months.

The company said it was now in talks regarding the restart with the U.S. Army, which runs the weapon’s program. The U.S. government must approve any foreign sales. The U.S. Army declined to comment, referring queries on the matter to BAE.

The M777’s potential resurrection exemplifies how the war in Ukraine could reshape the global armaments industry. High-profile weaponry including the U.S. M142 High Mobility Artillery Rocket System, or Himars, and the Anglo-Swedish NLAW portable antitank missile, which have proven very effective against Russian forces, are likely to win new orders, analysts say. Meanwhile, the poor performance of many Russian arms is expected to dent their sales on global markets.

The M777 has allowed Ukraine’s forces to fire a wider variety of projectiles than was possible with older weapons.

The howitzer, a class of mobile, long-barreled, battlefield gun, has long been a cornerstone of modern artillery. However, it has taken on a more prominent role in the war in Ukraine than in other recent conflicts such as the one in Afghanistan or the second war in Iraq.

The performance of the M777 in particular has been enhanced by the increasing use of precision GPS-guided shells, rather than traditional unguided shells. The M777 is also one of the most plentiful pieces in Ukraine’s Western-supplied artillery, which includes at least 170 of the guns received from the U.S., Australia and Canada.

Easy for troops to operate and less expensive than many other similar types of Western artillery, the M777’s reliability and versatility have drawn attention among military specialists and analysts.

“The demonstration of the effectiveness and utility of a wide variety of artillery systems is what is coming out of the Ukraine conflict,” said Mark Signorelli, a vice president of business development at BAE, one of the world’s largest defense companies.

BAE said that if inquiries from prospective M777 buyers, which include countries in Central Europe, turned into actual orders, it could lead to up to 500 new howitzers.

Easy for troops to operate and less expensive than similar types of artillery, the M777’s reliability and versatility have drawn the attention of military specialists.

“Inquiries don’t always turn into contracts,” said Mr. Signorelli. To restart the M777 production line profitably, the company needs at least 150 unit orders, he added.

The U.S. Army isn’t expected to add to its stockpile of M777s. The Army and Marines have purchased more than 1,000 of the guns, which entered service in 2005.

The M777 was primarily manufactured in the U.K. but often assembled in the U.S., and the program is currently in the final stages of producing its last orders, for India.

Phillips O’Brien, professor of strategic studies at the University of St. Andrews in Scotland, said that Himars and other Western rocket-launch systems have probably been more important in destroying Russian logistics and control centers.

“But when it comes to engaging Russian military forces directly in the field, the M777s, one assumes, are carrying a larger burden,” he said.

The M777 has positives and negatives when compared with rival guns. Unlike the German Panzerhaubitze 2000 and French Caesar howitzer, which are also being used in Ukraine, the M777 has to be towed. It also has a lower fire rate than those other European weapons, according to an officer in Ukraine’s military intelligence.

However, the M777 has found favor with Ukrainian forces for its greater accuracy and ease of use, he said.

The M777 fires standard Western ammunition, meaning Ukraine is less reliant on dwindling supplies of Russian-made shells, said Mark Cancian, a senior adviser with the CSIS International Security Program and a former artillery officer in the U.S. Marine Corps. The M777 can also fire a wider variety of projectiles, including guided shells, than the Soviet artillery that had been in Ukraine’s armory, he added.

The M777 howitzer was also used by U.S. forces during the war in Afghanistan.

The U.S., the U.K. and Sweden have given the howitzer new capabilities by creating GPS-guided shells that are far more precise than earlier-generation unguided projectiles.

Raytheon Technologies Corp.

and BAE, can strike within less than 10 feet of a target, even at their maximum range of around 30 miles, according to Pentagon and company documentation. Targeting of traditional artillery shells grows increasingly imprecise with firing distance because of wind and other factors. Even modern unguided Western-made artillery shells can land as much as 500 feet from a target located 15 miles away.

That kind of precision, previously achievable only with laser-guided projectiles or expensive air-to-ground explosives, is changing combat. U.S. Himars rocket launchers and larger M270 Multiple Launch Rocket Systems use similar GPS-guided missiles that have wrought crippling damage on Russian forces.

While the rockets used in U.S. guided missile systems cost $150,000 each, the sort of standard shell used in an M777 is $800, Mr. Cancian said, citing Department of Defense budget documents. A guided Excalibur shell is around $68,000, he said.

But as the U.S. and its allies supply Ukraine they are depleting their own inventories. The war has, for instance, run down U.S. stocks of ammunition used in howitzers, and the Pentagon has been slow to replenish its arsenal.

Dormant supply lines often can’t be switched on overnight, and surging production of active lines can take time.

BAE estimates that it would take some 30 to 36 months to restart full production of the M777, not least because the company needs a new supplier of titanium material and suppliers to produce the weapon’s lightweight components.

Colombia to restart peace talks with the country’s largest active guerrilla group | Colombia

Colombia’s government and the nation’s largest remaining guerrilla group have announced that they will restart peace talks next month for the first time since 2018.

After meeting in Caracas, representatives of the Colombian government and the National Liberation Army issued a statement saying a start date for the peace talks would be announced after the first week of November. The statement added that Norway, Venezuela and Cuba would be “guarantor states” in the talks, and that the participation of civil society groups would be “essential” for the peace talks to succeed.

A venue for the talks has not yet been announced, though an ELN commander, Antonio García, suggested that different stages of the negotiations could be held in Cuba, Norway and Venezuela.

The ELN was founded in the 1960s by students, union leaders and Catholic priests inspired by Cuba’s revolution. The group is believed to have about 4,000 fighters in Colombia and is also present deep inside Venezuela where it runs illegal goldmines and drug trafficking routes.

After a 2016 peace deal between the Colombian government and the Revolutionary Armed Forces of Colombia (Farc), the ELN became the nation’s largest remaining guerrilla group. Since then it has increased its activities in territories that were formerly under Farc control. The group is known for staging kidnappings for ransom and attacks on oil infrastructure and has been listed as a terrorist organisation by the US and the EU.

Colombia’s recently elected president, Gustavo Petro, is the nation’s first leftist leader and has promised to make peace deals with the ELN and other armed groups in Colombia. He has shifted away from the strategy of the previous government, which suspended talks with the ELN after the rebels refused to stop attacking military targets.

In a press conference after the meeting between both sides, Colombia’s peace comissioner Danilo Rueda said that the ELN had shown changes in its behaviour which had enabled it to gain the government’s trust. Rueda said that the rebel group had recently released hostages and scaled back attacks against the Colombian military.

The ELN did not disclose any details on what it would seek in exchange for laying down its weapons. But the commander, García, hinted that the group was looking for political and economic changes.

“The way to look for peace is not just by thinking about weapons but by attacking the root causes of this conflict which are inequality and the lack of democracy,” García said.

In the 2016 peace deal with the Farc, Colombia gave the rebel group 10 seats in the nation’s congress as well as the possibility of forming its own political party, while rebel leaders who collaborated with a transitional justice system were able to evade prison sentences. Colombia’s government also agreed to finance land titling schemes and rural development projects as part of the peace deal.

Skipped cancer screenings this past year? It’s time to restart

Many people postponed routine medical care because of disruptions related to the Covid-19 pandemic. That includes a decline in cancer screenings, such as mammograms and colonoscopies. In the meantime, cancer remains one of the major causes of death in the United States, second only to heart disease.

Why is cancer screening so important, and who should be screened for what types of cancer? How can people find out when their last exam was and what they are due for now? What if someone has fallen behind on their cancer screenings? And what should people do if they remain very concerned about their risk of contracting the coronavirus?

To help us with these questions, I spoke with CNN Medical Analyst Dr. Leana Wen, an emergency physician and professor of health policy and management at the George Washington University Milken Institute School of Public Health. She is also author of “Lifelines: A Doctor’s Journey in the Fight for Public Health.”

CNN: Why is getting screened for cancer so important?

Dr. Leana Wen: Regular cancer screening is key to detecting cancer early. That allows for cancers to be found before someone has symptoms. In general, early detection of cancer results in better outcomes. A small, localized tumor may be removed before it has spread to other parts of the body, for example. Screening can also find abnormal cells that could become cancer, and prompt treatment could prevent that cancer from developing and spreading.

CNN: Who should be screened for which cancers, and when?

Wen: The three primary types of cancer screenings supported by the US Centers for Disease Control and Prevention are for breast, cervical and colorectal cancer. The US Preventive Services Taskforce (USPSTF), an influential national organization that makes disease prevention recommendations, advises mammograms every two years for women who are between 50 and 74 years old, who are at average risk for breast cancer.

A mammogram is a type of X-ray and available at most hospitals and outpatient radiology centers. According to the USPSTF, those at higher risk within this age group, and those under 50, should speak with their physician to determine the frequency of screenings. Some other medical organizations, including the American Cancer Society, recommend more frequent annual screening mammograms.

Cervical cancer screening is done through a Pap test, in which a health-care provider does a gynecological exam to collect a few cells and mucus from the patient’s cervix. The USPSTF recommends that for women and other people who have a cervix to receive a Pap test every three years starting at age 21, until age 65. Some individuals may receive more frequent screenings, depending on their risk factors.

The USPSTF also recommends that for all adults ages 45 to 75 to be screened for colorectal cancer. There are several screening tools involved. One is a stool-based test that detects the presence of certain markers in your stool. Another is the colonoscopy, which involves a procedure that uses a long flexible scope to look into your rectum and colon. The colonoscopy is generally recommended every 10 years. Which tests, and how often, will also depend on the individual’s medical history and family history.

CNN: What about lung cancer, which is another leading cause of death?

Wen: Lung cancer screening is also supported by the CDC, specifically for individuals between 50 and 80 years old with a history of heavy smoking, who smoke now, or who have quit within the past 15 years. The USPSTF recommends annual low-dose computed tomography screening, which is a type of CT scan that can be done in many hospitals and radiology facilities.

CNN: Are there other cancers people should screen for — for example, what about ovarian cancer or pancreatic cancer?

Wen: There are a lot of cancers, including ovarian, pancreatic, thyroid and skin cancer, for which there isn’t sufficient evidence to justify regular, ongoing screening tests in individuals with average risk factors. If there is a particular type of cancer that runs in your family, you should ask your physician about the benefits of screening. Of course, if you develop symptoms — for example, you discover a new growth on your neck or there is a discoloration of your skin that’s changing in appearance — you should definitely consult your healthcare provider.

CNN: A lot of people may not recall when they had their last screening test, especially if they moved or changed healthcare providers. How should they find out if they’re due?

Wen: If you’ve had the same doctor throughout, you could call your physician’s office and find out the dates of your last screening tests. If you changed physicians but they are in the same hospital network, your healthcare system should have these records — and you might be able to access them if your provider offers an electronic patient portal.

Another possibility is to contact your insurance company, if you’ve had the same insurance company over the last several years. They should also have records of your last preventive tests. And you can always contact previous providers. In general, it’s a good idea to have copies of your old medical records so they can be compared with new test results.

CNN: What if you missed several screening tests? Would you recommend that people catch up with them as soon as possible?

Wen: Yes. A lot of patients missed screening tests for all kinds of reasons. Perhaps fear of Covid-19 resulted in delays. Perhaps they moved or changed jobs. Perhaps they had kids or grandkids or other new caregiving responsibilities, and life got busy. Find out which tests you are due for and start scheduling them now.

I’d add that this goes for other preventive services too. Make sure you are also on track with screenings for high blood pressure, diabetes, high cholesterol and other chronic conditions. The sooner these conditions are detected and flagged as potential problems, the sooner you can know and begin to address them.

CNN: There are some people who remain very concerned about their risk of contracting Covid-19 while undergoing screenings. What’s your advice for them?

Wen: Healthcare settings tend to be very cautious and have been taking many steps to reduce Covid-19 risk. People who are concerned about contracting Covid-19 should ask the facility where they’d get the tests what type of mitigation measures are being used. Are all staff masked while seeing patients, for example? Remember that one-way masking with a high-quality mask works very well. For mammograms and Pap tests, and for visits with your doctor, you can wear an N95 or equivalent throughout the exam. For colonoscopies, this might not be possible during the whole procedure, but almost certainly the colonoscopy will be done in a room where others are masked the entire time.

You can also reduce your risk of severe illness further by making sure you are up-to-date on your coronavirus boosters. If you are eligible for the preventive antibody Evusheld, that’s something you should take advantage of too.

Finally, it’s important to put the risk of Covid-19 into context. Absence of the coronavirus is not the only marker of good health, and we need to consider good health, both physical and mental health, in a holistic way, which includes keeping on track with preventive healthcare like cancer screenings.

Cern scientists restart hunt for answers to mysteries of universe

The world’s biggest particle accelerator will be fired up again next week as scientists resume research into the mysteries of the universe after a three-year shutdown for work to improve the machine’s power and precision.

The restart of the Large Hadron Collider at the Cern laboratory near Geneva coincides with the 10th anniversary of the celebrated discovery by its researchers of the Higgs boson, a long-sought fundamental particle that gives mass to other subatomic components of the universe.

Scientists hope that increasing the energy and frequency with which protons collide in the LHC’s experiments, after accelerating almost to the speed of light in a 27km underground ring, will provide evidence for “new physics” — fundamental forces and particles that go beyond the so-called standard model, to which the Higgs boson gave a finishing touch.

Thousands of physicists work on the LHC at the Cern headquarters close to the Swiss-French border and remotely from universities around the world. Among other questions, they are hoping to discover why matter rather than anti-matter dominates the universe and to uncover the nature of “dark matter” — invisible to all scientific instruments so far developed — which is known to be more plentiful than conventional matter.

Some physicists have expressed concern that though well deserved, the excitement over the Higgs discovery and its recognition with a Nobel Prize the following year may have misled the public into believing that finding new particles is the apogee of particle physics — and led to disappointment that nothing so spectacular has emerged since 2012.

“Of course it would be fantastic to see unambiguous evidence of new physics and we always hope, when analysing data, that this will be the moment we observe something . . . like a new fundamental particle,” said Tara Shears, Cern researcher and physics professor at Liverpool university in the UK.

“But it might be that new physics shows itself indirectly, by causing a pattern of differences in particle behaviour that our theory can’t explain and that would take longer to amass the evidence for and understand,” she said. “It all depends on what the nature of new physics is — and as we don’t know this, we have to try every avenue we can think of to find it.”

Gavin Salam, physics professor at Oxford university, pointed out that scientists have learnt a huge amount about the Higgs boson from LHC data over the past 10 years. “Our exploration of Higgs and its interactions has moved far beyond our original expectations,” he said.

LHC experiments have shown that the boson is responsible for the mass of an increasing number of other particles, extending the scope of the standard model.

The supercharged LHC would take that process far further, Salam said. One key question he hopes will be answered is whether the Higgs boson is really an indivisible fundamental particle or is composed of other particles.

Several hints of new physics from previous experiments will be investigated in the next LHC run. One finding was an unexpected discrepancy between the behaviour of the electron and its heavy cousin the muon, which appears to contravene the standard model, though the data was insufficient for the researchers to be sure.

Another was an observation from the now-closed Tevatron particle accelerator at Fermilab in the US, which found that another subatomic particle, the W boson, had an unexpectedly large mass that was inconsistent with the standard model. LHC experiments will add enough statistical power to disprove or confirm that inconsistency.

“It is important to add that not seeing evidence for new physics doesn’t mean you haven’t learned anything from searching — far from it,” said Shears.

Bill Cosby civil trial jury will have to restart deliberations after nearly reaching verdict

Jurors in the civil trial for sexual misconduct allegations against actor and comedian Bill Cosby must start deliberations over after reaching a verdict on Friday for nearly all the questions asked of them.

After two days of deliberations, the jury had concluded whether Cosby sexually assaulted plaintiff Judy Huth at the Playboy Mansion in 1975 when she was just 16-years-old, and whether she deserved any damages. 

Jurors answered eight of nine questions on their verdict form: the final one asking if Cosby’s actions warranted punitive damages.

Judge Craig Karlan had promised one juror that she could leave after Friday for a prior commitment.

The judge opted to read the verdict on the questions the jury had answered despite objections from Cosby’s attorneys. However, Karlan had to reverse his decision when deputies at the Santa Monica Courthouse showed up and required him to clear the courtroom. The courthouse has a required 4:30 p.m. closing time due to there being no budget for deputies’ overtime.

Karlan wouldn’t require the juror who had to leave to return on Monday, so deliberations will have to restart with an alternate juror in her place. “I won’t go back on my word,” he said.

Earlier in the day, a note was given to the judge about what he referred to as a “personality issue” between two of the jurors that was making their work difficult.

The judge called the two jurors to the courtroom and had them agree to allow every juror to be heard in discussions. The jurors resumed deliberations but had several questions on issues with their verdict form that the judge and attorneys had to talk about and answer, including how to calculate damages.

Cosby lawyer Jennifer Bonjean requested a mistrial after lunch because of a photo taken by a member of Cosby’s team showing a juror standing near one of the comedian’s accusers who had been sitting in the audience.

Artist Lily Bernard, who has filed her own lawsuit against Cosby, said she had not talked to any jurors.

“I never spoke to any juror, ever,” Bernard told the judge from her seat in the courtroom. “I would never do anything to jeopardize this case. I don’t even look at them.”

Jurors started deliberations Thursday morning following a two-week trial. Cosby was not in the courtroom.

The 84-year-old was freed from prison last year after the Pennsylvania Supreme Court overturned his 2018 criminal conviction. In a snippet from a 2015 video deposition shown to jurors, Cosby denied having any sexual contact with Huth. His spokesman and attorney have each reiterated his denial throughout the trial.

Bonjean asked the jury in closing arguments to tune out public allegations against Cosby and only consider the evidence presented during the trial. She said the evidence does not prove Huth’s case.
