Parkland Shooting Trial Live Updates: Latest News

Once Nikolas Cruz pleaded guilty last year to 17 counts of murder in the first degree and other charges, prosecutors no longer had to prove at trial that he had committed the deadly mass shooting at Marjory Stoneman Douglas High School in Parkland, Fla. His culpability was settled.

What the plea did not settle was his sentence. In Florida, first-degree murder is a capital felony, punishable by either death or life imprisonment without the possibility of parole. And state law requires that a jury determine which it should be.

If the defendant had been convicted at trial, the same jury that handed up the verdict would have been retained for a separate sentencing proceeding. But when a defendant pleads guilty before trial to a capital felony, as Mr. Cruz did, the court must impanel a jury just for sentencing, unless the defendant waives the right to have a jury make the determination.

What the state does

The prosecution’s job now is to convince the jury that there are aggravating factors in the case that would warrant the death penalty. Among the possible aggravating factors listed in the law are:

  • That the killings were “especially heinous, atrocious or cruel”;

  • That the defendant “knowingly created a great risk of death to many persons”;

  • That the defendant killed “in a cold, calculated, and premeditated manner without any pretense of moral or legal justification.”

Prosecutors are expected to present extensive details of the 17 murders and 17 attempted murders at the high school, including hundreds of gruesome photographs and videos. The jury may also tour the school building where the shooting took place.

“They’re going to try to get these jurors to relive what happened to the victims,” said David S. Weinstein, a former prosecutor who is now a defense lawyer. “It’s going to be an emotional roller coaster.”

What the defense does

The defense will try to convince the jury that there are mitigating circumstances that would call for leniency. Under the law, those circumstances could include that the defendant “was under the influence of extreme mental or emotional disturbance” or had a diminished ability to understand whether his actions were criminal, among other factors.

The defense lawyers intend to show that Mr. Cruz, who was 19 at the time of the shooting, struggled with a difficult upbringing and mental health problems and had tried to get treatment. They have requested permission to show jurors a map of his brain, but the judge has yet to decide whether to allow it.

The jury’s task

After hearing the evidence, the jury must first decide whether the state has proved each of its claimed aggravating factors beyond a reasonable doubt. For the defendant to be eligible for the death penalty, the jury must unanimously find at least one of the aggravating factors to be proved.

Next, the jury would consider whether the proven aggravating circumstances are sufficient to warrant a death sentence and outweigh any mitigating factors found to exist, and if they do, whether to recommend a death sentence to the court. To do so, the jury must again be unanimous; otherwise the sentencing recommendation must be for life in prison without possibility of parole.

The court cannot impose a death sentence if the jury has recommended life in prison, but it can set aside a jury’s recommendation of death and impose a life sentence instead.

A strange case

The need for a special sentencing jury is one of several ways the Parkland case is extremely unusual. It is rare for someone as young as Mr. Cruz (he is now 23) to face the death penalty, and even rarer for someone who has committed so deadly a mass shooting to still be alive afterward to face justice.

“In a sense, we are in completely uncharted waters,” said Robert M. Jarvis, a law professor at Nova Southeastern University in Davie, Fla., who tracks mass killings. “You never get these kinds of trials, because the gunman is always dead.”

Latest Ukraine-Russia War News: Live Updates

The first person Yana Muravinets tried to persuade to leave her home near Ukraine’s front lines was a young woman who was five months pregnant.

She did not want to abandon her cows, her calf or her dog. She told Ms. Muravinets that she put energy and money into building her house near the southern Ukrainian city of Mykolaiv, and she was afraid of losing it.

“I said: ‘None of this will be necessary when you’re lying here dead,’” Ms. Muravinets said.

Since the early days of the war Ms. Muravinets, a 27-year-old photographer and videographer from the region, has taken up a new volunteer job with the Red Cross: encouraging people to evacuate. In phone calls, doorstep conversations, public speeches in village squares, sometimes even under fire, she has tried to convince Ukrainians that leaving everything behind is the only sure way to survive.

Persuading people to abandon all they have built in a lifetime is one of the many dreary jobs the war has created, and another challenge authorities have faced. While the city of Mykolaiv managed to push back Russian attacks early in the war, strikes have pummeled it and its region, bringing widespread death and destruction. Many residents have left, but hundreds of thousands are still there, and the mayor’s office has urged people to leave.

Ms. Muravinets, who has spent thousands of hours in recent months trying to make the case for evacuating, said she was unprepared for the task. She started having panic attacks, she said, but she felt she must keep going.

“The war isn’t ending and people just keep putting themselves in danger,” she said in a Zoom call from Mykolaiv that had to be cut short because of shelling. “If I can convince one person to leave, that’s already good.”

Boris Shchabelkyi, a coordinator of evacuations of people with disabilities who works alongside Ms. Muravinets, described her as a tireless worker, gentle with the people she needs to evacuate and “always in a good mood” with her colleagues.

With the Red Cross, she has helped evacuate more than 2,500 people, she said, but many have stayed, or returned a few days after they left. It took a month and a half to convince the young pregnant woman to flee, and she left only after her home’s windows were knocked out twice, Ms. Muravinets said.

“Especially when it’s safe, people think it’s fine and live under some illusion,” she said. “They decide to leave only when missiles come to their house.”

For two years before the war, Ms. Muravinets worked for Lactalis, a French dairy company with a plant in the area, and she toured farming villages to check milk quality.

Now that many country roads have become dangerous, she has reached remote villages, avoiding fire by using shortcuts she learned in her previous job. But now, she has to persuade dairy farmers to abandon their livelihoods.

“It’s the whole life for them,” she said. “They say: ‘How can I leave my cows? How can I leave my cows?’”

Before the war, she said a cow could cost up to $1,000. Now, people take them to slaughterhouses to get meat for a fraction of that.

Ms. Muravinets said some farmers who agreed to evacuate left the corrals open, so the animals would not starve, and cows, bulls and ducks now roamed village streets looking for food and water.

“The people who had money, opportunities, cars have already left,” Ms. Muravinets said. But others, living in bunkers for months, told her that they were ready to die there because they refused to leave.

She said she was staying for the same reason.

“The people who are left are those who are ready to sacrifice their lives.”

Latest UK and Europe Heat Wave News: Live Updates

LONDON — England on Monday was facing the possibility of serious disruption to its transportation networks as temperatures were poised to creep to unprecendented new highs.

Temporary speed restrictions were in place over large portions of the network, including on London’s tube system. Entire lines preemptively canceled service over fears that the extreme temperatures forecast could cause rails to buckle. And bold red warnings were posted in stations and on social media urging people to reconsider their trips.

But despite warnings to only take the most necessary journeys and guidance urging potential commuters to stay at home, many Londoners felt they had no choice but to use the city’s tube network and other trains on Monday morning.

Rufus Cameron, 26, who lives on the third floor of a shared house in north London, had decided to escape the heat of the city for his parents’ home in the south of England and was waiting for a train on Monday morning.

“Our flat is hot, outside it’s hot, it’s all a bit much,” he said. “In England, we have no idea how to deal with this kind of heat.” While he said he was worried about potential delays to the national rail service that would take him home, he hoped that leaving before the temperatures rose too steeply would spare him any issues.

“But what can we do with the infrastructure that we have in England,” he added. “It’s not built for this.”

In London, where some of the most extreme temperatures are expected — Tuesday’s forecast predicts a high of 103 degrees Fahrenheit — a number of tube lines had service suspended on Monday and Tuesday, according to a statement from Transport for London, which operates the network.

Just 40 percent of the Tube network has air conditioning, and Transport for London advised passengers to carry water and considering timing trips for cooler parts of the day.

National rail services were also bracing for disruptions to thousands of miles of steel tracks, which absorb heat easily and can buckle, causing serious delays. Steel rails expand when heated and can push against adjacent pieces of track, which can also damage equipment that detects where trains are to keep them a safe distance apart, according to Network Rail, which owns and repairs the railway infrastructure in England, Scotland and Wales.

In a statement, the company warned of delays, cancellations, and last-minute changes to train services on Monday and Tuesday.It also closed the entire East Coast Main Line, which runs between London’s King’s Cross Station and York and Leeds, for Tuesday afternoon.

“Closing the line to traffic is always a last resort but it is the right thing to do to keep people safe on Tuesday given the unprecedented heatwave forecast,” Sam MacDougall, the operations director for Network Rail, said in a statement. “The forecast temperatures are well above those which our infrastructure is designed, and safety must come first.”

The trains’ speed was also being limited on Monday, a move that would limit the number of trains running and extend journey times significantly, Mr. MacDougall said, urging passengers to “only travel if absolutely necessary.”

Indiana mall shooting: Live updates

GREENWOOD, Ind. (AP) — Three people were fatally shot and two were injured Sunday evening at an Indiana mall after a man with a rifle opened fire in a food court and an armed civilian shot and killed him, police said.

The man entered the Greenwood Park Mall with a rifle and several magazines of ammunition and began firing in the food court, Greenwood Police Department Chief Jim Ison said.

A 22-year-old from nearby Bartholomew County who was legally carrying a firearm at the mall shot and killed the gunman, Ison said at a news conference.

Four of those hit by gunfire were females and one was a male, Ison said. He didn’t immediately know the specific gender or age of those who were killed.

He said a 12-year-old girl was among the two injured, both of whom are in stable condition.

Police confiscated a suspicious backpack that was in a bathroom near the food court, Ison said.

Officers went to the mall at about 6 p.m. for reports of the shooting.

“The real hero of the day is the citizen that was lawfully carrying a firearm in that food court and was able to stop the shooter almost as soon as he began,” Ison said.

The mass shooting was just the latest to unnerve Americans in 2022. Schools, churches, grocery stores and a July Fourth parade in Highland Park, Illinois, have all become killing grounds in recent months. Still, the reality of America’s staggering murder rate can often be seen more clearly in individual deaths that rarely make the news.

Indianapolis Metropolitan Police and multiple other agencies are assisting in the investigation.

“We are sickened by yet another type of incident like this in our country,” Indianapolis Assistant Chief of Police Chris Bailey said.

There was no threat to the area Sunday night, authorities said.

Greenwood is a south suburb of Indianapolis with a population of about 60,000. Mayor Mark Myers asked for “prayers to the victims and our first responders.”

“This tragedy hits at the core of our community,” Myers said in a statement.

Authorities said they would provide more details Monday.

What Is Live A Live? Everything You Need To Know (And Maybe More)

If you’ve been following game news lately, you’ve probably heard about Live A Live. You probably also belong to one of two camps: Someone who knows what Live A Live is, and someone who can’t really tell it apart from all the other HD-2D Square Enix games, like Triangle Strategy and Octopath Traveler.

Well, whether you’re the type of person who knows about Live A Live or not, you can hopefully learn something from us, as we walk you through everything we know, and everything you need to know. And probably also some things you don’t.

All Your Live A Live Questions, answered

What is it?

Live A Live is a 1994 Super Famicom RPG, previously released only in Japan, that is coming to the Nintendo Switch on the 22nd July, 2022. The remake will be in Square Enix’s now-iconic HD-2D style, like Triangle Strategy and Octopath Traveler.

Who made it?

Square, which eventually became Square Enix (the Final Fantasy folks). They also published it, and that means that Square Enix are publishing the 2022 version — but only in Japan. Nintendo is publishing Live A Live everywhere else.

Is it “Live A Live” or “Live A Live”? Or is it “Live A Live”?

This is not a good question for the written form, but if you read the original katakana, it’s “Live A Live”. As in, live music.

What is the plot?

Live A Live is a story split across seven chapters, eight protagonists, and nine scenarios, all of which are in a different time period. There is an evil force called (some version of) Odio in each time period, who you will have to kill in order to complete the chapter. Although you can play the chapters in any order, they range from a prehistorical time period through to the far future, each with their own protagonist from the period in question.

What kind of game is it?

It’s a role-playing game with turn-based combat, much like other JRPGs of the era like Final Fantasy and Chrono Trigger. Each of the time periods and scenarios has different mechanics, too — sometimes you’ll be focusing on dungeon-crawling, other times you’ll have to use stealth to get by.

How does the combat work?

Well, it’s turn-based, and it’s presented much like a typical JRPG: two parties, one that you control, and one that you fight, stand facing one another. You have a bunch of moves to select from, including attacks and skills, some of which can give special effects like healing or defense to a single tile when you stand in it. You can also move around the tile grid, with different moves requiring different distances and stances.

Enemies also have an action meter on top of their heads, which tells you how ready they are to make a move. If you’re not within range when their action meter reaches the end, then the meter will reset. A good strategy for staying out of danger!

It’s worth noting that some characters’ stories will prioritise combat, others will discourage it, and some will have none altogether.

Who are all the characters?

Note: These names might change in the remake.

Pogo (Prehistoric times)
A caveman who hopes to save his crush from being a human sacrifice.

Master and Student of Kung Fu (Imperial China)
An old master of Xin Shan Quan Kung Fu, and his best student, who he hopes to succeed him, who have to avenge the deaths of their fellow students.

Oboro-maru (Feudal Japan)
A ninja on a mission to rescue a prisoner.

The Sundown Kid (Wild West)
An outlaw about to have a showdown with his rival, Mad Dog, in an old west town in America.

Masaru Takahara (Present day Japan)
A fighter hoping to become the strongest in the world.

Akira Tadokoro (Near future, Japan)
A psychic orphan who learns of a kidnapping ring run by bikers.

Cube (Distant future, space)
A spherical robot on a spaceship called the Cogito Ergosum.

Why is it coming out now?

Square Enix seems to be reviving a lot of their old catalogue, with great success — consider the glossy remake of Final Fantasy VII, the recently-announced Front Mission remakes, the HD-2D remake of Dragon Quest 3, and even just the nostalgia-adjacent HD-2D style of their newer games. Square know that they’ve got some gold in their archives, and they’re happy to trot it all out alongside their newer IPs.

It turns out that Takashi Tokita, the original director of Live A Live, was working on the team developing Octopath Traveler, and he was inspired to use the HD-2D style to resurrect his own game.

Is Live A Live a big deal?

Yes, and no. It didn’t sell particularly well in 1994 — only 270,000 copies, according to Wikipedia, which doesn’t name its sources on that figure — but it’s an important historical gaming relic.

It was the first game that Takashi Tokita would work on as a director, and his next one would be… Chrono Trigger. So it’s basically the precursor to Chrono Trigger, which isn’t surprising, given its time travelling plot.

One of the game’s designers, Nobuyuki Inoue, would go on to be the director of Mother 3.

The composer, Yoko Shimomura, would eventually be the composer for Legend of Mana, Super Mario RPG, the Mario & Luigi series, and the Kingdom Hearts games. She’s a big deal!

And, of course, despite its low sales, Live A Live is a beloved early RPG with enough of a cult following that a fan translation was made by Aeon Genesis in 2001, who describe it thusly:

Live A Live is truly unique when it comes to RPGs. Rather than have one long continuous storyline, LAL throws a whole bunch of rather short (but good) stories at you. Each chapter is set in a different time period, and each has unique gameplay aspects… The story is fairly generic, but it’s told very well, and a couple of the chapters throw you some real curve-balls. Suffice to say, the game is really worth your time. Just don’t spoil it for yourself with a walkthrough!

Is it actually good?

Yeah! Although it’s no Chrono Trigger, it has its fans and its place in the JRPG canon. It got a 29/40 in Famitsu when it came out, which is not too shabby, and although several reviews apparently criticised its shortness and its final chapters, the overall consensus seems to be that the game was unique, interesting, and well-written.

Is the music good?

With Kingdom Hearts composer Yoko Shimomura at the helm, you BET it’s good. It looks like Shimomura has returned to orchestrate and arrange the soundtrack, too!

Expect bombastic fight themes, epic organ pieces, and Megalomania, the theme that Toby Fox’s “Megalovania” was named for.

Why did it take so long to come to the West?

Tokita told Famitsu that he had tried multiple times, but it just didn’t work out. It wasn’t until he joined the team behind Octopath Traveler that he realised that the HD-2D style would work perfectly. In particular, he said, the Edo and prehistoric chapters were hard to finish, because the team had a much higher bar for the remake than the original!

How long is it?

About 30-40 hours, according to Tokita. How Long To Beat says anywhere between 18-30 hours, depending on whether you’re a completionist or whether you play games leisurely, as well as the ways you choose to play some of the chapters.

In a sense, yes. The director, Takashi Tokita, went on to direct Chrono Trigger. You can see from the original designs that it’s quite similar-looking to Chrono Trigger, too!

Will I enjoy it?

Do you like JRPGs? Did you like Chrono Trigger? Do you want to experience an older, cult-favourite game without having to play it in Japanese on a Super Famicom? Do you want to listen to some absolute bops? Do you have about 18-30 hours to spare? Then yes, probably.

2022 British Open leaderboard: Live coverage, golf scores today, Rory McIlroy score in Round 4 at St. Andrews

The final round of the final major the 2022 golf season is officially upon us, and it appears as if we are in for a tremendous finish at the historic 150th Open Championship. With Rory McIlroy and Viktor Hovland co-leading and plenty chasing including Cameron Smith, Cameron Young, Scottie Scheffler and Dustin Johnson, Sunday’s final 18 holes on the Old Course at St. Andrews could make for an all-time finish.

McIlroy and Hovland will be the final pairing on Sunday after providing the drama in the penultimate game of Saturday’s round. The two fired matching 6-under 66s to move to 16 under, making them four strokes clear of the field as the co-leaders. McIlroy is looking to win a second Claret Jug — and his first major since 2014 — as he tries to hold off a would-be first-time major winner in Hovland along with a handful of tough competitors all within six strokes of the top.

With a star-studded field atop the leaderboard, St. Andrews serving as a historic backdrop and the pressure on given this is the final major of the year, the 150th Open has already been one remember. Chelsea vs Club America – pre-season: Live score, team news and updates

Chelsea 2-1 Club America: Mason Mount restores Chelsea’s lead with stunning strike shortly after Reece James scored an OWN GOAL to cancel out Timo Werner’s opener for the Blues

  • Chelsea beat Club America 2-1 in their pre-season friendly in Las Vegas  
  • Timo Werner opened the scoring for Chelsea in the 55th minute of the game
  • However, Reece James scored an own goal just three minutes later to make it 1-1
  • Mason Mount managed to restore their victory after scoring in the 83rd minute 

Chelsea have turned down the opportunity to sign Cristiano Ronaldo as they want to focus on reinforcing their defensive line and it appears to be wise decision following their performance against Club America.

Chelsea struggled to shrug off the cobwebs as they stepped out to face their Mexican opponents in Las Vegas on Sunday morning. They looked lethargic and struggled to string passes together during the opening stages of the game. 

It was not until Tuchel made the decision to swap his entire first XI at half-time, bringing on the likes of Werner, Pulisic, Alonso, Batshuayi, Jorginho, James, Emerson, Mount, Azpilicueta, Ampadu and Bettinelli after the break that Chelsea started to perform.

Mason Mount scored the winner for Chelsea from the corner of the box in the 83rd minute 

Mount instantly changed the game and his partnership with James became almost too much to handle for the Mexican outfit. The dynamic duo helped build-up the play for Chelsea ahead of Timo Werner’s opening goal.

The German forward found the back of the net in the 55th minute of the game to give the Blues to advantage. However, it didn’t last long as James’ questionable back-pass caught out Chelsea goalkeeper, Bettinelli. 

As a result, the scores were level once again after just three minutes.

Club America did get on the scoresheet after Reece James (not pictured above) scored an own goal in the second half of the game 

However, James worked hard to try and redeem himself by connecting nicely with Mount down the flank. A series of passes between the pair saw Chelsea work their way up to the Club America box. Although, little came of it. 

The Chelsea defender did, however, play a cross field ball to Marcos Alonso – who took the ball down and shipped it on to Mount on the edge of the area. The England midfielder got the ball under control and went for goal from the edge of the box. Safe to say he was successful and it was a stunning finish.

Chelsea’s lead had been restored and the Blues played out the remainder of the game to walk away with a 2-1 victory over Club America.

Moving Day is officially upon us at the 150th Open Championship, paving the way for a memorable round of golf as the Old Course at St. Andrews will help determine who is truly in contention entering Sunday’s final round. At the 36-hole mark, Cameron Smith emerged ahead of 18-hole leader Cameron Young with his 36-hole score of 131 tying for the four-lowest in Open history (two off the record pace).

Young, though, remains in solo second with Rory McIlroy and Viktor Hovland (-10), Dustin Johnson (-9) and Scottie Scheffler (-8) lurking entering what should be a fun finish at St. Andrews. Given 14 of the last 15 Open Champions at St. Andrews were within three shots of the lead through 36 holes and each of the last seven Open winners have been T4 or better at this point in the tournament, the 2022 Champion Golfer of the Year will likely be one of those six golfers.

So, How Do You Pronounce ‘Live A Live’?

We’re big fans of noodly linguistic questions around these parts, and if they involve video games, all the better. Whether it’s Nintendo-related gaming vocab, Pokémon pronunciation, or finding out how you say the name of Link’s sentient sword, we’re always down a discussion when it comes to words.

A recent conundrum that’s had us scratching our heads and beginning sentenced with “oh, how do you say it — I never know which is the right way!” when discussing the game is Square Enix’s HD-2D Switch remake of the Super Famicom RPG Live A Live.

We’ve been fortunate enough to have spent a lot of time with it recently — and you can find out more about our thoughts on the game in our Live A Live hands-on preview (spoilers: we like it so far) — yet we’re still unsure how we should be saying the name of the game. All the years it was a Super Famicom exclusive, we could laugh off our ignorance, but now the game is officially coming to the West on 22nd July, it’s a more pressing pronunciation matter!

They pronounced both Lives like ‘jive’, and bearing in mind the rigorous media training Nintendo employees go through to make sure they use the full and correct titles when discussing any of their games — which makes Nintendo Power Podcasts particularly fun when they discuss games like Cadence of Hyrule: Crypt of the Necrodancer Featuring The Legend of Zelda — we’d imagine that jiver-jive is the way we should be saying it, rather than giver-give, which we’ve been saying for a while.
