Petito family alleges Laundries went on vacation with Brian knowing Gabby was dead

A newly filed court document claims Brian Laundrie’s parents knew his girlfriend, 22-year-old Gabrielle “Gabby” Petito, had been killed before going on a family vacation to Fort De Soto Park. 

The filing, submitted Thursday in Florida’s Sarasota County court on behalf of Petito’s parents and penned by attorney Patrick J. Reilly, alleges that Laundrie, 23, told his parents Petito was dead on Aug. 28, 2021. 

On the same date, the Petito lawyer asserts, the Laundries spoke with attorney Steve Bertolino. 

“While Gabrielle Petito’s family was suffering, the Laundrie family went on vacation to Fort DeSoto Park on September 6-7, 2021,” Reilly said. “They went on vacation knowing that Brian Laundrie had murdered Gabrielle Petito, it is believed that they knew where her body was located and further knew that Gabrielle Petito’s parents were attempting to locate her.”

FLORIDA JUDGE GIVING LAWYERS FOR GABBY PETITO’S PARENTS SECOND CHANCE TO MAKE ‘COHERENT CLAIM,’ LAUNDRIE ATTORNEY

Fort De Soto Park is located in Pinellas County.

Records obtained by Fox News later that month showed Roberta Laundrie, Brian’s mother, had checked into the Florida park. 

She canceled reservations for two people at the St. Petersburg campground Aug. 31 and made new reservations for three people at the same park Sept. 3 for the weekend of Sept. 6-8. 

Duane “Dog” Chapman, also known as Dog the Bounty Hunter, said he had learned that Laundrie’s parents spent the night there twice in early September.

“I will no longer give that dog credibility or dignify his false claims with the time of my reply,” Steven Bertolino, Laundrie’s attorney, told Fox News at the time. However, he told local media that the family camped out on Sept. 6 and 7 and that “they all left the park.”

The documents revealed the checkout was actually recorded on Sept. 8, three days before Gabby Petito officially became a missing person.

Thomas Rutherford, another camper, and his wife were celebrating their anniversary at the campground, three spots down from the Laundries, he previously told Fox News.

He said he could “vaguely remember” seeing their truck and camper because he and his wife rarely see campers attached to vehicles anymore. Other than that, he had no interaction with the family.

Reilly wrote that Roberta Laundrie also reportedly blocked Nicole Schmidt – Gabby’s mother – on her cell phone and Facebook on or around Sept.10. 

GABBY PETITO’S PARENTS MIGHT FACE LAUNDRIES IN TENTATIVE JURY TRIAL SCHEDULED IN 2023

Petito’s body was found Sept. 19 at a campground near Grand Teton National Park in northwestern Wyoming. 

While the Petito family was searching for information, Reilly said, the Laundries were keeping Brian’s whereabouts secret, and it is believed they were “making arrangements for him to leave the country.” 

He accused Christopher and Roberta Laundrie of acting “with malice of great indifference to the rights of Joseph Petito and Nichole Schmidt.” 

“Christopher Laundrie and Roberta Laundrie exhibited extreme and outrageous conduct, which constitutes behavior, under the circumstances, which goes beyond all possible bounds of decency and is regarded as shocking, atrocious and utterly intolerable in a civilized community,” he said.

The FBI announced in January that Brian Laundrie had admitted to the murder in a notebook discovered near his body after his suicide in Myakkahatchee Creek Environmental Park. 

Petito’s parents and stepparents filed a lawsuit in Florida in March that seeks more than $100,000 in damages for alleged negligence, pain and suffering. 

At the end of the month, Bertolino filed a motion to drop the lawsuit with prejudice, arguing that there are no facts to support their claims of “intentional infliction of emotional distress.” 

He asked that the judge prevent the Petito family from filing an amended lawsuit should his dismissal request be granted.

Bertolino said the Laundries were exercising their constitutional right to remain silent.

KDFW noted that the lawsuit does not provide evidence of when Brian Laundrie’s parents knew Gabby Petito was dead and where her remains might have been located.

The couples are expected to face off for a jury trial in 2023.

Gabby Petito’s parents sue Brian Laundrie’s parents, claiming they knew of her killing and were helping son escape

In the lawsuit, Joseph Petito and Nichole Schmidt allege Brian Laundrie told his parents about killing Gabby Petito around August 28.

“While Joseph Petito and Nichole Schmidt were desperately searching for information concerning their daughter, Christopher Laundrie and Roberta Laundrie were keeping the whereabouts of Brian Laundrie secret, and it is believed were making arrangements for him to leave the country,” the suit alleges.

Though a coroner previously ruled Gabby Petito’s cause of death as manual strangulation, the lawsuit also lists blunt force injuries to her head and neck as well as manual strangulation for her cause of death.

Petito and Laundrie, who were engaged, were on a monthslong van-life trip through the western United States when she was killed.

The lawsuit says Petito called members of her family almost daily. Schmidt’s last communication with her daughter was on August 27, the suit says. Her parents believe that was the day she was killed, citing a text message that was sent from Gabby Petito’s phone later that day where her grandfather was referred to as “Stan,” something their daughter Gabby would have never done. The lawsuit alleges Brian Laundrie sent that text.

The lawsuit also claims that on August 30, Brian, pretending to be Gabby, sent a text message to Schmidt that there was no service in Yosemite Park. The family believes this was done to make her believe Gabby Petito was still alive.

Laundrie arrived at his parents’ home in North Port, Florida, on September 1, police have said.

In the lawsuit, Joe Petito and Schmidt say that the Laundries refused to respond to them or law enforcement when they inquired whether Gabby Petito was alive and if not, where her remains were.

“Christopher Laundrie and Roberta Laundrie knew of the mental suffering and anguish of Joseph Petito and Nichole Schmidt, and knew that they could alleviate, at least in part, such mental suffering and anguish by disclosing what they knew about the well-being and the location of the remains of Gabrielle Petito, yet they repeatedly refused to do so,” the suit says.

“In doing so, Christopher Laundrie and Roberta Laundrie acted with malice or great indifference to the rights of Joseph Petito and Nichole Schmidt,” it continues.

The lawsuit alleges that around September 10, Roberta Laundrie blocked Schmidt from calling or texting her cell phone and also blocked her on Facebook. Schmidt reported Petito missing to police in New York, where the couple left for their trip, on September 11. Petito’s body was found in Wyoming eight days later.

Brian Laundrie left his parents’ house the week of September 13 and was not seen again. His parents said he told them he was going on a hike, according to their attorney.

In a statement to multiple media outlets a week after Gabby Petito’s body was found, Laundrie family attorney Steven Bertolino said, “Chris and Roberta Laundrie do not know where Brian is. They are concerned about Brian and hope the FBI can locate him.”

“The speculation by the public and some in the press that the parents assisted Brian in leaving the family home or in avoiding arrest on a warrant that was issued after Brian had already been missing for several days is just wrong,” the statement continued.

In October, weeks into the search for Laundrie at Florida’s Carlton Reserve, investigators found human remains and personal items including a backpack and notebook belonging to Laundrie.

The District Twelve medical examiner’s office in Florida later said its investigation into Laundrie’s death determined he died by suicide from a gunshot wound to the head.
In January, after the FBI reviewed the contents of the notebook found near Laundrie’s remains, the agency said it found “written statements by Mr. Laundrie claiming responsibility for Ms. Petito’s death.”

Gabby Petito’s parents are asking for a judge to compensate them for “pain and suffering, mental anguish, inconvenience, and the loss of the capacity for enjoyment of life experienced in the past and in the future.”

There is not a monetary amount listed in the suit.

When reached by text, Bertolino told CNN he had no comment on the lawsuit.

Brian Laundrie’s family didn’t want to set off a public ‘frenzy’ by revealing gun was missing, attorney says

Laundrie’s parents, Chris and Roberta Laundrie, were surrendering their guns to law enforcement on September 17 — the same day they reported their son missing — when they discovered one handgun was not in its case, Bertolino told CNN Friday. The family immediately consulted law enforcement, he said, including the FBI and North Port, Florida, police.

Asked why information about the missing gun was not publicly shared, Bertolino told CNN he and law enforcement agreed “it was best for that information to not be public.”

“Imagine, with the frenzied atmosphere at the time, if the public thought Brian had a gun,” Bertolino said. “I cannot speak to why (law enforcement) did not reveal the info but we spoke about it at the time and I believe they felt as I did.”

CNN has reached out to the FBI for comment. North Port Police did not immediately respond to a request for comment Friday.

Laundrie vanished from his parents’ home in North Port just days after Petito had been reported missing. The couple had been traveling across the country over the summer in a converted van before Laundrie returned home without Petito on September 1.

Laundrie vanished days after Petito was reported missing, sparking a multistate investigation and capturing the attention of social media sleuths. Petito’s remains were found in Wyoming on September 19, and her death was ruled a homicide by manual strangulation.

In the meantime, authorities focused their search for Laundrie on the vast Florida nature reserve where his remains were eventually found October 20. On Friday, Bertolino said he did not know whether a gun was found near Brian’s remains or possessions.

While the Florida District Twelve medical examiner’s office confirmed Laundrie had died of suicide, the office said it would not make the autopsy report public “until the law enforcement investigation is complete,” the office said in a release.

The circumstances that led to Petito’s death remain a mystery. The FBI described her fiancé as a “person of interest” in her murder, but he did not face charges in her death. A federal grand jury had indicted him for allegedly using two accounts that belonged to someone else in the days after Petito died.

Human remains found in Florida park likely Laundrie’s, family lawyer says

The “probability is strong” that the human remains found in a Florida park on Wednesday belong to Brian Laundrie, a representative for the family said Wednesday night.

Laundrie family attorney Steven Bertolino made the shocking statement in an interview with CNN’s Chris Cuomo, but added “we are going to wait for the forensic results to come in to verify that.”

A backpack and a notebook belonging to Laundrie were also discovered in the park Wednesday on the same day Laundrie’s parents, Chris and Roberta, showed up to help search for their fugitive son.

Bertolino told Cuomo that the findings were made near a bridge that connects the Myakkahatchee Creek Environmental Park and adjoining Carlton Reserve.

“This is the very area of the park that we initially informed law enforcement on, I believe it was Sept. 17, that Brian would be most likely in the preserve in this particular area,” the lawyer said.

“It was quite near the entrance,” the lawyer said, “About 30 minutes in.”

The parents filed a missing persons report on Sept. 17 after Brian apparently failed to return home after going for a hike in the park.

The FBI explained at a Wednesday press conference that the area where the remains and items were found had “up until recently been underwater.”

Brian, 23 has been the subject of a massive police and FBI manhunt since he went missing and was named a “person of interest” in the murder of his 22-year-old girlfriend Gabby Petito.

Petito’s remains were found on Sept. 19 in a Wyoming park and her death was later ruled a homicide by strangulation.

Laundrie’s parents left their North Port home about 7:15 a.m. Wednesday for the park.

Bertolino told Cuomo that he reached out to North Port police on Tuesday night to give them a heads up that the parents intended to help search the next morning.

The Laundries later discovered a white bag and another object after making their way through a thicket.

They could be seen putting the object into the bag and handing it over to an officer, Fox News reported.

The couple could be seen making and receiving phone calls before being joined by the officer, who patted Chris on the shoulder.

Bertolino said Wednesday night that Brian’s parents are “heartbroken” over Wednesday’s developments.
