Johnny Depp Reportedly Sabotaging Comeback with Old Habits

One might think that Johnny Depp would be on his best behavior following his massive public trial earlier this year. But the actor is reportedly back to his formerly reported professional peccadillos on the set of his comeback project, Jeanne du Barry—formerly titled La Favorite.

Actor Bernard Montiel shared rumors from the set of the upcoming film on the French talk show Touche pas à mon poste! (Don’t Touch My TV Set!) in October, in a panel interview that’s recently begun to make the rounds in English-language media. The actor and commentator claimed that Depp and French director Maïwenn Le Besco, known by the mononym Maïwen, had been clashing.

“I’ve heard some noise from the shoot, very serious stuff,” Montiel said. “So, [Depp is] an excellent actor, when he comes on set, except sometimes at six in the morning the crew is ready, and nobody turns up. So of course, Maïwenn, who is the director, gets angry, and the next day she’s the one who doesn’t turn up. And you’ve got Johnny Depp, and she’s not there. It’s finished, over this week, [but] it’s going very, very badly. They don’t get on at all; they’re screaming at each other the whole time.”

Some might remember that Depp’s “constant lateness” was among a series of alleged complaints from the crew of Pirates of the Caribbean: Dead Men Tell No Tales, shot in 2015 in Australia. According to a production dispatch from The Hollywood Reporter in 2017, “sources close to the production report tales of excessive drinking, physical fights with [Depp’s ex-wife, Amber] Heard and constant lateness on set, which often left hundreds of extras waiting for hours at a time.”

Producer Jerry Bruckheimer—who, sources told THR, frequently found himself strategizing with other higher-ups around Depp’s tardiness—told the outlet, “You’ve got to understand the kind of pressure Johnny was under in Australia… At times helicopters would follow him home. There would be so many media outside his gates that trucks were feeding them. There was so much stuff made up about him: that Johnny had a fight on set and had gone back to the States, which we both read about while we were in his trailer.”

Depp’s alleged chronic tardiness also came up during his defamation trial this year against Amber Heard. Tracey Jacobs, who testified that she worked as the actor’s agent for decades, claimed that she’d explained to Depp that his consistent lateness and substance use were hurting his career. CNN quoted Jacobs as saying, “His star had dimmed due to it getting harder to get him jobs given the reputation that he’d acquired due to his lateness and other things… People were talking and the question was out there about his behavior.”

This summer, Depp claimed in an explosive defamation trial that Heard had defamed him in a 2018 Washington Post op-ed; while she did not name him in the piece, she described herself as a “public figure representing domestic abuse.” The jury held Heard liable for over $10 million in damages but also awarded her $2 million, on the grounds that former Depp attorney Adam Waldman had defamed her by inaccurately calling her allegations a “hoax.”

Earlier this month, Heard announced that she’d made the “very difficult decision to settle” the case rather than move forward with her appeal; a source close to Depp told The Daily Beast at the time that Heard agreed to pay $1 million, a deal that precluded her paying the full $10 million.

News of Depp’s latest film role broke in January—after he’d lost his libel case against The Sun publisher News Group Newspapers in the UK over a piece that called him a “wife beater,” and before the Virginia trial this summer. Variety has also reported that Depp is set to play King Louis XV in the new film; director Maïwen, who’s also an actress, will star as his final mistress, after whom the film is named. Variety also noted that as a period piece, Jeanne du Barry is a new direction for Maïwenn, whose previous works—including DNA, Mon Roi, and Polisse—have all been contemporary. Netflix is set to license the new film for digital distribution in France after its theatrical release. No North American release has been announced.

Lily-Rose Depp defends decision to remain silent during Johnny Depp and Amber Heard trial

Lily-Rose Depp defended her choice to remain silent during the defamation trial involving her father Johnny Depp and his ex-wife Amber Heard.

In a candid interview with Elle, the rising star actress explained why she decided to steer clear of all the drama and not comment directly on the case that was held in Fairfax County, Virginia earlier this year.

‘When it’s something that’s so private and so personal that all of a sudden becomes not so personal…I feel really entitled to my secret garden of thoughts,’ the model and actress, who is set to star in HBO’s upcoming series The Idol, said in the publication’s cover story.

While addressing her silence, the Neuilly-sur-Seine, France native, 23, declared she wants to be judged on her own merits and not by the men in her life, whether that be her famous dad or boyfriends in her life.

‘I also think that I’m not here to answer for anybody, and I feel like for a lot of my career, people have really wanted to define me by the men in my life, whether that’s my family members or my boyfriends, whatever.’

Sounding confident and somewhat defiant at the same time, she added, ‘And I’m really ready to be defined for the things that I put out there.’

Johnny Depp started dating Amber Heard following his announcement that he had separated from Lily-Rose’s mother, Vanessa Paradis, in June 2012 after being an item for more than 14 years.

The Depp and Heard union would only last about a year-and-a-half, ending with Heard filing for divorce in May 2016. During that filing she obtained a temporary restraining order against the A-list actor, alleging that he had been verbally and physically abusive throughout their relationship, usually while under the influence of drugs or alcohol.

After denying Heard’s claims of abuse, a settlement was reached and the divorce was finalized in January 2017. 

Heard would also go on to dismiss the restraining order, and the former couple issued a joint statement saying that their ‘relationship was intensely passionate and at times volatile, but always bound by love.’

Nearly two years later, Heard wrote an op-ed that was published by the Washington Post in December 2018 titled ‘Amber Heard: I spoke up against sexual violence—and faced our culture’s wrath. That has to change.’

In the article, Heard stated: ‘Then two years ago, I became a public figure representing domestic abuse, and I felt the full force of our culture’s wrath for women who speak out. … I had the rare vantage point of seeing, in real time, how institutions protect men accused of abuse.’ 

While it never identified Depp by name, the Pirates Of The Caribbean star maintained Heard caused new damage to his reputation and career and filed a $50 million defamation lawsuit. Heard went on retaliate by filing a countersuit claiming $100 million in damages.

Their trial ended up going from April until June, with Heard being found guilty of all three defamation claims. 

Depp was awarded $10 million in compensatory damages and $5 million in punitive damages from Heard, although the court reduced the punitive damages to $350,000 due to a limit imposed by Virginia state law. They also ruled that Depp’s former lawyer, Adam Waldman, had defamed Heard by falsely alleging that she and her friends ‘roughed up’ Depp’s penthouse as part of a hoax’ and awarded Heard $2 million in compensatory damages but zero dollars in punitive damages.

Evidence presented during the trial, which made headlines all across the world, showed that Heard and Lily-Rose appeared to have a close relationship. 

Her decision to not comment on their trial was criticized by many on social media, but she also had many fans come to her defense at the time.

While The Dancer star continued to avoid taking sides in the trial in the Elle interview, Lily-Rose did elaborate on her childhood and what it was like being raised by a superstar father and mother, who’s been a big star in her own right as a model, singer and actress in her native France.

‘I know my childhood didn’t look like everybody’s childhood, and it’s a very particular thing to deal with, but it’s also the only thing that I know,’ she explained.

‘My parents protected my brother, [Jack], and me from it as much as possible. I’ve just been raised in a manner that has taught me that privacy is something that’s important to protect.’

She also addressed critics who claims her career is a product, in part, of nepotism.

‘People are going to have preconceived ideas about you or how you got there, and I can definitely say that nothing is going to get you the part except for being right for the part,’ she said, adding, ‘The internet cares a lot more about who your family is than the people who are casting you in things. Maybe you get your foot in the door, but you still just have your foot in the door. There’s a lot of work that comes after that.’

Season 4, Episode 10, “It Was All a Dream”

With this brilliant episode, Atlanta is over. I tried to go into this series finale with zero expectations, but of course I had some. I expected it to be non-traditional in that Atlanta way, which for me defaulted to chill. Even the trailer looked fairly calm, although it would obviously be a Darius adventure. And still, with my expectations to not expect anything, I nevertheless wan’t prepared for the absolute perfect mind-fuck of this quintessentially Atlanta episode, directed by Murai and written by Glover. Bravo, y’all.

The episode started in the chill mode that I initially thought, with Darius zoning out to Judge Judy as Earn and Al prepared to go out. Everything about this scene is so intentional yet subtle; it isn’t apparent until the second watch that the opening shot of Darius is framed to look like a tank, with that groovy soundtrack, Judge Judy, and the Popeyes commercial serving so much importance later. The conversation with our main trio of men is so natural, as Darius sets off on his own before they all go meet up with Van (though I wish they axed the Johnny Depp joke). Also, I appreciated that there were nods to the characters’ arcs in the prior few episodes, with Earn sharing Van’s wants and the “Old MacDonald” song about Al’s Safe Farm.

When Cree Summer (!!!!) popped up, I was hoping that Darius had found his perfect transcendental soulmate and they would finish the episode together, but I also appreciated the conversation as a lovely bit of exposition, since I didn’t know about sensory deprivation besides the Simpsons episode. Part of the brilliance of this episode is that Atlanta has two modes: the heightened reality and the grounded surrealism. When he runs into London, his wild former friend who can pass a sobriety test while cross-faded, it’s a segment that feels very much like the reality of Atlanta. She seems like a character who could’ve popped up in something like season one’s “The Club,” even up to stealing the cop’s gun. After she runs over the kid, and Darius drops the stolen gun, that wake-up moment as the gun fires and he awakes is a complete surprise, because everything was so thoroughly set up…except how it actually feels to be lost to the senses. So from here on out, I’m questioning everything that happens with him.

The “tea in the tea room” moment and the excessive laughter: Is Darius still in the tank, or are the excessively-laughing women? It really seems like it could be both, but then Darius gets kicked out. We then get this lovely, simple scene of Darius visiting his brother, the only time we’ve interacted with his personal history besides the Nigerian restaurant in “White Fashion.” It all feels so real, until he sees thick Judge Judy. Then there’s the moment of him awaking and waking up, and that final shot of him screaming in the tank with the door closed. Did he ever get out? Has he ever gotten out?

Meanwhile, Earn, Al, and Van are in a completely different storyline where it’s heavily hinted that Darius is gonna show up late after the story’s over. Van’s friend (Candice?) has invested in Atlanta’s first Black-owned sushi restaurant, run by a chef who studied under sushi masters in Japan. It’s Black-sushi fusion, in a spot that used to be a Blockbuster and still has the candy on the racks. The towels aren’t all white, but a random assortment. The apparent sous chef calls out “Sup” instead of “Yes, chef.” Al (and I) are immediately skeptical, and he’s staring at a Popeyes right across the street. (Van is less antagonistic, but quickly decides the meal ain’t it.)

When the main meal comes out, the infamous potentially-poisonous blowfish (another bit of Simpsons knowledge), Al’s done, Van’s done, I’m done…and Earn still wants to support the culture. Then master chef DeMarcus shows up and serves a truth-telling monologue similar to Kirkwood Chocolate’s. (Based on a quick Google, sushi is traditionally served at room temperature to get the best flavor experience, and chefs do make the meal bare-handed.) The man has a point that the phrase “Black-owned sushi” shouldn’t automatically bring pause (though the Blockbuster of it all probably doesn’t help). It’s a very honest, hilarious speech that raises intra-cultural questions. But then Darius storms in and punches the mad chef in the face before he can force them to eat the blowfish. They all speed off in a stolen pink Maserati.

The final scene is some Inception-type shit in the best way, not a corny reproduction but a clever instance in which Glover takes the belief that the audience has suspended ever since the invisible car and shoves it back onto us all for a brief moment. Have the past four seasons of the show just been Darius’ tank dreams? The Teddy Perkinses, Thomas Washingtons, and the white Earnest Marks would have you believe so. But in the end, the episode leaves it up to the audience. We don’t see whether or not Judge Judy is thick. The contingent who think that “It Was All A Dream” is a brilliant subversion of the trope, and the others who will be mad that the trope was even a possibility can fight it out on Reddit. But you can’t deny that it’s such a great Atlanta ending.

I’m really glad that this is how the show left us. I assume there will be naysayers about the ending, because you can find a naysayer about literally anything. I’m focusing on the craft of storytelling, the way the episode tricked us along with Darius multiple times, fit another social-commentary monologue into the B-plot, and did it all pretty much flawlessly. Tomorrow I’ll be sad that such a show has ended, but tonight I’m leaning back with a smile on my face, happy that Glover and the Atlanta team got to make their weird, indescribable, creative, excellent show.

Stray observations

  • I’m writing this in a bit of a rush, but I’m super excited to find the two bookend tracks for this episode later.
  • Seriously, I will be making derivatives of the “Old MacDonald” song to roast my friends for the next few months.
  • I think this episode has the most hidden Atlanta logo yet, and I’m very happy about it. It’s like they’re going, “Bruh, you know what you’re watching. You know our style. We don’t have to say it.”
  • I’m kind of surprised there hasn’t been Popeyes discourse on Atlanta yet. It’s a topic that would’ve felt extremely dated if they didn’t find a unique angle. (Glad they did.)
  • Sooooo many good jokes in this episode. Like Al about the Popeyes: “Smell like the manager mean as hell.”
  • I really do think that London would be just as wild if it wasn’t a tank dream. Maybe not steal a cop’s gun, but probably the weed, vodka, and beer bottle.
  • That shot of Darius looking at Al, Van, and Earn through the window was sweet. I’m gonna miss the four of them.
  • It was a pleasure to recap this for you all.

Johnny Depp to Appear in Rihanna’s Savage X Fenty Fashion Show

In breaking news that makes one further question celebrity stan culture, Rihanna has reportedly tapped alleged abuser and gainfully employed musician, actor, director, and artist Johnny Depp to star in her upcoming Savage X Fenty Vol. 4 show. Yes, you read that correctly.

Sources just revealed to TMZ—the same outlet that first reported he’d appear at this year’s Video Music Awards—that Rihanna and co. invited Depp to be featured in the highly acclaimed show, and that “both sides were super excited to make it happen.” Depp, who will be the first man in the show’s history to have his own “star segment,” has reportedly already filmed his part. The show will appear on Amazon Prime Video on November 9.

This bulletin arrived (straight from hell) just one day after exclusive photos of the production were published by Vogue. In addition to Depp, viewers can expect performances from Anitta and Burna Boy; cameos from models including Irina Shayk, Cara Delevingne, and Precious Lee; and dozens of more stars to drop in bedecked in Savage X Fenty lingerie. Notably, none of the pre-released photos included Depp, but sources told TMZ the vibe for his look is “cool and chic.”

Fans are justifiably befuddled, per my quick perusal of Twitter. One writes: “Rihanna really saw a man that hasn’t used shampoo in months and put him in a fashion show I can’t.” And another: “Crazy to me. Literally in what world. Where is her team? Her publicist? HER BRAIN.”

In fairness, perhaps we should’ve seen this coming. Since his alleged abuse was aired in a court of law, we’ve learned that Depp was a Renaissance man, capable of finding love and securing several new cash streams, and that he was pretty much just doing the most with his one wild and “ruined life.”

Even still, of all the problematic men in Hollywood for Rihanna to include and outfit in—god forbid—silk, lace, or this onesie, Depp definitely feels like what we like to call a choice.

Johnny Depp is reportedly going to be starring in Rihanna’s upcoming Savage X Fenty Vol. 4 fashion show.

Production sources told TMZ that the actor is going to be a focus of one of the show’s “star” moments, with the likes of Cindy Crawford and Erykah Badu being involved in the past.

The publication claimed Depp would be the first male in Savage X Fenty Show history to take on the role.

The Pirates of the Caribbean star, 59, was filmed chatting to a fan before effortlessly slipping into the iconic role of Captain Jack Sparrow.

While he begins talking to her as normal in the clip, he soon takes on Jack’s slurred speech patterns and begins talking about rum.

The wholesome interaction was shared on TikTok with fans excitedly praising the actor for his transformation.

But many were taken aback by the star’s clean-shaven appearance, and even dismissed the video as actually being of him.

However, when he launches into his pitch-perfect impression of Jack Sparrow it becomes clear than it can be none other than Johnny himself.

Johnny has been seen putting on the pirate’s famous voice and mannerisms for fans in the past.

It comes after it was reported that Johnny is set ‘to return’ to Pirates of the Caribbean after being dropped from the franchise in 2018. 

He was the major lead in five Pirates movies over the past 15 years and made what was thought to be his final voyage on the Black Pearl in Dead Men Tell No Tales which was released in 2017.

But a source told Poptopic that the actor has been in talks with Disney about a ‘$300 million deal’ after winning his defamation trial again Amber Heard. 

The insider revealed that Disney are interested in patching the relationship up with Johnny and have recently reached out to him.

They said: ‘They reached out to the actor prior to his defamation trial against Amber Heard and asked whether he would be interested in returning for another pirate film or two.

The source added that another project is in the works for Disney Plus. They said: ‘The deal is reportedly for Johnny Depp to return as Jack Sparrow in Pirates of the Caribbean 6 and a spin-off Disney Plus series about the early life of the Captain of The Black Pearl.’

They continued: ‘What I can tell you is that the studio has already penned up a draft for a film about Jack Sparrow so they are very hopeful that Johnny will forgive them and return as his iconic character.’

The source said that the media house is working on a ‘$301 million deal’ to coax Depp back soon and are also reportedly adding a ‘sizeable donation’ to a charity of Depp’s choice as a gesture of goodwill.

The Edward Scissorhands star previously told the jury he would not work with Disney again after he was scrubbed from the sixth Pirates movie.

His legal team claims Johnny lost out on a $22 million payday after Amber published her Washington Post op-ed in 2018 that didn’t identify Johnny, but clearly branded him as a domestic abuser.

Johnny said he felt as if he was ‘guilty until proven innocent’ with Disney executives.

Original Pirates script writer Stuart Beattie was the first to publicly confirm that Disney Studios were ditching the star in 2018 as they rework the entire franchise.

Speaking exclusively to DailyMailTV at a red carpet event in Hollywood, Beattie confirmed on camera the reboot means Depp is out as Sparrow.

Nodding when it was suggested Depp was out, he said: ‘I think he’s had a great run. Obviously, he’s made that character his own and it’s become the character he’s most famous for now.

‘And kids all over the world love him as that character so I think it’s been great for him, it’s been great for us, so I’m just very, very happy about it.’

Amber Heard seen in Spain with daughter after Johnny Depp trial

Amber Heard has resurfaced in Spain after having gone MIA for a few months.

The “Aquaman” actress and her 1-year-old daughter, Oonagh Paige, were photographed in Palma de Mallorca on Friday while spending time with her girlfriend, Bianca Butti.

In multiple photos, Heard can be seen playing with her daughter on a swing set, walking with her and a group of friends and enjoying the European city.

It’s unclear how long she will be staying in Europe.

Heard, 36, looked happy surrounded by friends and her daughter, whom she welcomed via surrogate in July 2021, despite losing to Johnny Depp in their defamation trial in June. As a result, Heard owes her ex-husband millions of dollars.

The lack of funds hasn’t stopped Heard from spending a chunk of the summer in the Hamptons and then jet-setting off to Israel, where she was seen vacationing with pal Eve Barlow — a woman barred from the courtroom during the trial — and Oonagh.

As Page Six exclusively reported, the judge ejected Barlow from the highly publicized Depp-Heard trial in April for “live-tweeting, texting and posting information” while sitting in the front row, which is usually reserved for legal counsel.

Amber Heard has hired new lawyers as she appeals the $10 million verdict awarded to Johnny Depp in their defamation battle — a move experts said could be advantageous for the “Aquaman” actress.

Heard, 36, has brought on David Axelrod and Jay Ward Brown, of national law firm Ballard Spahr, who successfully represented the New York Times against former Alaska Gov. Sarah Palin’s libel lawsuit.

They’ll help Heard as she fights to overturn the largely unfavorable verdict against her handed down by a jury following the ex-couple’s bombshell trial in Fairfax, Virginia.

Virginia lawyer Elaine Bredehoft — who repped Heard at trial — will be leaving the team, according to a spokesperson for the actress.

“A different court warrants different representation, particularly as so much new evidence is now coming to light,” the rep said.

Texas civil lawyer Katherine Lizardo — who followed the trial closely — said she expected the change in the legal team and noted it would benefit Heard.

“This is a good move for her because it would give her a different point of view legally from trial counsel,” Lizardo told The Post.

Appeal lawyers are a “different breed” of attorneys who are experts in the “nuanced and specialty” field of law, Lizardo explained.

“If Amber Heard did not hire an attorney that was familiar with the appellate system then she would lose,” she said.

Lizardo also noted that it takes a certain demeanor to argue an appellate case — which in Virginia only allows for each side to speak for 15 minutes before a three-judge panel.

“Elaine Bredehoft’s style at trial and her time management issues wouldn’t work for appeal,” Lizardo said. “We saw when Elaine would ramble on or argue unrelated matters and that would be very detrimental if she argued similarly in front of the court of appeal judges.”

New York civil lawyer William Newman told The Post that Axelrod and Brown’s maneuvers in Palin’s case against the Times signal the type of strategy the legal team will use in Heard’s appeal.

The lawyers had focused on trying to prove that statements made about the 2008 Republican vice presidential nominee in a Times piece weren’t made with actual malice — which is a higher legal standard applied to cases involving public figures.

“By selecting a lawyer that famously made that argument in the Sarah Palin case — that tells me that [actual malice] is going to be something that they are going to likely focus on in this appeal,” Newman said.

Still, Newman said it’s smart that Heard is still hanging onto one of her Virginia lawyers from trial, Benjamin Rottenborn.

“I think it’s a good choice,” Newman said of hiring Axelrod and Brown. “Ballard Spahr is a very well regarded firm. She is in good hands.”

“It’s still very good to have local Virginia lawyers working on it too,” Newman added.

Former California appeals court judge and current criminal defense attorney Halim Dhanidina told The Post that hiring new lawyers for an appeal is routine and has many upsides, including gaining the expertise of an appellate lawyer and getting a fresh set of eyes on the case.

A trial lawyer “is almost too close to the issues.” Dhanidina said. “Whereas an appellate specialist might be able to look at what happened in the lower court record and have perhaps a different perspective or a different strategy of how they might be successful on appeal.”

“What an attorney might want to do at the appellate level is perhaps second guess some of the strategies or actions taken by the trial attorney and the attorney who handled the trial would obviously not be in a position to be critical or to second guess their own actions,” the former judge noted.

The 59-year-old “Pirates of the Caribbean” actor won a $10.35 million verdict in June with a jury siding with his claims that Heard defamed him in a 2018 Washington Post op-ed piece on being a victim of domestic violence.

While she didn’t specifically name Depp in the essay, his side argued at trial that it clearly referred to her allegations that he abused her around their 2016 divorce.

The jury awarded Heard $2 million in her counterclaims that Depp defamed her when his lawyer Adam Waldman called her claims a hoax.

Bredehoft didn’t return a request for comment Monday.

Amber’s insurance company is reportedly refusing to pay for the damages the actor owes her ex-husband following their high-profile defamation trial. Amber was ordered to pay $10 million in compensatory damages and $5 million in punitive damages in a June 1 verdict in a US court. According to the report, the insurance company is suing Amber Heard so that it can be absolved of any duty to pay for her defense in the recent defamation case against ex-husband Johnny. The report added that the US-based company is also suing Amber so that it does not have to pay any costs of ongoing litigation, if Amber makes any further appeals in court or be required to pay the damages, Amber was ordered to pay Johnny after the trial’s verdict was declared.

New York Marine and General Insurance Company filed the suit against Amber on Friday in the US District Court for the Central District of California, reported lawandcrime.com. The report added Amber had a $1 million liability policy with the company, with which she could have paid a portion of the damages she owes Johnny. However, the insurance company could refuse the payout, if Amber was found to have committed ‘willful’ and ‘malicious’ misconduct. Amber’s insurance coverage was from July 2018 to July 2019. During that time period, Amber wrote an op-ed in The Washington Post, in which she said she was ‘a public figure representing domestic abuse’.



In the suit it filed against Amber, New York Marine and General Insurance Company, reportedly said that California insurance law provides that although an insurance company may be liable for an insured party’s negligence, ‘an insurer is not liable for a loss caused by the willful act of the insured’. The company added that Amber was found to have acted with actual malice, in other words, willfully. Therefore, it should not have to compensate Amber.

Earlier, it was reported that Amber’s lawyers wanted a Virginia court to order a fresh trial in the defamation case against Johnny, as a wrong juror was seated in the jury during the trial. Johnny and Amber have both accused each other of domestic violence. After Johnny sued Amber for defamation because of her 2018 article, Amber countersued Johnny for $100 million in 2021.

Amber Heard asks for Johnny Depp defamation verdict to be tossed

Amber Heard has asked a Virginia judge to toss her losing verdict in the defamation lawsuit filed by ex-husband Johnny Depp — claiming the evidence doesn’t hold up.

Lawyers for Heard, who was found guilty of three defamation claims filed by Depp, claimed in a 43-page motion filed last week that the judgment wasn’t supported by the evidence during the former couple’s blockbuster trial.

The document claims Depp “proceeded solely on a defamation by implication theory, abandoning any claims that Ms. Heard’s statements were actually false,” the papers filed Friday claim.

Heard’s attorneys also argue that Juror 15 on the panel may have even been selected illegally by giving the wrong birthdate during jury selection — 1945 instead of the actual year of 1970.

“This discrepancy raises the question [of] whether Juror 15 actually received a summons for jury duty and was properly vetted by the court to serve on the jury,” the lawyers’ motion said. 

It is unknown if the juror actually deliberated on the case.

Depp, 58, sued his ex claiming he damaged his career in a 2018 op-ed piece in The Washington Post alleging she was a victim of domestic abuse — and leaving little doubt the reference was to the “Pirates of the Caribbean” franchise star.

Depp attorney Ben Chew emailed Courthouse News that Heard’s filing was “what we expected, just longer, more substantive,” The Guardian reported.

In the verdict last month, the jury awarded Depp $10 million in compensatory damages and $5 million in punitive damages — although Virginia law restricted the total to $10.3 million.

Heard, who countersued, was awarded $2 million for one of her claims.

But Chew and the “Aquaman” actress’s legal team argued in the new court filing that Depp failed to prove that the actor’s career and reputation were impacted by Heard’s op-ed article. 

“Mr. Depp presented no evidence of any pecuniary damages suffered in the limited December 18, 2018, through November 2, 2020 timeframe as a result of the Op-Ed,” the motion said. “There was no evidence of any project or lost commercial opportunities because of the Op-Ed.”

The lawyers noted that Depp had not signed a contract for the sixth installment of “Pirates of the Caribbean,” despite claiming at the trial that The Washington Post cost him the role.

The papers also argue that Depp failed to disprove the abuse claims.

“Mr. Depp was required to establish at the time the Op-Ed was published, Ms. Heard did not believe she had been abused or that she had doubts about whether she was abused,” Chew wrote.

“But Mr. Depp presented no evidence -that Ms. Heard did not believe she was abused. Instead, the evidence overwhelmingly supported [that] Ms. Heard believed she was the victim of abuse at the hands of Mr. Depp.

“Therefore, Mr. Depp did not meet the legal requirements for actual malice, and the verdict should be set aside,” the papers said
