Brett Favre’s texts included in lawsuit over misspent Mississippi welfare funds

“Just left Brett Farve (sic). Can we help him with his project,” Bryant wrote to Nancy New, the founder of the nonprofit Mississippi Community Education Center, in a July 2019 message. “We should meet soon to see how I can make sure we keep your projects on course.”

In a separate conversation nearly two years prior, Favre wrote to New about his concerns about media publicity.

“If you were to pay me is there anyway the media can find out where it came from and how much?” Favre wrote in an August 2017 message.

“No, we never have had that information publicized,” New said.

The next day, New texted Favre with an update: “Wow, just got off the phone with Phil Bryant! He is on board with us! We will get this done!”

More than two years later, Bryant texted New to ask whether she had gotten any of the new programs through Mississippi’s Department of Human Services (DHS). New responded, in part, that “someone” was “definitely pulling for us behind the scenes,” and thanked Bryant. He responded with a smile emoji.

The text messages were included in a legal filing Monday as part of a civil lawsuit brought by the Mississippi DHS related to misspent welfare funds. Attorney Thomas Bufkin, who represents New’s non-profit Mississippi Community Education Center, one of the defendants, included the texts as part of a motion to compel Bryant to produce further documents.

The lawsuit stems from an investigation into how the state spent tens of millions of dollars in federal money that was intended to go to those most in need — the largest public fraud scheme in the state’s history, according to the state’s auditor.
The media outlet Mississippi Today, which has covered the scheme for several years, has reported that at least $5 million of the welfare funds were channeled to build a new volleyball facility at the University of Southern Mississippi. Favre played football for the school from 1987-90 and his daughter played volleyball there 2017-2022.

In April, New and her son were convicted for their roles in a scheme to use the welfare funds for the construction of the volleyball center. Neither Bryant nor Favre have been charged with wrongdoing.

Bryant’s attorney William M. Quin II issued a statement in response to the filing.

“Governor Bryant notified Nancy New’s attorney that he would produce the requested documents even though he isn’t a party to the lawsuit. All of the documents are privileged, so Governor Bryant requested that New’s attorney agree to a protective order that would allow the documents to be used in court with certain reasonable restrictions,” Quin said.

“Cases should be tried in courts of law where rules of evidence govern and privileges are respected. They should not be tried in the press, where innuendo and speculation sometimes get confused with actual facts. It appears that New’s attorney prefers to try his client’s case in the latter as opposed to the former.”

Favre’s attorney Bud Holmes denied any wrongdoing. “Since the very beginning, Brett has been honorable from day one to today,” he said.

University of Southern Mississippi did not respond to a request for comment.

How we got here

In May 2020, Mississippi’s state auditor announced that the state’s Department of Human Services wasted tens of millions of dollars in federal welfare grant funds through misspending, personal use and spending on family members, friends of staffers and grantees, including Favre.

The eight-month long investigation showed that the department gave more than $98 million to two non-profits: The Mississippi Community Education Center and the Family Resource Center of North Mississippi.

Of the $98 million, $94 million was “questioned,” meaning it was either definitively misspent or auditors were unable to determine if it was legally spent. Most of the money, given over three years, from 2016 to 2019, came from the Temporary Assistance for Needy Families program, state auditor Shad White said.

Among the “questioned” spending is a series of payments made to Favre by the Mississippi Community Education Center.

The audit shows that Favre Enterprises was paid $500,000 in December 2017 and $600,000 in June 2018 in return for speeches at multiple events. The auditor’s report, however, states that “upon a cursory review of those dates, auditors were able to determine that the individual contracted did not speak nor was he present for those events.”

A follow-up audit conducted by an accounting firm in Maryland found that more than $77 million was improperly used from the state’s welfare program through the non-profits.

Favre, a Mississippi native, made millions of dollars during his stellar NFL career from 1991 to 2010, primarily as a quarterback for the Green Bay Packers. He was inducted into the Hall of Fame in 2016.

In October 2021, Favre repaid the state $600,000 but authorities said he still owed $228,000 in interest.

“I have never received monies for obligations I didn’t meet,” Favre said in a tweet in May 2020. “… I was unaware that the money being dispersed was paid for out of funds not intended for that purpose, and because of that I am refunding the full amount back to Mississippi.”

Holmes, his attorney, said Wednesday that Favre did not know the origin of the funds.

“He had no idea where it came from. When it developed later that this money he was paid for speaking came out of money designed by the government … for the less fortunate or poor people, Brett paid it back,” Holmes said.

CNN’s Gregory Lemos and Kelly Mena contributed to this report.

Victims of floatplane crash included activist, winemaker

WHIDBEY ISLAND, Wash. (AP) — A civil rights activist, a business owner, a lawyer, an engineer and the founder of a winery and his family were on the floatplane that crashed in the waters of Washington state’s Puget Sound, killing 10.

The U.S. Coast Guard released the names of the victims early Tuesday. The body of one of the dead was recovered after Sunday afternoon’s crash, but the other nine remain missing despite an extensive search.

The Northwest Seaplanes flight was on its way from Friday Harbor, a popular tourist destination in the San Juan Islands, to a Seattle suburb when it went down without sending out a distress call. The cause of the crash was not immediately known, but the Federal Aviation Administration earlier this year issued a safety directive for the type of aircraft involved.

A team from the National Transportation Safety Board is investigating the crash of the DHC-3 Otter. At a Tuesday evening news briefing, Tom Chapman from the NTSB said investigators on scene wouldn’t speculate on a cause of the crash and crews were collecting information about the approximately 35-minute flight.

Chapman said the agency is directing the search for the wreckage and sonar equipment was being used.

The dead include pilot Jason Winters, activist Sandy Williams, winemaker Ross Andrew Mickel, his pregnant wife Lauren Hilty and their child Remy Mickel. Also killed were passengers Joanne Mera, Patricia Hicks, Luke Ludwig, Rebecca Ludwig and Gabrielle Hanna. The Coast Guard did not provide hometowns.

Williams, from Spokane, Washington, was a lecturer, filmmaker, founder of the Carl Maxey Center and editor of The Black Lens, an African American-focused newspaper.

“Sandy was a voice for the voiceless, a tireless advocate for marginalized people in Spokane, a journalist unafraid to speak truth to power, a builder of hope in her vision for the Carl Maxey Center, and a beloved friend to countless members of our community,” The Spokane County Human Rights Task Force said on Facebook.

Thayne McCulloh, president of Gonzaga University, said the community lost a leader, teacher, activist and powerful voice.

Also from Spokane, Hicks was a retired teacher.

Mickel was the founder of the Ross Andrew Winery in Woodinville, Washington.

“We are deeply saddened and beyond devastated at the loss of our beloved Ross Mickel, Lauren Hilty, Remy and their unborn baby boy, Luca,” the Mickel and Hilty families said in a statement. “Our collective grief is unimaginable. They were a bright and shining light in the lives of everyone who knew them.”

The Washington State Wine Commission said in an email that Ross had “an incredible impact on the Washington wine community” and will be greatly missed.

Mera was a business owner from San Diego, The Seattle Times reported. Her niece, Sami Sullivan, said she was visiting family in Seattle. She leaves behind three children and a husband of more than 30 years, Sullivan said.

“Joanne Mera was someone everyone gravitated towards,” Sullivan said in a statement. “She was the life of any party and the soul of our family.”

The Ludwigs, a couple from Minnesota, also perished in the crash. Luke Ludwig was an engineering leader with Arizona-based HomeLight Home Loans.

“The entire HomeLight team extends our deepest sympathies to both Luke and Becca’s families, friends, and loved ones,” the company said in an email. “Luke was a deeply devoted father, husband, outdoorsman, and coach for his kids’ sports teams, known for his remarkable kindness and generous spirit.”

Seattle lawyer Gabby Hanna was returning from a friend’s wedding when the plane went down, The Seattle Times reported.

“She was a fierce, fierce young woman, in the best of ways,” her father, Dave von Beck, said. “There are no words to describe the pain.”

The Coast Guard ended the search for survivors Monday afternoon. The plane went down in Mutiny Bay off Whidbey Island, about halfway between Friday Harbor and its destination in Renton.

The owner of the seaplane company was aboard one of two flights that took off on Sunday, Scott Giard, director of the U.S. Coast Guard’s search and rescue for the Pacific Northwest, said at a news conference.

The owner told authorities he saw the other plane divert slightly off course and he tried to make radio contact but was unable to.

“Shortly after that, he noticed on his flight tracker that the flight had stopped tracking and notified authorities,” Giard said.

Officials received reports that “the aircraft dropped suddenly at a fair amount of speed and hit the water,” Giard said.

There was no distress call or distress beacon from the crashing plane, he said. The aircraft has an electronic locating transmitter onboard, but they have not received any transmission.

Steven Wallace, former director of FAA Office Accident Investigations, said the NTSB will look at all other accidents with this type of aircraft, any safety directives and the company’s maintenance records as it tries to learn why the plane hit the water.

“Early in the investigation every possibility is on the table,” Wallace said.

One accident that will be of interest is the 2019 crash of the same model of floatplane in Manitoba, Canada, he said. A DHC-3 Otter with a pilot and two passengers was headed to Family Lake when the plane’s right wing came off. The aircraft took a nosedive into the lake, killing everyone onboard, according to the accident report.

Following the lead of Canadian authorities, the FAA issued an Airworthiness Directive for these planes in March that required inspections of lugs, bolts and plates to ensure the wing strut is secure, according to the agency’s order.

“Failure of a wing strut could result in a catastrophic in-flight breakup of the wing,” the report said.

Coast Guard searchers found “minimal debris,” Giard said.

Without a clear picture of the actual crash, and not knowing whether it exploded on impact or immediately sank to the sea floor, 150 to 200 feet (45-60 meters) below, it’s difficult to know what happened to the plane, he said.

U.S. Justice Dept. says Trump papers included material on intelligence, sources

WASHINGTON, Aug 26 (Reuters) – The U.S. Department of Justice on Friday said it was investigating former President Donald Trump for removing White House records because it believed he had illegally retained documents, including some pertaining to government intelligence-gathering and sources – among the country’s most closely-held secrets.

The heavily redacted affidavit about government documents at Trump’s Mar-a-Lago estate that was released on Friday contained some new details, though it did not unveil any major revelations.

Nevertheless, the affidavit could help explain why the Justice Department sought court approval for an Aug. 8 search at the Florida resort.

The FBI search marked a significant escalation in one of the many federal and state investigations Trump is facing from his time in office and in private business.

The Republican former president has suggested he might run for the White House again. He has described the search as politically motivated, and on Friday, he again described the court-approved search as a “break-in.”

The FBI action was part of a federal probe into whether Trump illegally removed documents when he left office in January 2021 after losing the presidential election to Democrat Joe Biden, and whether he tried to obstruct the government’s investigation.

According to the document released on Friday, an unidentified FBI agent said the FBI had reviewed and identified 184 documents “bearing classification markings” containing “national defense information,” after Trump in January returned 15 boxes of government records to the U.S. National Archives.

The agent who drafted the affidavit said that after the FBI had reviewed the initial batch of records, it believed there was probable cause to believe more documents were still inside Mar-a-Lago.

“There is also probable cause to believe that evidence of obstruction will be found at the premises,” the agent added.

The Justice Department also said on Friday in a separate batch of unsealed records that it has “a significant number of civilian witnesses” who are helping with its investigation, a rare disclosure for a probe in such early stages.

Like much of the 32-page affidavit, many pages in those other unsealed records were also redacted.

TRUMP REACTION

Trump on Friday complained on social media that the affidavit was “heavily redacted,” and he demanded that the judge in the case recuse himself without giving any apparent basis – a request that Trump’s legal team has not formally made with the court.

“Judge Bruce Reinhart should NEVER have allowed the Break-In of my home,” Trump wrote.

The records unsealed on Friday also showed how Trump’s attorneys tried to convince the Justice Department not to pursue a criminal investigation, arguing Trump had the authority to declassify documents.

In one section, it references an article published in May by former Trump administration official Kash Patel, who claimed media reports about the National Archives identifying classified material at Mar-a-Lago were “misleading.”

Brandon Fox, a former federal prosecutor now with Jenner and Block, said he believes the references to Trump’s claims about declassifying the documents are significant, even though much of the material is redacted.

“They likely indicate the proof the DOJ believes it has showing that Mr. Trump had not declassified the documents,” he told Reuters.

The newly released records also showed how Trump’s attorneys sought to downplay the Justice Department’s concerns about the records.

“Any attempt to impose criminal liability on a President or former President that involves his actions with respect to documents marked classified would implicate grave constitutional separation-of-powers issues,” Trump’s attorney Evan Corcoran wrote in a May 25 letter to the Justice Department’s head of counterintelligence.

“Beyond that, the primary criminal statute that governs the unauthorized removal and retention of classified documents or material does not apply to the President,” he added.

The FBI agent said a preliminary review of the records the Archives received in the 15 boxes, which was conducted between May 16-18, found 184 “unique documents” labeled as classified. Of those, 67 were marked “confidential” while 92 were marked as “secret” and 25 marked as “top secret.”

Other defense-related records, meanwhile, contained references to things such as confidential sources that help the United States with its intelligence-gathering, as well as details on how the U.S. conducts foreign surveillance and information it collected using the Foreign Intelligence Surveillance Act – the law that established the country’s domestic surveillance program.

The agent added that there was probable cause to search a number of rooms inside Mar-a-Lago, including a storage room and Trump’s residential suit as well as “Pine Hall” and the “45 Office.”

Asked by reporters on Friday if it’s ever appropriate for a president to bring classified material home, President Joe Biden said it depends.

“It depends on the document and it depends on how secure” the location is, he said. He added that he has a “completely secure” site at his home, and that he was taking home on Friday a copy of his daily intelligence briefing, but said those records would later be returned to the military.

Democratic Senator Mark Warner, who chairs the Senate Intelligence Committee, said Friday’s documents underscore the need for the panel to receive a bipartisan “damage assessment of any national security threat posed by the mishandling” of the information.
