Migrants flown to Martha’s Vineyard by Florida governor say they were misled

MARTHA’S VINEYARD, Mass., Sept 15 (Reuters) – Some migrants who were flown to the wealthy island of Martha’s Vineyard, Massachusetts, said on Thursday they were duped about their destination, and Democratic leaders called for a probe of the move by Florida’s Republican governor to send them there from Texas.

Florida Governor Ron DeSantis, who is up for re-election in November and seen as a possible presidential contender in 2024, took credit for the two flights, which originated in San Antonio, Texas, and stopped in Florida on the way to Martha’s Vineyard.

The White House and residents of the vacation enclave called it a “political stunt,” as DeSantis joins Republican governors from Texas and Arizona in sending migrants north. The governors have sought to highlight the two parties’ differences on immigration policy and shift the burden of caring for immigrants to Democratic areas.

For months Texas and Arizona have sent busloads of migrants to the Democratic-run cities of New York, Chicago and Washington.

Florida now joins the campaign. Details of how the flights were arranged and paid for remain unclear, as well as an explanation as to why Florida was moving migrants in Texas. The Florida legislature has appropriated $12 million to transport migrants from the state to other locations.

The two flights on Wednesday carried about 50 migrants, mostly Venezuelans, a Martha’s Vineyard Airport official said.

Hours after the planes landed, two buses sent by Texas Governor Greg Abbott, another Republican facing re-election, dropped off migrants in a Washington neighborhood not far from Vice President Kamala Harris’ official residence on Thursday.

One Venezuelan migrant who arrived at Martha’s Vineyard identified himself as Luis, 27, and said he and nine relatives were promised a flight to Massachusetts, along with shelter, support for 90 days, help with work permits and English lessons. He said they were surprised when their flight landed on an island.

He said the promises came from a woman who gave her name as “Perla” who approached his family on the street outside a San Antonio shelter after they crossed from Mexico and U.S. border authorities released them with an immigration court date.

He said the woman, who also put them up in a hotel, did not provide a last name or any affiliation, but asked them to sign a liability waiver.

“We are scared,” he said, adding he and others felt they were lied to. “I hope they give us help.”

Residents of Martha’s Vineyard rallied to aid the confused migrants and offered housing at St. Andrews Episcopal Church.

Martha’s Vineyard is best known as a summer retreat populated mostly by affluent liberal Americans, including former President Barack Obama, a Democrat who owns a multimillion-dollar vacation home there.

Locals stopped by to donate money and children’s toys, while attorneys mobilized to offer free legal help.

“It’s a stunt to make political points and not caring about who gets hurt,” said Mike Savoy, 58, a nurse at Martha’s Vineyard Regional High School.

DeSantis defended the flights, telling a news conference that Democratic U.S. President Joe Biden “has refused to lift a finger” to secure the border.

“We’ve worked on innovative ways to be able to protect the state of Florida from the impact of Biden’s border policies,” DeSantis said.

White House Press Secretary Karine Jean-Pierre said Republican governors were using migrants as “political pawns.”

LEGAL QUESTIONS

Several Democrats, including Charlie Crist, DeSantis’ opponent in Florida, and California Governor Gavin Newsom, called on federal authorities to investigate.

Massachusetts U.S. Attorney Rachael Rollins said at a news conference her office would be “looking into that case” and speaking with the Justice Department.

The U.S. Department of Homeland Security developed a plan last year to fly migrants to interior cities in coordination with aid groups to ease pressure on border regions, a Biden administration official told Reuters, requesting anonymity to discuss internal planning.

The White House never adopted the idea, according to a second U.S. official familiar with the matter.

The use of resources from Florida to move migrants from Texas to Massachusetts raises legal concerns, including about what information was relayed to the migrants before they boarded and whether they were coerced, said immigration law expert Pratheepan Gulasekaram of Santa Clara University School of Law.

U.S. border agents have made 1.8 million migrant arrests at the U.S.-Mexico border since last October. Many are quickly expelled to Mexico or other countries under a public health rule implemented in 2020 to curb the spread of COVID-19.

But hundreds of thousands Cubans, Nicaraguans, Venezuelans and others cannot be expelled because Mexico refuses to accept them, or because they can pursue asylum claims. read more

Many migrants who are released from U.S. custody in border states seek to move elsewhere to join relatives or find jobs. They often must check in with U.S. immigration authorities or attend court hearings to obtain legal status.

Pope dissolves Knights of Malta leadership, issues new constitution

VATICAN CITY, Sept 3 (Reuters) – Pope Francis on Saturday dissolved the leadership of the Knights of Malta, the global Catholic religious order and humanitarian group, and installed a provisional government ahead of the election of a new Grand Master.

The change, which the pope issued in a decree, came after five years of often acrimonious debate within the order and between some top members of the old guard and the Vatican over a new constitution that some feared would weaken its sovereignty.

The group, whose formal name is Sovereign Military Hospitaller Order of St. John of Jerusalem, of Rhodes and of Malta, was founded in Jerusalem nearly 1,000 years ago to provide medical aid for pilgrims in the Holy Land.

It now has a multi-million dollar budget, 13,500 members, 95,000 volunteers and 52,000 medical staff running refugee camps, drug treatment centres, disaster relief programs and clinics around the world.

The order has been very active in helping Ukrainian refugees and war victims.

It has no real territory apart from a palace and offices in Rome and a fort in Malta, but is recognised as a sovereign entity with its own passports and licence plates.

It has diplomatic relations with 110 states and permanent observer status at the United Nations, allowing to act as a neutral party in relief efforts in war zones.

Cardinal Silvano Tomasi, the pope’s special delegate to the order, told reporters at a briefing along with some members of the provisional government that the order’s new constitution would not weaken its international sovereignty.

But as a religious order, it had to remain under the auspices of the Vatican, said Cardinal Gianfranco Ghirlanda, a member of the working group that prepared the new constitution approved by the pope on Saturday.

Francis convoked an extraordinary general chapter for Jan. 25 to begin the process of electing a new Grand Master.

The last one, Italian Giacomo Dalla Torre, died in April.

“We hope this will re-establish unity in the order and increase its ability to serve the poor and the sick,” Tomasi said.

Tomasi and the Lieutenant of the Grand Master, Canadian John Dunlap, will lead the group to the general chapter. A new Grand Master is expected to be elected by March, officials said.

Under the previous constitution, the top Knights and the Grand Master were required to have noble lineage, something reformers said excluded nearly everyone except Europeans from serving in top roles.

The new constitution eliminates the nobility rule as well as the tradition of Grand Masters being elected for life.

“It will be more democratic. The question of nobility has now become secondary,” Tomasi said.

Future Grand Masters will be elected for 10-year terms, renewable only once, and will have to step down at age 85.

Reformers, backed by the Vatican, had called for a more transparent government to bring in fresh blood and allow the order to better respond to the massive growth it has seen in recent years.

Australia raises migration target amid labour squeeze, global talent race

SYDNEY, Sept 2 (Reuters) – Australia on Friday increased its intake of permanent migrants to 195,000 this financial year, up by 35,000, in a bid to help businesses and industries battling widespread staff shortages and reduce reliance on short-term workers.

The COVID-19 pandemic closed the country’s borders for nearly two years and along with an exodus of holiday workers and foreign students left businesses struggling to find staff to keep afloat.

“It makes no sense to bring people in, have them for a few years, then get a new cohort in to adapt to the Australian work environment,” Prime Minister Anthony Albanese told reporters on the sidelines of a government jobs summit in Canberra.

“We want people … to have a mortgage, to raise a family, to join the Australian family. Migration is part of our story.”

The increase will take effect for the current financial year ending June 2023 and will bring Australia’s immigration target largely in line with the annual cap of 190,000 that was in place between 2013 and 2019.

That level was cut by 15% to 160,000 just months before the emergence of COVID-19 in a bid to ease urban congestion. The government gave no details on numbers going forward.

Australia’s unemployment rate is now at a near 50-year-low of 3.4% but labour shortages have contributed to soaring inflation that has reduced real wages.

“COVID is presenting us, on a platter, with a chance to reform our immigration system that we will never get back again. I want us to take that chance,” Home Affairs Minister Clare O’Neil told the summit.

SKILLED LABOUR RACE

Australia has been competing with other developed economies, like Canada and Germany, to lure more high-skilled immigrants, with the surge in demand exacerbated by an ageing population.

Canada, last month, said it was on track to exceed its goal of granting permanent residency to more than 430,000 people this year, more than double Australia’s target, while Germany plans reforms to make itself more attractive to skilled workers.

But a blowout in visa processing times in Australia has left about a million prospective workers stuck in limbo, worsening the staff shortage crisis. read more

“We understand that when people wait and wait, the uncertainty can become unmanageable,” Immigration Minister Andrew Giles told the summit. “This is not good enough, and reflects a visa system that has been in crisis.”

In a bid to speed up visa processing, Giles said the government will spend A$36.1 million ($25 million) to beef up its staff capacity by 500 people for the next nine months.

Businesses welcomed the government’s efforts.

“We are in a global competition for the world’s best talent and the more barriers we remove from the system the more chance we will have of attracting the best people,” said Innes Willox, Chief Executive of the Australian Industry Group.

Turks frustrated by ‘deliberate’ increase in number of European visa rejections

ISTANBUL, Aug 26 (Reuters) – Turkish sports presenter Sinem Okten was surprised to see her visa application to Europe’s Schengen area rejected twice, having visited often to cover matches and interview figures like Italian keeper Gianluigi Buffon and Liverpool’s Juergen Klopp.

“I applied first to Germany then to France. Both rejected my application,” she said. “I’ve travelled abroad numerous times to follow and film matches and interview people, maybe 50-60 times. This is the first time I am having this problem.”

Turks applying for visas to the 26 Schengen countries are increasingly being rejected, data shows, and tours are being cancelled. Ankara said this week it was a deliberate effort to put President Tayyip Erdogan in a difficult position ahead of tight elections next year, a charge the European Union denies.

According to data from schengenvisainfo.com, 16.5% of applicants from Turkey last year were denied a visa, up from 12.5% a year earlier. Schengen rejections were only 4% in 2015 and started ramping up in 2017 for Turks, it shows.

The visa costs – amounting to some 100 euros, or a third of Turkey’s minimum wage – are not refundable whether a visa is issued or not.

“Overall, the rejection rates for Schengen visa applications have increased worldwide…however, when compared to other countries like Russia, Turkey’s rejection rate growth is way bigger and consistent,” said Shkurta Januzi, editor-in-chief at SchengenVisaInfo.com.

Okten said the German embassy gave no reason for rejecting her application. A document from the French embassy, seen by Reuters, said it did not see enough evidence that the TV presenter could finance her stay in France or return to Turkey.

Turkish Foreign Minister Mevlut Cavusoglu said he believed the lengthy processing times and an increase observed in rejection rates were deliberate, adding that he raised the issue in meetings with his counterparts.

“Unfortunately, the U.S. and some EU and non-EU western countries give our citizens visa appointments one year, 6-7-8 months later. They also increased the rejection rate. This is planned and deliberate,” he said on Tuesday.

Cavusoglu dismissed “excuses” related to coronavirus measures or personnel shortages, and said, without providing evidence, that the visa rejections were intended to give Erdogan a pre-election headache.

His ministry will warn ambassadors of some Western countries about the issue in September, he said. “If the situation does not improve after that we will take counter, restrictive measures.”

Nikolaus Meyer-Landrut, head of the EU delegation to Turkey, told Reuters the Schengen applications are treated on their merits and not on political grounds, adding relatively more incomplete and potentially fraudulent applications are seen from Turkey.

“No decisions are taken on political grounds but rather on objective grounds,” he said, adding Turkey’s rejection rate last year was near the global rate of 13-14% for Schengen visas.

TOURS CANCELLED

Twenty-two of the 26 Schengen area members are EU states.

Turkey and the bloc enjoy good trade ties and decades of migration however relations are strained over issues including freedom of speech in Turkey and EU policies on refugees from Syria.

Before the coronavirus pandemic, Schengen states received more than 900,000 visa applications annually from Turkey but that figure had dropped to around 270,000 in 2021.

Citizens from all Schengen countries are exempt from visas when visiting Turkey, most for up to 90 days, and some can enter with only their ID cards, according to Turkey’s foreign ministry website.

As more and more Turks are being rejected, tour operators have cancelled regular trips, Tur Andiamo chairman Cem Polatoglu said.

“We are having problems. Our tours are getting cancelled. We used to schedule tours to Italy every week, now we have to offer them every fortnight,” Polatoglu said.

At a visa application centre in Istanbul, 57-year-old Hikmet Dogan said it was easier to get a visa in his previous trips to see his son in Sweden.

“I travelled 2-3 times but this time it is harder, the costs jumped too…Unfortunately young people are trying to leave the country as the Turkish economy is getting worse,” Dogan said.

Beyond the Schengen area, the United States vowed on Wednesday to expand its visa processing capacity in Turkey after the foreign minister’s public complaints. read more

Okten, the sports presenter, said she would continue her efforts to secure a visa.

“The season started and I need to cover some matches on site. I need to be able to travel abroad to do my job…I will apply again and try my chance through Greece this time,” she said.

Texas governor sends migrants to New York City as immigration standoff accelerates

NEW YORK, Aug 5 (Reuters) – Texas Governor Greg Abbott, a Republican, said on Friday he has started to send buses carrying migrants to New York City in an effort to push responsibility for border crossers to Democratic mayors and U.S. President Joe Biden, a Democrat.

The first bus arrived early on Friday at the city’s Port Authority Bus Terminal in midtown Manhattan carrying around 50 migrants from Bolivia, Colombia, Ecuador, Honduras and Venezuela. Volunteers were helping to steer people who had no relatives in town to city resources.

“Most of them don’t have anybody to help. They don’t know where to go, so we’re taking them to shelters,” said one volunteer at the bus station, Evelin Zapata, from a group called Grannies Respond.

One family of four from Colombia, who ended up at a homeless intake center in the Bronx, were unsure of where they would spend the night. Byron and Leidy, both 28, said they left the country’s capital Bogota because they were having trouble finding work. They did not provide their last name.

“It’s a little easier to enter the country now, before it was very hard to come here with children,” said Leidy, who traveled with her kids Mariana, 7, and Nicolas, 13. She said the family had hoped someone they knew in New York would take them in, but that plan did not work out. “We came here because they said they would help us find a place to sleep to not have to stay in the street,” Leidy said.

Abbott, who is running for a third term as governor in November elections, has already sent more than 6,000 migrants to Washington since April in a broader effort to combat illegal immigration and call out Biden for his more welcoming policies. read more

Biden came into office in January 2021 pledging to reverse many of the hardline immigration policies of his Republican predecessor, former President Donald Trump, but some efforts have been blocked in court.

Abbott said New York City Mayor Eric Adams could provide services and housing for the new arrivals.

“I hope he follows through on his promise of welcoming all migrants with open arms so that our overrun and overwhelmed border towns can find relief,” Abbott said in a statement.

Arizona Governor Doug Ducey, another Republican, has followed Abbott’s lead and bused another 1,000 to Washington.

U.S. border authorities have made record numbers of arrests under Biden although many are repeat crossers. Some migrants who are not able to be expelled quickly to Mexico or their home countries under a COVID-era policy are allowed into the United States, often to pursue asylum claims in U.S. immigration court.

‘POLITICAL PAWNS’

Adams’ office has in recent weeks criticized the busing efforts to Washington, saying some migrants were making their way to New York City and overwhelming its homeless shelter system.

On Friday the mayor’s press secretary Fabien Levy said Abbott was using “human beings as political pawns,” calling it “a disgusting, and an embarrassing stain on the state of Texas.”

Levy said New York would continue to “welcome asylum seekers with open arms, as we always have, but we are asking for resources to help do so,” calling for support from federal officials.

White House press secretary Karine Jean-Pierre on Friday called the Texas initiative “shameful” and an unnecessary burden on taxpayers in that state.

Costs for the effort amounted to $1.6 million in April and May, a local NBC News affiliate reported in June, more than $1,400 per rider.

Texas officials declined to provide the cost when asked by Reuters.

Washington Mayor Muriel Bowser has also said her city’s shelter system has been strained by migrant arrivals and last month called on the Biden administration to deploy military troops to assist with receiving the migrants, a request that has frustrated White House officials. read more

A U.S. defense official, speaking on condition of anonymity, told Reuters that Defense Secretary Lloyd Austin had declined a request for D.C. National Guard to help with the transportation and reception of migrants in the city because it would hurt the troops’ readiness.

Bowser suggested on Friday that she would submit a more targeted troop request, reiterating her stance that the federal government should handle what she called a “growing humanitarian crisis.”

“If the federal government’s not going to do it, they need to at least get out of our way and give us the resources that we need,” she told reporters.

Many migrants are arriving after long and difficult journeys through South America.

Venezuelan migrant Jose Gregorio Forero said before traveling more than a day by bus from Texas he had crossed through eight countries. “It’s taken 31 days to get here, on foot and asking for rides,” he said, saying he was glad to be in New York where he thought there would be more job opportunities.

New York City, he said, “is very beautiful. I love it.”

Exclusive: Hyundai subsidiary has used child labor at Alabama factory

LUVERNE, Alabama, July 22 (Reuters) – A subsidiary of Hyundai Motor Co has used child labor at a plant that supplies parts for the Korean carmaker’s assembly line in nearby Montgomery, Alabama, according to area police, the family of three underage workers, and eight former and current employees of the factory.

Underage workers, in some cases as young as 12, have recently worked at a metal stamping plant operated by SMART Alabama LLC, these people said. SMART, listed by Hyundai in corporate filings as a majority-owned unit, supplies parts for some of the most popular cars and SUVs built by the automaker in Montgomery, its flagship U.S. assembly plant.

In a statement sent after Reuters first published its findings on Friday, Hyundai (005380.KS) said it “does not tolerate illegal employment practices at any Hyundai entity. We have policies and procedures in place that require compliance with all local, state and federal laws.” It didn’t answer detailed questions from Reuters about the findings.

SMART, in a separate statement, said it follows federal, state and local laws and “denies any allegation that it knowingly employed anyone who is ineligible for employment.” The company said it relies on temporary work agencies to fill jobs and expects “these agencies to follow the law in recruiting, hiring, and placing workers on its premises.”

SMART didn’t answer specific questions about the workers cited in this story or on-the-job scenes they and other people familiar with the factory described.

Reuters learned of underage workers at the Hyundai-owned supplier following the brief disappearance in February of a Guatemalan migrant child from her family’s home in Alabama.

The girl, who turns 14 this month, and her two brothers, aged 12 and 15, all worked at the plant earlier this year and weren’t going to school, according to people familiar with their employment. Their father, Pedro Tzi, confirmed these people’s account in an interview with Reuters.

Police in the Tzi family’s adopted hometown of Enterprise also told Reuters that the girl and her siblings had worked at SMART. The police, who helped locate the missing girl, at the time of their search identified her by name in a public alert.

Reuters is not using her name in this article because she is a minor.

The police force in Enterprise, about 45 miles from the plant in Luverne, doesn’t have jurisdiction to investigate possible labor-law violations at the factory. Instead, the force notified the state attorney general’s office after the incident, James Sanders, an Enterprise police detective, told Reuters.

Mike Lewis, a spokesperson at the Alabama attorney general’s office, declined to comment. It’s unclear whether the office or other investigators have contacted SMART or Hyundai about possible violations. On Friday, in response to Reuters’ reporting, a spokesperon for the Alabama Department of Labor said it would be coordinating with the U.S. Department of labor and other agencies to investigate.

Pedro Tzi’s children, who have now enrolled for the upcoming school term, were among a larger cohort of underage workers who found jobs at the Hyundai-owned supplier over the past few years, according to interviews with a dozen former and current plant employees and labor recruiters.

Several of these minors, they said, have foregone schooling in order to work long shifts at the plant, a sprawling facility with a documented history of health and safety violations, including amputation hazards.

Most of the current and former employees who spoke with Reuters did so on the condition of anonymity. Reuters was unable to determine the precise number of children who may have worked at the SMART factory, what the minors were paid or other terms of their employment.

The revelation of child labor in Hyundai’s U.S. supply chain could spark consumer, regulatory and reputational backlash for one of the most powerful and profitable automakers in the world. In a “human rights policy” posted online, Hyundai says it forbids child labor throughout its workforce, including suppliers.

The company recently said it will expand in the United States, planning over $5 billion in investments including a new electric vehicle factory near Savannah, Georgia.

“Consumers should be outraged,” said David Michaels, the former U.S. assistant secretary of labor for the Occupational Safety and Health Administration, or OSHA, with whom Reuters shared the findings of its reporting.

“They should know that these cars are being built, at least in part, by workers who are children and need to be in school rather than risking life and limb because their families are desperate for income,” he added.

At a time of U.S. labor shortages and supply chain disruptions, labor experts told Reuters there are heightened risks that children, especially undocumented migrants, could end up in workplaces that are hazardous and illegal for minors.

In Enterprise, home to a bustling poultry industry, Reuters earlier this year chronicled how a Guatemalan minor, who migrated to the United States alone, found work at a local chicken processing plant read more .

“WAY TOO YOUNG”

Alabama and federal laws limit minors under age 18 from working in metal stamping and pressing operations such as SMART, where proximity to dangerous machinery can put them at risk. Alabama law also requires children 17 and under to be enrolled in school.

Michaels, who is now a professor at George Washington University, said safety at U.S.-based Hyundai suppliers was a recurrent concern at OSHA during his eight years leading the agency until he left in 2017. Michaels visited Korea in 2015, and said he warned Hyundai executives that its heavy demand for “just-in-time” parts was causing safety lapses.

The SMART plant builds parts for the popular Elantra, Sonata, and Santa Fe models, vehicles that through June accounted for almost 37% of Hyundai’s U.S. sales, according to the carmaker. The factory has received repeated OSHA penalties for health and safety violations, federal records show.

A Reuters review of the records shows SMART has been assessed with at least $48,515 in OSHA penalties since 2013, and was most recently fined this year. OSHA inspections at SMART have documented violations including crush and amputation hazards at the factory.

The plant, whose website says it has the capacity to supply parts for up to 400,000 vehicles each year, has also had difficulties retaining labor to keep up with Hyundai’s demand.

In late 2020, SMART wrote a letter to U.S. consular officials in Mexico seeking a visa for a Mexican worker. The letter, written by SMART General Manager Gary Sport and reviewed by Reuters, said the plant was “severely lacking in labor” and that Hyundai “will not tolerate such shortcomings.”

SMART didn’t answer Reuters questions about the letter.

Earlier this year, attorneys filed a class-action lawsuit against SMART and several staffing firms who help supply workers with U.S. visas. The lawsuit, filed in the U.S. District Court for the Northern District of Georgia on behalf of a group of about 40 Mexican workers, alleges some employees, hired as engineers, were ordered to work menial jobs instead.

SMART in court documents called allegations in the suit “baseless” and “meritless.”

Many of the minors at the plant were hired through recruitment agencies, according to current and former SMART workers and local labor recruiters.

Although staffing firms help fill industrial jobs nationwide, they have often been criticized by labor advocates because they enable large employers to outsource responsibility for checking the eligibility of employees to work.

One former worker at SMART, an adult migrant who left for another auto industry job last year, said there were around 50 underage workers between the different plant shifts, adding that he knew some of them personally. Another former adult worker at SMART, a U.S. citizen who also left the plant last year, said she worked alongside about a dozen minors on her shift.

Another former employee, Tabatha Moultry, 39, worked on SMART’s assembly line for several years through 2019. Moultry said the plant had high turnover and increasingly relied on migrant workers to keep up with intense production demands. She said she remembered working with one migrant girl who “looked 11 or 12 years old.”

The girl would come to work with her mother, Moultry said. When Moultry asked her real age, the girl said she was 13. “She was way too young to be working in that plant, or any plant,” Moultry said. Moultry didn’t provide further details about the girl and Reuters couldn’t independently confirm her account.

Tzi, the father of the girl who went missing, contacted Enterprise police on Feb 3, after she didn’t come home. Police issued an amber alert, a public advisory when law enforcement believes a child is in danger.

They also launched a manhunt for Alvaro Cucul, 21, another Guatemalan migrant and SMART worker around that time with whom Tzi believed she might be. Using cell phone geolocation data, police located Cucul and the girl in a parking lot in Athens, Georgia.

The girl told officers that Cucul was a friend and that they had traveled there to look for other work opportunities. Cucul was arrested and later deported, according to people familiar with his deportation. Cucul didn’t respond to a Facebook message from Reuters seeking comment.

After the disappearance generated local news coverage, SMART dismissed a number of underage workers, according to two former employees and other locals familiar with the plant. The sources said the police attention raised fears that authorities could soon crack down on other underage workers.

Tzi, the father, also once worked at SMART and now does odd jobs in the construction and forestry industries. He told Reuters he regrets that his children had gone to work. The family needed any income it could get at the time, he added, but is now trying to move on.

“All that is over now,” he said. “The kids aren’t working and in fall they will be in school.”

WASHINGTON, July 21 (Reuters) – The U.S. Supreme Court on Thursday declined to reinstate President Joe Biden’s policy shifting the focus of America’s immigration enforcement toward public safety threats, handing a victory to Texas and Louisiana as they challenge a plan they call unlawful.

The justices on a 5-4 vote denied the Biden administration’s request to block a federal judge’s ruling that had prevented immigration officials from carrying out the enforcement guidelines while litigation over the legality of the policy continues. But the court said in a brief order that it would fast-track the Biden administration appeal and hear oral arguments in December.

Biden’s policy departed from the hard-line approach taken by the Democratic president’s Republican predecessor, Donald Trump, who sought to broaden the range of immigrants subject to arrest and removal. Biden took office last year promising a more humane approach to immigration.

In announcing the new guidelines last September, Biden’s administration noted that U.S. officials have long relied on setting enforcement priorities due to the estimated 11 million immigrants living in the country illegally.

The policy would give agents more discretion to consider individual circumstances and prioritizes threats to national security or public safety.

Republicans have criticized Biden’s administration, saying fewer detentions and deportations have encouraged more illegal border crossings.

Texas and Louisiana sued in a federal court in Texas over Biden’s policy, arguing that under federal law officials lack discretion and are obligated to detain immigrants who commit a broad array of crimes or who have been ordered removed.

Increasingly bitter race to replace UK PM Johnson narrows to four

LONDON, July 18 (Reuters) – Britain’s former finance minister Rishi Sunak held onto his lead in the race to become Britain’s next prime minister on Monday as another hopeful was knocked out, leaving four candidates in an increasingly bitter contest to replace Boris Johnson.

Sunak got 115 votes in the third ballot of Conservative lawmakers on Monday, ahead of former defence minister Penny Mordaunt on 82 and Foreign Secretary Liz Truss on 71.

Since Johnson said he would resign earlier this month after his scandal-ridden administration lost the support of many in his ruling Conservative Party, the race to replace him has taken an ugly turn with several contenders turning their fire on the frontrunner Sunak.

He has faced criticism on everything from his record in government to the wealth of his wife by those vying to make it to a run-off between the final two candidates, with foreign secretary Truss and Mordaunt, currently a junior trade minister, his most likely opponents.

The chair of the Foreign Affairs Committee Tom Tugendhat, a former soldier and Johnson critic who has never had a role in government, was eliminated from the leadership contest on Monday, after securing the fewest votes with 31.

Former equalities minister Kemi Badenoch came fourth in the ballot with 58 votes.

The governing Conservative Party’s 358 lawmakers will whittle the field down to the final two this week, eliminating the candidate with the fewest votes each time. The results of the next ballot are due at 1400 GMT on Tuesday.

A new prime minister will then be announced on Sept. 5, after the Conservative Party’s 200,000 members cast postal ballots over the summer.

VIGOROUS DEBATE

The race has become focused on pledges, or non-pledges, to cut taxes, at a time when Britain’s economy is beset with spiralling inflation, high debt and low growth that have left people with the tightest squeeze on their finances in decades.

Bookmaker Ladbrokes said on Monday Truss, who got seven more votes in round three than she had in round two, was now the second favourite, ahead of Mordaunt but behind Sunak.

Truss’s campaign tried to buttress their argument for lower taxes by citing a report by The Centre for Economic and Business Research, a private sector think tank, showing there was more room for manoeuvre from higher tax receipts.

But a top Bank of England official, Michael Saunders, pushed back at her suggestion the government should set a “clear direction of travel” for monetary policy, saying the foundations of Britain’s framework were best left untouched. read more

Suspected truck driver in Texas migrant deaths was on meth, lawmaker says

SAN ANTONIO, June 30 (Reuters) – The suspected driver of a truck packed with dozens of migrants who died in blazing heat during a Texas smuggling attempt was allegedly under the influence of methamphetamine when police encountered him, a U.S. lawmaker told Reuters, citing information from law enforcement.

San Antonio police officers found Homero Zamorano Jr, a Texas native, hiding in brush near the abandoned tractor-trailer on Monday, according to documents filed in federal court on Thursday. Fifty-three migrants lost their lives, making it the deadliest such trafficking incident on record in the United States.

U.S. Representative Henry Cuellar, a Democrat whose district includes the eastern part of San Antonio, told Reuters on Thursday that Zamorano was found to have had methamphetamine, a powerful synthetic drug, in his system.

Cuellar said he was briefed on the matter by U.S. Customs and Border Protection (CBP), but did not know how authorities made that determination. A CBP official, speaking on the condition of anonymity, separately told Reuters that Zamorano had methamphetamine in his system.

Reuters was not immediately able to independently confirm the accounts of the alleged drug use.

Zamorano, 45, appeared in federal court in San Antonio on Thursday where human trafficking charges against him were read. If convicted, he faces a maximum sentence of life in prison or the death penalty and up to a $250,000 fine, he was told.

He was accompanied by public defender Jose Gonzalez-Falla, who declined to comment on the case. U.S. Magistrate Judge Elizabeth Chestney said Zamorano would be held in custody until his next hearing, on July 6.

Officials described finding the trailer’s rear door ajar with bodies stacked inside that were hot to the touch. In nearby brush, officers discovered other victims, some deceased. They found Zamorano hiding near the victims and escorted him to a local hospital for medical evaluation, prosecutors said. Mexican officials said he had tried to pass himself off as one of the survivors.

‘WHERE YOU AT?’

The truck had been carrying migrants from Mexico, Guatemala, Honduras and El Salvador and was found in a desolate, industrial area near a highway on the outskirts of the U.S.-Mexico border.

Temperatures in the area that day had soared as high as 103 Fahrenheit (39.4 Celsius), and authorities called to the scene found no water supplies or signs of working air-conditioning inside the cargo trailer.

Prosecutors allege Zamorano conspired with Christian Martinez, 28, who was also charged with a human trafficking offense. Martinez on Monday sent a photo of a truck load manifest to Zamorano, who responded by saying, “I go to the same spot,” a federal investigator wrote in a court filing Wednesday.

Martinez repeatedly messaged Zamorano in the hours after but received no reply, wrote Nestor Canales, a special agent with Immigration and Customs Enforcement’s (ICE) investigations division. Martinez sent messages including “Call me bro” and “Wya bro,” meaning “where you at,” Canales wrote.

A confidential informant for ICE and the Texas police spoke with Martinez after the incident, Canales wrote. Martinez told the informant, “The driver was unaware the air conditioning unit stopped working and was the reason why the individuals died,” Canales added.

Reuters was unable to reach Martinez for comment. Martinez, who is in official custody, made an initial appearance in a court in the Eastern District of Texas on Wednesday.

‘STASH HOUSE’

Along with 27 Mexicans, the victims included 14 Hondurans, eight Guatemalans and two Salvadorans, Mexican and Guatemalan officials said. Others, including minors, remain hospitalized.

A spokeswoman for Guatemala’s foreign ministry told Reuters it was unclear whether two of the Guatemalans identified Thursday had died on Monday or at a later date.

Among the dead were Pascual Melvin Guachiac, 13, and Juan Wilmer Tulul, 14, both from Guatemala, the country’s foreign ministry wrote on Twitter.

The two were cousins who left home two weeks ago to escape poverty, Guachiac’s mother was quoted as saying by Guatemalan media. read more

Also among the victims was Yazmin Nayarith Bueso, who left Honduras nearly a month ago. Her brother said she had gone a year without a job. “She looked and looked and couldn’t find anything, and became desperate,” Alejandro Bueso told a Honduran television program on Thursday.

Officials believe the migrants boarded the truck on the U.S. side of the border with Mexico.

Surveillance photographs captured the truck passing through a border checkpoint at Laredo, Texas, at 2:50 p.m. CT (1950 GMT) on Monday, before the migrant passengers are believed to have boarded.

Cuellar, the Texas lawmaker, said the migrants had likely crossed the border and gone to a “stash house” before being picked up by the trailer and passing the Encinal checkpoint. They likely then went into San Antonio and experienced mechanical issues that left them in the back of the truck without air conditioning or ventilation, Cuellar said.

Another truck carrying migrants headed for San Antonio evaded the Encinal checkpoint on Thursday, crashing into the back of a tractor-trailer after a chase and killing four on board, according to Mexican authorities. read more

Two other men suspected of involvement in Monday’s incident, Mexican nationals Juan Claudio D’Luna-Mendez and Francisco D’Luna-Bilbao, were charged on Tuesday in U.S. federal court with possessing firearms while residing in the country illegally. A preliminary hearing for the pair is set for Friday.

D’Luna-Mendez’s attorney, Michael McCrum, said his client is a 21-year-old carpenter who has been in the U.S. since childhood and had “nothing to do with” the tragedy. McCrum said he believed the other man charged was his client’s father.

Charging documents in the case said the truck’s registration was tracked to the men’s address. “They are arresting anyone they can,” McCrum said.

Morocco says 18 migrants died during mass crossing into Spanish enclave

MADRID, June 24 (Reuters) – Morocco said 18 migrants died trying to cross into Spain’s North African enclave of Melilla on Friday, after a violent two-hour skirmish between migrants and border officers that also led to scores of injuries

About 2,000 migrants stormed a high fence that seals off the enclave. This led to clashes with security forces as more than 100 migrants managed to cross from Morocco into Melilla, Moroccan and Spanish authorities said.

Morocco’s Interior Ministry initially said five migrants had died in the border raid, some after falling from the fence surrounding Melilla and others in a crush, and that 76 migrants were injured. It later said another 13 had died.

Some 140 Members of Moroccan security forces were also injured, it added, five seriously, though none of them died.

Over the past decade, Melilla and Ceuta, a second Spanish enclave also on Africa’s northern coast, have become a magnet for mostly sub-Saharan migrants trying to get into Europe.

Friday’s attempt began around 6:40 a.m. in the face of resistance from Moroccan security forces.

At around 8:40 a.m., more than 500 migrants began to enter Melilla, jumping over the roof of a border checkpoint after cutting through fencing with a bolt cutter, the Madrid government’s representative body there said in a statement.

Most were forced back but around 130 men managed to reach the enclave and were being processed at its reception centre for immigrants, it added.

Footage posted on social media showed large groups of African youths walking along roads around the border, celebrating entering Melilla and the firing of what appeared to be tear gas by the authorities.

Spanish authorities said the border incursion led to 57 migrants and 49 Spanish police sustaining injuries.

‘HUMAN TRAFFICKING MAFIAS’

Spanish Prime Minister Pedro Sanchez paid tribute to officers on both side of the border for fighting off “a well-organised, violent assault” which he suggested was organised by “human trafficking mafias”.

He underscored the improvement in relations between Madrid and Rabat. In March, Spain recognised the position of Morocco towards the Western Sahara, a territory the North African nation claims as its own but where an Algeria-backed independence movement is demanding establishment of an autonomous state.

“I would like to thank the extraordinary cooperation we are having with the Kingdom of Morocco which demonstrates the need to have the best of relations,” he said.

AMDH Nador, a Moroccan human rights watchdog, said the incursion came a day after migrants clashed with Moroccan security personnel attempting to clear camps they had set up in a forest near Melilla.

The watchdog’s head, Omar Naji, told Reuters that clash was part of an “intense crackdown” on migrants since Spanish and Moroccan forces resumed joint patrols and reinforced security measures in the area around the enclave.

The incursion was the first significant one since Spain adopted its more pro-Rabat stance over Western Sahara.

In the weeks of 2022 prior to that shift, migrant entries into the two enclaves had more than trebled compared with the same period of 2021.

In mid-2021, as many as 8,000 people swam into Ceuta or clambered over its fence over a couple of days, taking advantage of the apparent lifting of a security net on the Moroccan side of the border following a bilateral diplomatic spat.
