Parkland shooter’s victims face him in court once more before he’s sentenced to life in prison

Anguished survivors of the Parkland school shooting and grieving relatives of victims are facing the gunman in court before he’s sentenced to life in prison, testifying Tuesday about the loved ones and feelings of security he stole from them, and expressing anger over a jury’s decision not to recommend he be put to death.

“You don’t know me, but you tried to kill me,” teacher Stacey Lippel told Nikolas Cruz, who attended court in a red prison jumpsuit, thick eyeglasses and a medical mask. “The person I was at 2:20 (p.m.) on Wednesday, February 14, 2018, is not the same one who stands here today. I am broken and altered, and I will never look at the world the same way again.”

Many of those who took the stand spoke directly to Cruz, including the widow of victim Christopher Hixon, who told the gunman he did not get the justice he deserved: “You were given a gift – a gift of grace and mercy,” Debra Hixon said, “something you did not show to any of your victims.”

After a monthslong trial to decide if Cruz should get the death penalty, a jury recommended he serve a life sentence without the possibility of parole for the shooting at a South Florida high school in which 17 people were killed, sparing his life after his defense attorneys argued he was a disturbed, mentally ill person.

Broward County Circuit Judge Elizabeth Scherer must abide by the jury’s recommendation – three jurors voted against a death sentence, which in Florida must be unanimous – when she sentences Cruz, 24, who pleaded guilty last year to 17 counts of murder and 17 counts of attempted murder in the deadliest mass shooting at an American high school, even as the scourge of gun violence on US campuses continues.

She is expected to issue a formal sentence Wednesday.

David Robinovitz, the grandfather of 14-year-old Alyssa Alhadeff, referred Tuesday to Cruz not by his name but as “Parkland murderer,” saying while the shooter “won for now,” one day he will die.

“At that time, Parkland murderer, it is my hope that you go somewhere to meet your maker,” Robinovitz said. “And, Parkland murderer, I hope your maker sends you directly to hell to burn for the rest of your eternity.”

The older sister of slain 14-year-old Alaina Petty expressed her disappointment with the outcome of the court case that followed the attack.

“He chose to turn to violence,” Meghan Petty said, “and is now being protected from the same punishment he needlessly inflicted on my sister because he’s too scared to receive what he exuberantly dished out.”

Many of the Parkland families already had testified over several days this summer as prosecutors closed their case for the death penalty, describing the depth of the loss they had suffered. But those statements, according to the father of 14-year-old victim Jaime Guttenberg, who was among 14 students killed, did not include everything the families wanted to say because they had to be vetted by attorneys on both sides.

“It wasn’t the extent of how we feel,” Fred Guttenberg told CNN last month after the jury’s decision. “At the sentencing hearing, we will get to say whatever we want, including discussing how we feel now about this verdict.”

On Tuesday, the father of victim Alex Schachter expressed his displeasure with the earlier restrictions put on the families, calling them “very upsetting.”

“We were prohibited from talking about the murderer, the crime and the punishment that he deserves,” Max Schachter said, “(that) we wanted that creature to receive.”

Others went further, attacking not only the outcome of the trial but also the shooter’s appointed public defenders. Eventually, public defender Melisa McNeill objected, reminding the court all defendants are afforded the right to legal representation in the US justice system.

“Attacking defense counsel, attacking the judicial system and attacking the jurors is not permissible,” she said, adding it sends a “message to the community” that if you sit on a jury and render a verdict others don’t agree with, “that you will be chastised and degraded.”

Prosecutors responded by noting victims’ families had been limited on what they could say earlier in the trial, accusing the defense of trying to “curtail” their rights to speak – something McNeill disagreed with.

This second round of victim impact testimony will happen over two days, the Broward County State Attorney’s Office confirmed to CNN in a statement ahead of the hearing. It’s unclear how many of them or victims’ loved ones will take the stand, but no time limits are being imposed, and some people may testify via video conference.

Victim impact statements this week do not need to be shown to the lawyers in advance, the state attorney’s office said.

Because of his plea, Cruz skipped the guilt phase of his trial and instead moved directly to the sentencing phase, in which prosecutors sought a death sentence while Cruz’s appointed public defenders lobbied for life without parole.

To make their decisions, jurors heard prosecutors and defense attorneys argue for several months over aggravating factors and mitigating circumstances – reasons Cruz should or should not be executed.

Prosecutors pointed to seven aggravating factors, including that the killings were especially heinous, atrocious or cruel, as well as cold, calculated and premeditated, backing their case with evidence the gunman spent months meticulously planning the shooting, modifying his AR-15 to improve his marksmanship and accumulating ammunition.

Prosecutors also presented Cruz’s online search history showing how he sought information about past mass shootings, as well as comments he left on YouTube, sharing his express desire to perpetrate a mass killing.

“What one writes,” lead prosecutor Michael Satz said during closing arguments, “what one says, is a window to someone’s soul.”

But defense attorneys said their client should be sentenced to life instead, pointing to a lifetime of struggles that began before he was even born: His biological mother, they said, used drugs and alcohol while pregnant with Cruz, causing a slew of mental and intellectual deficits that stemmed from fetal alcohol spectrum disorder.

Despite his issues – and the educators and school counselors who were concerned about his behavior and poor academic performance – Cruz never got adequate or appropriate intervention, defense attorneys argued. This was in part due to his late adoptive mother who, defense attorney McNeill said, “never truly appreciated” what was wrong with him.

“Sometimes,” McNeill said in her own closing argument, “the people who deserve the least amount of compassion and grace and remorse are the ones who should get it.”

In rendering their decision, the jury unanimously agreed the state had proven the aggravating factors beyond a reasonable doubt – and they were sufficient to warrant a possible death sentence.

Ultimately, however, the jurors did not unanimously agree the aggravating factors outweighed the mitigating circumstances, resulting in a recommendation for life in prison and not death.

Three jurors voted against recommending the death sentence, jury foreman Benjamin Thomas told CNN affiliate WFOR – a decision he disagreed with, noting: “I don’t like how it turned out, but … that’s how the jury system works.”

One of the jurors was a “hard ‘no,’” who couldn’t vote for death because she “didn’t believe, because he was mentally ill, he should get the death penalty,” Thomas said. Two more jurors joined her.

The woman was “not moving” from her stance, juror Melody Vanoy told CNN. “Whether we took 10 hours or five days” to deliberate, “she didn’t feel she was going to be moved either way.”

Vanoy herself voted for life, telling CNN she was persuaded because she “felt that the system failed” Cruz repeatedly throughout his life.

Regardless, the outcome did little for the families who hoped to see Cruz sentenced to death and who, in the hours after the jury’s verdict was read, saw their disappointment turn to anger and confusion as they grappled with the decision.

“I’m disgusted with those jurors,” said Ilan Alhadeff, the father of student victim Alyssa Alhadeff. “I’m disgusted with the system, that you can allow 17 dead and 17 others shot and wounded, and not get the death penalty. What do we have the death penalty for?”

“This shooter did not deserve compassion,” Tony Montalto, father of slain 14-year-old Gina Montalto, said outside the courtroom after the jury’s findings were read.

“Did he show the compassion to Gina when he put the weapon against her chest and chose to pull that trigger, or any of the other three times that he shot her? Was that compassionate?”

Not all the victims relatives felt that way. Before the end of the trial, Robert Schentrup, the brother of victim Carmen Schentrup, told CNN he was against the death penalty – in Cruz’s case and all others.

“Logically,” he said, “it doesn’t follow for me that we say, ‘Murdering someone is this horrible, heinous, awful, terrible thing, and in order to prove that point, we’re going to do it to someone else.’”

Fetterman and Oz face off in Pennsylvania Senate debate on abortion, inflation, crime, more

The highly anticipated Pennsylvania Senate debate on Tuesday night was a fast-paced affair focused on policy questions interspersed with — and sometimes interrupted by — the candidates’ attacks, which have defined a key race for who controls Congress’ evenly split upper chamber.

The faceoff also put Democratic Lt. Gov. John Fetterman’s stroke symptoms back in the spotlight as well as what he said was his resilience and recovery from, as he put it, a notable but not disqualifying challenge.

Many eyes were on Fetterman’s health as he took the stage. He spoke haltingly and sometimes inconsistently throughout the debate, even more so than he has at campaign events since returning to the trail in August, three months after his stroke. At times he seemed to struggle to complete his answers.

Two monitors were hung above the heads of the moderators to transcribe both the questions and Republican Mehmet Oz’s answers in real time as an aid for Fetterman’s auditory processing issues, which outside neurologists have said are no indication of cognitive issues for stroke survivors.

Fetterman has worked with a speech therapist; his doctor said last week he was ready for “full duty” in office, though he has declined to release his medical records.

Several times on Tuesday, but not often, there was a pause before Fetterman answered a question as he read the transcription.

Soon after the debate began, he invoked his stroke and the sometimes-mocking criticism he has faced because of it from his rival’s campaign team.

“Let’s talk about the elephant in the room: I had a stroke. He’s never let me forget that,” Fetterman said in his opening remarks, teeing up a line he would repeat over the course of the hour. “It knocked me down, but I’m going to keep coming back up.”

Oz, a former surgeon and popular TV host who described himself as “a living embodiment of the American dream,” did not mention his opponent’s health on stage.

Both candidates were forced to answer for inconsistent views on policies: For example, each was presented with past comments on fracking that contradicted what they’ve said on the issue on the trail.

“I strongly support fracking,” said Oz when asked about comments he made in 2014 arguing against the industry, which employs thousands of Pennsylvanians but draws scrutiny over its environmental effects.

Fetterman, too, was asked by moderators to square his recent public support for fracking with comments he made in 2018 sharply criticizing it.

“I’ve always supported fracking,” he insisted.

Of the discrepancy, Fetterman said awkwardly: “I do support fracking … I do support fracking.”

He and Oz also tried to take advantage when asked about the issues on which they have hinged their candidacies.

“I want to look into the face of every woman in Pennsylvania,” said Fetterman when the debate shifted to abortion access.

“If you believe that the choice of your reproductive freedom belongs to Dr. Oz, then you have a choice,” Fetterman said, contrasting his views with his opponent, who opposes abortion except in cases of rape, incest or the mother’s health and has said he wants it restricted but not criminalized.

“Roe v. Wade, for me, should be the law,” Fetterman added, referring to the national guarantee to abortion rights that was overturned by the Supreme Court this summer.

Fetterman, however, dodged questions on whether he would support any restrictions on abortion, including in later trimesters.

The moderators continually followed up with Oz on whether he would support South Carolina Sen. Lindsey Graham’s proposal to institute a nationwide ban on abortion, with limited exceptions, after 15 weeks.

Oz, as he has done with reporters, declined to answer yes or no, instead saying he was against federal control of the issue and preferred it be left up to the states — to women, their doctors and local politicians, he said.

“Any bill that violates what I said, which is the federal government interfering with a state rule on abortion, I would vote against,” Oz eventually acknowledged.

On crime, meanwhile — an issue he has leveraged as he has closed his yawning polling gap — Oz touted his endorsements by multiple police unions in the state while Fetterman defended himself against soft-on-crime allegations. He claimed Oz, who said he had a lax record granting parole to convicts, had “no experience” with public safety.

Fetterman said that as a mayor of Braddock, Pennsylvania, he had successfully worked to curb gun violence and had a track record of addressing such problems.

“We should be talking about crime and inflation — the issues that are hurting Pennsylvanians,” said Oz, who at multiple points in the debate touted a plan to “unleash” the state’s energy industry to, as he envisioned, raise wages, bolster businesses and help lower high prices.

Oz cited one example of a woman who could no longer afford her groceries given the rising cost of living — a dismaying problem, he said.

Fetterman, he said, was a “radical” who wouldn’t be budget conscious and would raise taxes. On the other hand, he would promote “balance” in Washington.

“I’m a surgeon, not a politician. We take big problems, we focus on them and we fix them,” Oz said late into the debate. And we do it by uniting, by coming together — not dividing — and by doing that, we get ahead.”

Fetterman said Oz — whom he frequently tried to paint as a liar — wouldn’t have voted for Democrats’ Inflation Reduction Act in Congress, which allows Medicare to negotiate some prescription drug prices, and he invoked Oz’s wealth and relative lack of roots in Pennsylvania. He repeatedly claimed Oz wanted to cut Social Security and Medicare, which Oz said was a baseless allegation. Oz said one of Fetterman’s ads had been pulled for being “dishonest.”

“He has 10 gigantic mansions,” Fetterman said. “We must push back against corporate greed. We must also make sure that we’re also pushing back against price gouging.”

When asked to explain his plan to attack price-gouging corporations, Fetterman did not answer, speaking more broadly about how “inflation is hurting Americans” and how Oz “has never been able to stand up for working families all across America.”

Elsewhere, Fetterman said he supported a law to raise the state minimum wage to $15 an hour, more than double its current rate. Oz said he wanted the minimum wage even higher than that but driven by market forces, not a law, via his plan for the state’s energy companies.

The two candidates split on the value of federal student loan forgiveness – which Fetterman supports — while Oz argued he had a more defined plan for lowering the price of college including offering online instruction.

The campaigns react post-debate

Tuesday was the only event Fetterman agreed to after Oz’s entreaties and criticism — “this is the only debate I could get you to come to talk to me on,” Oz said on stage — and ahead of it, Fetterman’s campaign attempted to lower expectations for his performance, with two top aides telling reporters in a memo on Monday that debating “isn’t John’s format” and citing Oz’s years on television.

In the minutes right after the faceoff ended Tuesday night, his campaign team mobilized to — in their words — tout how he had performed.

“We are thrilled with John’s performance,” spokesman Joe Calvello told reporters.

The campaign announced late Tuesday that it planned to run an ad targeting Oz for one of his answers on abortion access, in which he said policy should be democratically decided by states but more specifically involve “a woman, a doctor and local political leaders.”

The Oz camp, meanwhile, declared victory.

“We saw tonight a debate that was a complete disaster for John Fetterman,” adviser Barney Keller told reporters. “He wasn’t able to defend any of his radical positions, and it really showed.”

Both candidates will be back on the stump Wednesday, with Election Day in less than two weeks and early voting well underway.

Heading into Tuesday, Polls had narrowed considerably, with FiveThirtyEight’s average now showing Fetterman ahead by less than 3 points, down from nearly 11 points six weeks ago.

Elon Musk must close Twitter deal by end of this week or face trial

The clock is ticking for Elon Musk to complete his deal to buy Twitter.

The billionaire Tesla CEO has until 5 p.m. ET on Friday to close his $44 billion acquisition of Twitter or face a trial that was previously delayed to allow both parties to close the deal.

The high-stakes countdown comes after a months-long battle over an acquisition that would put the world’s richest man in charge of one of the world’s most influential social media platforms, with vast potential impacts on the company’s employees, users and for online discourse generally.

Musk in April agreed to buy Twitter

(TWTR) for $54.20 per outstanding share and then, weeks later, sought to terminate the deal. He initially cited concerns over the prevalence of bots on the platform and later added claims from a company whistleblower. Twitter

(TWTR) sued him to follow through with the acquisition.

The two sides had been in the midst of a contentious litigation process preparing for trial to begin on Oct. 17 when Musk told Twitter he wanted to move forward with closing the deal at the originally agreed upon price. The judge overseeing the case, Delaware Chancery Court Chancellor Kathaleen St. Jude McCormick, gave the two sides until Oct. 28 to close the deal or face a November trial.

In the weeks since the litigation was paused, Twitter has appeared to continue to take steps toward closing the deal. Bloomberg last week reported that the company had frozen employees’ stock accounts in anticipation of the deal’s closing, and that lawyers for both Musk and Twitter were preparing paperwork to close the deal. Musk, meanwhile, told Tesla shareholders that he was “excited” about Twitter even as he admitted to “obviously overpaying” for it.

But there have been questions about whether the financing Musk had originally lined up to help fund the deal would come through as expected after he spent months disparaging the company and the overall market, including for social media stocks, has declined. Musk has turned to a mix of debt and equity financing for the deal, in addition to putting up his own money, much of it likely from sales of his Tesla shares.

Some experts have suggested that Musk may need to sell billions of dollars worth of additional Tesla

(TSLA) shares to fund the deal, a move that became easier for the CEO after the company reported quarterly earnings last week – not to mention more costly following a recent decline in the car maker’s share price.

With days to go before the deadline, there have also been some last-minute jitters among Twitter investors and employees.

Twitter shares briefly dipped Friday morning following a Bloomberg report that Biden administration officials were in early discussions about possibly subjecting some of Musk’s ventures to national security reviews, including the planned Twitter takeover.

However, asked by CNN, the administration pushed back on the report, which cited people familiar with the matter. “We do not know of any such conversations,” National Security Council Spokesperson Adrienne Watson said in a statement. Mergers and acquisitions experts have said that while such a review could complicate matters, it likely wouldn’t allow Musk to get out of the acquisition deal.

Separately, Twitter was forced to address concerns among its employees about the fate of their jobs after The Washington Post reported on Thursday that Musk told prospective investors in the deal that he planned to get rid of nearly 75% of the company’s staff. (Representatives for Musk did not respond to a request for comment on the report, which cited internal documents and unnamed people familiar with the matter.)

Following the report, Twitter General Counsel Sean Edgett sent a memo to staff saying the company does “not have any confirmation of the buyer’s plans following close and recommend not following rumors or leaked documents but rather wait for facts from us and the buyer directly,” according to a report from Bloomberg. A Twitter spokesperson confirmed to CNN the authenticity of the memo.

Musk previously discussed dramatically reducing Twitter’s workforce in personal text messages with friends about the deal, which were revealed in court filings, and didn’t dismiss the potential for layoffs in a call with Twitter employees in June.

Despite his reported plans to gut the staff, and his own remarks that he is overpaying for the company, Musk has tried to sound optimistic about Twitter’s potential.

“The long-term potential for Twitter, in my view, is an order of magnitude greater than its current value,” he said on the Tesla conference call last week. He has floated several possible product updates and suggested Twitter will become part of an “everything” app called x, possibly in the style of popular Chinese app WeChat.

But the most immediate change for users, if the deal goes through, could be limiting Twitter’s content moderation and restoring accounts that were previously banned from the platform, most notably that of former President Donald Trump.

U.S. mortgage rates crept up once again this week as demand for home loans tumbled, according to a pair of widely followed reports.

Buyers and sellers are increasingly on edge as the average 30-year fixed mortgage rate — now more than double what it was at the beginning of the year — inches closer to 7%.

Homebuilders, too, are losing confidence in the housing market amid rising rates, which one industry leader calls “unhealthy and unsustainable.”

“High mortgage rates approaching 7% have significantly weakened demand, particularly for first-time and first-generation prospective homebuyers,” Jerry Konter, chairman of the National Association of Home Builders, said this week.

“Policymakers must address this worsening housing affordability crisis.”

30-year fixed-rate mortgages

The average rate on a 30-year fixed mortgage hit 6.94% this week, up from 6.92% a week earlier, mortgage finance giant Freddie Mac reported on Thursday. A year ago at this time, the 30-year rate averaged 3.09%.

While the latest rate increase was more moderate than in previous weeks, borrowing costs are still at a 20-year high and getting worse.

“The 30-year fixed-rate mortgage continues to remain just shy of 7% and is adversely impacting the housing market in the form of declining demand,” says Sam Khater, Freddie Mac’s chief economist.

“Additionally, homebuilder confidence has dropped to half what it was just six months ago and construction, particularly single-family residential construction, continues to slow down.”

15-year fixed-rate mortgages

The rate on a 15-year fixed mortgage is averaging 6.23%, up from 6.09% last week, Freddie Mac says. A year ago at this time, the 15-year rate was averaging 2.33%.

Since then, buyers have lost significant buying power — and many have had to adjust their budgets or put their searches on hold.

Faced with fewer buyers, sellers are no longer able to call all the shots.

“Among recently sold properties that were on the market for more than a month, sellers had to drop prices by 12% on average,” says Nadia Evangelou, senior economist for the National Association of Realtors.

5-year adjustable-rate mortgage

The increasingly popular five-year adjustable-rate mortgage (ARM) averaged 5.71% this week, down from 5.81% a week earlier.

A year ago at this time, these adjustable mortgages averaged 2.54%.

This week’s rate dip is likely to fuel even more demand for the five-year ARM, which comes with a fixed rate for the first five years and then adjusts up or down based on a benchmark like the prime rate.

Buyers have been scooping up adjustable-rate mortgages at a rate not seen since the Great Recession, betting they’ll have an opportunity to refinance into a lower, fixed-rate mortgage before their ARM adjusts.

Mortgage rates could be at a ‘new normal’

Rates have been steadily increasing this year amid actions by the Federal Reserve to tamp down decades-high inflation — despite the pain it’s causing consumers.

Today’s rates could be considered “the new normal,” says Evangelou.

She points out that 7% rates were typical in the mid-to-late 1990s and early 2000s. Yet homeownership then was higher than it is now.

“Today’s potential buyers also have to deal with higher inflation,” Evangelou says. “While inflation outpaces wage growth, the typical family needs to stretch out its budget and spend more than 25% of its income on its mortgage payment.

“Including other expenses such as mortgage insurance, home insurance, taxes and expenses for property maintenance, home buying costs exceed 30% of a typical family’s income.”

Mortgage applications this week

Mortgage applications fell 4.5% week over week, according to the latest report from the Mortgage Bankers Association (MBA).

“The speed and level to which rates have climbed this year have greatly reduced refinance activity and exacerbated existing affordability challenges in the purchase market,” says Joel Kan, the MBA’s vice president and deputy chief economist.

“Residential housing activity ranging from housing starts to home sales have been on downward trends coinciding with the rise in rates.”

Applications to refinance existing loans fell 7% from a week earlier and were 86% lower than last year. The refi share of mortgage activity fell to 28.3%, down from 29% the previous week.

Mortgage applications to purchase homes were down 4% this week — and were 38% lower than the same week a year ago.

“With rates at these high levels, the ARM share rose to 12.8% of all applications, which was the highest share since March 2008,” Kan says.

“ARM loans continue to remain a viable option for borrowers who are still trying to find ways to reduce their monthly payments.”

Yet the intricate snapshot that has stirred up so much conversation and shock on social media didn’t place in the Small World competition.

Instead, Nikon’s first-place winner, Grigorii Timin and Dr. Michel Milinkovitch of the University of Geneva, presented a detailed photo of the embryonic hand of a Madagascar giant day gecko — showing the complete internal structure in vibrant color.

“Masterfully blending imaging technology and artistic creativity, Timin utilized high-resolution microscopy and image-stitching to capture this species of Phelsuma grandis day gecko,” Nikon said in a press release.

“[With] a visually stunning and painstaking technique, Timin used image-stitching to merge hundreds of images together to create the final image of his gecko.”

Timin commented, “This particular image is beautiful and informative, as an overview and also when you magnify it in a certain region, shedding light on how the structures are organized on a cellular level,” according to the news release.

Nikon competition reveals ant’s horrifying face up close

It’s not a good look.

A startling photograph of an ant’s face magnified five times under a microscope is swarming social media — though it barely merited a mention in the Nikon Small World Photomicrography Competition.

Lithuanian wildlife photographer Dr. Eugenijus Kavaliauskas submitted “Ant (Camponotus),” which gives a nightmarish perspective of the beady-eyed everyday pest with a ferocious snarl and flame-like whiskers.

Previously a noted photographer of birds of prey, Kavaliauskas recently switched his focus to insects, according to his portfolio.

This year marked the 48th iteration of the annual Nikon competition, which zeroes in on microscope photography that reveals details otherwise invisible to the human eye. Kavaliauskas’ photo didn’t make it to the Top 20 and Honorable Mentions categories, but was included as one of 57 “Images of Distinction.”

Speaking to Insider this week, Kavaliauskas said he appreciated how microphotography allows him to find newer and more interesting aspects to his subjects.

“I’m always looking for details, shadows, and unseen corners. The main goal of photography is to be a discoverer,” he said. “I am fascinated by the Creator’s masterpieces and the opportunity to see God’s designs.”

When asked about the ant’s startling visage, Kavaliauskas replied“there are no horrors in nature.”

Not everyone agrees.

USC film professor Rebekah McKendry ignited a small firestorm when she shared Kavaliauskas’ image on Twitter Monday.

“Image from a horror movie?” McKendry captioned the photograph. “Nope. That’s the very real face of an ant.”

“Now you have to think about that all night,” she joked.

Commenters quickly chimed in with their own reactions.

“Why would you do this to me,” one demanded.

“And now I have 12-15 hours to get that image out of my head,” another replied.

Some were able to make light of their terror, with one person writing “Just wait till Disney’s photorealistic remake of A Bug’s Life.”

Even Kavaliauskas admitted he was once spooked by all he saw under the microscope.

“When I first started with microphotography, I, too, thought all beetles looked a little like monsters,” he told Insider. “But now, I’ve gotten used to it, and am surprised that there are so many interesting, beautiful, and unknown miracles under our feet.” 

In addition to some viral clout, Kavaliauskas walked away from the competition with one Nikon item with a $35 retail value. Out of 1,300 submissions, the top prize– including a $3,000 cash reward– went to “Embryonic hand of a Madagascar giant day gecko (Phelsuma grandis)” by Grigorii Timin and Michel Milinkovitch.

“This particular image is beautiful and informative, as an overview and also when you magnify it in a certain region, shedding light on how the structures are organized on a cellular level,” Timin said in a Nikon press statement.

The 2023 Small World Photomicrography Competition is already open for submissions, which are welcomed from anyone interested in photography and microscopy. There is also a video portion, titled the Small World In Motion.

Kavaliauskas did not immediately respond to The Post’s request for a comment.

SAN DIEGO — Amongst a sea of yellow at raucous Petco Park stood A.J. and Stacie Nola, not quite sure how to react when their eldest son, Austin, sparked a five-run rally against his younger brother, Aaron.

Earlier in Game 2 of the National League Championship Series between the Phillies and Padres, the Nolas became the first pitcher/batter brother combination to square off in MLB postseason history.

While Round 1 went to Aaron in the second inning, Austin got his revenge with a run-scoring single on an 0-2 count in the fifth. The hit cut the Padres’ deficit to 4-3 before Austin scored on Juan Soto’s game-tying double. San Diego would go on to win, 8-5, on Wednesday and even the NLCS at one game apiece.

“It was the best and worst inning of my life,” A.J. told MLB.com. He anxiously stood as Aaron made three pickoff attempts, then settled into his seat as a FOX camera captured his reactions.

In their first at-bat against each other, Austin, 32, took a first-pitch cutter for a strike from Philadelphia’s 29-year-old right-hander before he chopped a sinker to third for an inning-ending groundout in the second. Earlier in the frame, Aaron had served up homers on consecutive pitches as San Diego trimmed its deficit to 4-2.

With his name being chanted throughout the ballpark in the fifth, Austin took advantage of Aaron’s elevated two-strike sinker and lined it to right-center for a one-out RBI single as Ha-Seong Kim scored from first on the play. Though Aaron didn’t think the brotherly matchup changed the game, the floodgates soon opened, as he was pulled three batters later with the score tied at 4.

When that happened, Stacie told her husband to switch jerseys; for Aaron’s starts, A.J. wears his Phillies jersey on top of his Padres one.

“I wish I could have taken a snapshot and just held the moment for like a day, because that’s how fun it is,” Austin said. “And I’m sure he would say the same thing, that like stepping in the box against your brother in a situation, just facing [off] in a big league game is enough to just hold the moment. I was like, ‘I wish I could press pause on the time button and just live it for much longer than what it does,’ because it happens really quick.”

In two previous games between the Nolas, Austin collected one hit in six plate appearances, with a walk and two strikeouts. That lone hit — an RBI single on June 24 — was the decisive knock in a 1-0 San Diego victory. It made Austin the first player in the Modern Era (since 1900) to log a game-winning hit off his brother that was the sole RBI of the game.

The emotions were the same Wednesday as they were then. Minutes before first pitch, Stacie and A.J. tried to contain their nerves and anxiety from their seats along the first-base line. Austin, whose Padres were the home team, left them tickets with his wife and two kids. Aaron’s fiancée and her family sat in the Phillies section. 

“For both of them, when they get up when the game starts, they’re not brothers,” said Stacie, who wore a neutral blue outfit. “Both of their mindsets, they’re not brothers. Just another Padre, just another Phillie.”

Aaron entered Wednesday with 12 2/3 scoreless innings in the postseason. Austin, who has caught every inning this postseason, is now batting .321 with five RBIs.

“It’s the same as it was the first time we played against each other,” Aaron said. “We’re trying to win, they’re trying to win. That’s what it comes down to. He’s swinging the bat pretty well right now. He’s balanced up there, and just try to make pitches to him.”

Both siblings consider themselves the ultimate competitors, so there’s no empathy with the result because of what’s at stake. There will be time to reflect on the history they made over the offseason. After all, there’s a trip to the World Series on the line. If the NLCS heads back to Southern California, Aaron will be lined up for Game 6 on Monday.

“It’s special for sure,” Austin said. “I’ll always remember it. He’ll always remember it. My family will always remember it. I’m sure we’ll be talking about this 20 years from now when we’re all sitting [at] Christmas time talking about these moments, right? That’s what it’s all about.”

In a #MeToo moment, Hollywood figures face season of trials

NEW YORK (AP) — The #MeToo movement is having another moment in the spotlight as high-profile sexual assault trials play out in courtrooms from coast to coast.

Five years after allegations against movie mogul Harvey Weinstein triggered a wave of sexual misconduct claims in Hollywood and beyond, he and “That ’70s Show” actor Danny Masterson are fighting criminal rape charges at trials down the hall from each other in Los Angeles.

In New York, trials are underway in sexual assault lawsuits against actor Kevin Spacey and screenwriter-director Paul Haggis, both Oscar winners. Spacey’s defense rested Wednesday while lawyers for Haggis and his accuser gave opening statements in an adjacent courthouse. All of the men deny the allegations.

A forcible touching case against another Academy Award winner, actor Cuba Gooding Jr., wrapped up in New York last week with a guilty plea to a non-criminal harassment violation and no jail time, to the dismay of at least some of his accusers.

The confluence is a coincidence, but a striking one, amid a cultural movement that has demanded visibility and accountability.

“We’re still very early on in this time of reckoning,” said Debra Katz, a Washington-based lawyer who has represented many sexual assault accusers. She isn’t involved in the Haggis, Masterson, Spacey or Weinstein trials.

Besides their #MeToo reverberations, both Haggis’ case and Masterson’s have become forums for scrutinizing the Church of Scientology, though from different perspectives.

In the case against Haggis, publicist Haleigh Breest claims that the “Crash” and “Million Dollar Baby” screenwriter forced her to perform oral sex and raped her after she reluctantly agreed to a drink in his Manhattan apartment after a 2013 movie premiere. She’s seeking unspecified damages.

She didn’t go public until after the allegations against Weinstein burst into view in 2017 and Haggis condemned him.

“The hypocrisy of it made her blood boil,” lawyer Zoe Salzman said in her opening statement.

Jurors will also hear from four other women who told Breest’s lawyers that Haggis sexually assaulted them, or attempted to do so, in separate encounters. One of them testified Wednesday, via videotaped questioning, that Haggis raped her during an after-hours meeting in her office in 1996, when both worked on a Canadian TV show.

The jury won’t hear, however, that Italian authorities this summer investigated a sexual assault allegation against Haggis, which he denied.

Haggis maintains that his encounter with Breest was consensual, and defense attorney Priya Chaudhry noted that the other women who are set to testify never took legal action of their own against him.

“Paul Haggis is relieved that he finally gets his day in court,” Chaudhry told jurors.

Both sides pointed to what Breest texted to a friend the day after the alleged attack.

Her lawyer emphasized that Breest wrote that “he was so rough and aggressive. Never, ever again … And I kept saying no.” Haggis’ attorney, meanwhile, said Breest added “lol” — common texting shorthand for laughter — when she mentioned performing oral sex, and that she told the friend she wanted to be alone with Haggis again to “see what happens.”

Chaudhry argued that Breest falsely claimed rape to angle for a payout. But the attorney also suggested another explanation for the allegations.

Promising “circumstantial evidence,” she suggested that Scientologists ginned up Breest’s lawsuit to discredit him after he became a prominent detractor.

The church denies any involvement, and Breest’s lawyers have called the notion a baseless conspiracy theory.

“Scientology has nothing to do with this case” or with any of Haggis’ accusers, she told jurors. The church has said the same.

Scientology is a system of beliefs, teachings and rituals focused on spiritual betterment. Science fiction and fantasy author L. Ron Hubbard’s 1950 book “Dianetics: The Modern Science of Mental Health” is a foundational text.

The religion has gained a following among such celebrities as Tom Cruise, John Travolta and Kirstie Alley. But some high-profile members have broken with it, including Haggis, singer Lisa Marie Presley and actor Leah Remini. In a memoir and documentary series, Remini said the church uses manipulative and abusive tactics to indoctrinate followers into putting its goals above all else, and she maintained that it worked to discredit critics who spoke out.

The church has vociferously disputed the claims.

Haggis says he was a Scientologist for three decades before leaving the church in 2009. He slammed it as “a cult” in a 2011 New Yorker article that later informed a book and an HBO documentary, and he foreshadowed that retribution would come in the form of “a scandal that looks like it has nothing to do with the church.”

The church, which didn’t respond to a request for comment this week, has repeatedly said Haggis lied about its practices to get attention for himself and his career.

Masterson’s lawyer, meanwhile, is asking jurors to disregard the actor’s affiliation with Scientology, though prosecutors say the church discouraged two of his three accusers from going to authorities. All three are former members.

Closing arguments are scheduled for Thursday in a $40 million lawsuit brought by actor Anthony Rapp who says Spacey made a sexual pass at him in 1986, when Rapp was 14 and Spacey was 26. Spacey denies the encounter ever happened.

Weinstein is facing his second criminal trial, this time set in L.A. and involving five women and multiple rape and sexual assault charges. He is already serving a 23-year prison sentence on a rape and sex assault conviction involving two women in New York.

The Associated Press does not usually name people alleging sexual assault unless they come forward publicly, as Breest and Rapp have done.
