Far-right MK says doctors could deny treatment on religious grounds, sparking uproar

Religious Zionism lawmaker Orit Strock, who is set to be a minister in the new Israeli government, said on Sunday that doctors should be allowed to refuse to provide treatments that contravene their religious faith, as long as another doctor is willing to provide the same treatment.

Strock’s comments were denounced as racist and discriminatory by numerous politicians from the outgoing coalition, while incoming prime minister Benjamin Netanyahu distanced himself from her position. Netanyahu also denied that his coalition would allow a law to this effect to pass, although nascent coalition agreements reportedly state that the current law against such discrimination will be amended.

Chair of the Israel Medical Association Prof. Zion Hagay insisted that doctors in Israel would defy any attempt to allow the use of discriminatory practices in the treatment of patients.

“If a doctor is asked to give any type of treatment to someone that violates his religious faith, if there is another doctor who can do it then you can’t force them to provide treatment,” Strock told Kan public radio.

“Anti-discrimination laws are just and right when they create a just, equal, open and inclusive society,” said Strock, who is slated to become the minister for National Projects in the new government, with authority over the Department of Jewish Culture — hitherto part of the Education Ministry. “But there is a certain deviation in which religious faith is trampled upon and we want to amend this.”

Strock was speaking with regard to treatments where a doctor may have some religious objection, such as fertility treatment for unmarried women, within the general context of her party’s proposed legislation to allow businesses or private enterprises to refuse service on the grounds of religious conscience.

According to the Kan state broadcaster, a clause in the coalition agreement between Likud and Religious Zionism stipulates that legislation will be passed by the new government to allow business owners to refuse service to customers if doing so violates their religious beliefs.

Netanyahu denied, however, that the coalition deal provided for such a law.

“MK Orit Strock’s words are unacceptable to me and my colleagues in Likud. The coalition agreements do not allow for discrimination against LGBT people or for harming the right of any citizen in Israel to receive service. Likud will guarantee that there will be no harm to LGBT people or any Israeli citizen,” Netanyahu said in a statement.

Despite Netanyahu’s denial, Kan journalist Michael Shemesh tweeted an image of the clause in question of the coalition agreement, which states that the law against discrimination will be amended “in a way that will prevent injury to a private business which refrains from providing service or a product due to religious faith, on condition that it is a service or product which is not unique and for which an alternative can be found nearby and for a similar price.”

According to Kan, the clause appears in every coalition agreement between the Likud and the other parties of the incoming government, although only the deal between Likud and Agudat Yisrael, one half of the United Torah Judaism faction, has been formally signed so far.

The law as it stands forbids discrimination by those providing public services or products on the basis of race, religion, gender, sexual orientation, and other similar considerations, and anyone doing so is liable to be fined.

According to Strock, the legislation she and Religious Zionism are advancing would allow such providers to refuse service if it they feel it violates their religious faith, as long as there is another similar service within reasonable geographic range.

Strock gave by way of example a situation in which a Christian wanted to hold a Christmas party with a Christmas tree in a venue owned by a religious Jew.

“I assume an observant Jewish person won’t want to do this because it contravenes his religious faith… Jews gave up their lives to not do such things throughout history. The law must not treat Jewish law as something of lesser value,” she said.

“The State of Israel is the state of the Jewish people, a people that gave up its life for its religious faith. It is unacceptable that, having established a country after 2,000 years of exile and of laying down their lives for the Torah, this country will call religious faith ‘discrimination.’”

Backing up Strock, fellow Religious Zionism MK Simcha Rothman made similar comments on Sunday, asserting that if a hotel wanted to refuse service to gay people on religious grounds it would be entitled to do so.

“A business owner can do whatever they like in his business. He created the business and he doesn’t owe anyone anything,” Rothman told Kan.

“The law states that a business cannot discriminate for a whole variety of reasons. This bill [proposed by his party] seeks not to abolish the general prohibition on discrimination but says that when there is a religious obstacle for someone to do something, it will be permissible for him to withhold service — rather than force him to do something that contravenes his beliefs,” said Rothman.

Asked if it would be permissible for a Jew to refuse service to Arabs on the basis that he believed Arabs should not live in the Land of Israel, Rothman declined to answer. He also refused to say what mechanism would be put into place to define whether or not refusal of service was based on a legitimate religious belief.

Strock’s and Rothman’s comments were castigated by numerous members of the incoming opposition and described as racist, homophobic and discriminatory.

Outgoing Prime Minister Yair Lapid denounced Strock’s remarks and blamed Netanyahu for the rise of such sentiments, saying he was “leading us to a benighted state [ruled by] Jewish law.”

Labor MK Gilad Kariv tweeted, “We should not be surprised by Orit Struck’s racist comments. It is her life’s teaching. We should be outraged by the equanimity of Likud MKs in light of these disgraceful and dangerous comments.”

Yesh Atid MK Ram Ben Barak said he did not believe Netanyahu’s denials and warned that the country was moving in a direction that would allow for widespread discrimination.

“We have lived through periods in which there were signs saying ‘no entry to Jews,’ and now we see these laws that state that business owners can decide whom they want to sell to. There will be grocery stores that will say ‘no entry to women’ and tomorrow there will be another that says ‘no entry to Arabs,” Ben Barak predicted.

Hagay, chairman of the Israel Medical Association, insisted that “doctors in Israel are committed to the doctor’s oath and will not allow any person or any law to change this fact,” in response to Strock’s comments.

“We will not allow foreign or political considerations to be introduced between doctors and patients. The health system has always been an island of sanity, a symbol of coexistence, a place in which Jews and Arabs work shoulder to shoulder, with the value of equality a guiding light for them,” tweeted Hagay.

“The Hebrew doctor’s oath says explicitly, ‘You shall help a sick person since they are sick, be they a foreigner or a non-Jew, and be they a citizen, despicable or honorable.’ And in Maimonides’ doctors’ prayer it is written ‘I will only see the human in a sick person.’ That is how it always was and how it will be forever.”

The chair of the Association for LGBTQ Equality in Israel, Hila Peer, also condemned the remarks, describing them and the proposed law as “un-Jewish” and disgraceful.

“MKs Strock and Rothman want to mark out LGBT people so that we’ll remain in our homes as in the dark days of humanity. We will not agree to this in any way,” said Peer, calling on Netanyahu to oppose such legislation.

Responding to the criticism, Struck said, “No one intends to discriminate against LGBT people because of their identity or what they identify with. Not in medical treatment, or any other manner. LGBT people are human beings deserving of respect and love like anyone else.”

She insisted, however, that if there was “medical treatment that contravenes Jewish law, a religiously observant doctor will not be forced to give it, regardless of the identity of the patient.”

Justice Dept. asks Supreme Court to deny Trump’s Mar-a-Lago appeal

The Justice Department asked the Supreme Court on Tuesday to deny a petition from Donald Trump’s attorneys in the Mar-a-Lago search case, arguing that allowing an outside arbiter to review the classified documents seized from Trump’s residence would “irreparably injure” the government and that as former president he has no “plausible” claims of ownership over sensitive government materials.

It’s the latest turn in the department’s high-stakes investigation to determine whether the former president or his advisers mishandled national security secrets, or hid or destroyed government records. Prosecutors have accused Trump’s team of failing to turn over highly sensitive government documents when asked, and over the summer took the extraordinary step of executing a search warrant at his home and private club in South Florida.

Trump has said he is being treated unfairly by the Justice Department. Last week his legal team made a technical and narrow petition to the Supreme Court, asking the justices to reconsider a portion of an appeals court ruling that granted the Justice Department’s request to keep the classified documents separate from a review of seized material being conducted by the outside expert, known as a special master.

FBI agents seized more than 11,000 documents from Trump’s Florida residence and private club, including 103 with a variety of classification markings. The Washington Post has reported previously that authorities recovered one document that described a foreign government’s military defenses, including its nuclear capabilities.

The former president’s lawyers have argued that the appeals court lacked authority to prohibit the special master from reviewing the classified material. They asked the Supreme Court to allow the outside expert to examine those sensitive government documents.

The status of key investigations involving Donald Trump

The government’s response said Trump’s emergency request should fail because he has not shown how he would be harmed without the Supreme Court’s intervention or that the appeals court order was wrong.

“Because applicant has no plausible claims of ownership of or privilege in the documents bearing classification markings, he will suffer no harm at all from a temporary stay of the special master’s review of those materials while the government’s appeal proceeds,” wrote Solicitor General Elizabeth B. Prelogar in Tuesday’s response to the Supreme Court. “And applicant further undermined any claim that he is suffering irreparable injury from the stay by opposing the government’s motion to expedite the underlying appeal and urging that oral argument be deferred until ‘January 2023 or later.’ ”

In its September ruling, the U.S. Court of Appeals for the 11th Circuit also said the Justice Department could immediately resume using the classified documents in its criminal investigation — something a lower court had prohibited until the special master completed his review. While Trump’s lawyers requested that the Supreme Court allow the classified documents to be reviewed, they did not ask the justices to prohibit the government from using those materials in its criminal probe.

The Justice Department on Tuesday pushed back against the Trump lawyers’ arguments that the appeals court lacked jurisdiction to say what the special master could review, saying the panel of judges had authority to review the entire ruling appointing a special master, not just portions of it.

Trump and the Mar-a-Lago documents: A timeline

Prelogar noted that “the government believes the district court fundamentally erred in appointing a special master and granting injunctive relief at all,” and is appealing the Sept. 5 order . The Justice Department is expected to submit its appeal Friday.

When Trump first called for the appointment of a special master in late August, his lawyers argued that he has retained some executive privileges since leaving office, which the Justice Department has argued a former president can no longer assert. In Tuesday’s filing, the solicitor general noted that Trump’s lawyers have “abandoned” that argument in recent filings, suggesting that the former president’s attorneys realize he cannot invoke that privilege.

“In any event, any such invocation would necessarily yield to the government’s ‘demonstrated, specific need for evidence’ in its criminal investigation concerning the wrongful retention of those very documents and obstruction of its efforts to recover them,” the filing reads.

Elsewhere in its 32-page filing, the Justice Department traces the history of the criminal probe into the possible mishandling of government documents at Mar-a-Lago, accusing Trump’s team of likely obstructing the investigation after a grand jury issued a subpoena in May requesting “[a]ny and all documents or writings in the custody or control of Donald J. Trump.”

“The FBI uncovered evidence that the response to the grand jury subpoena was incomplete, that additional classified documents likely remained at Mar-a-Lago, and that efforts had likely been undertaken to obstruct the investigation,” the filing says.

In response, investigators went to a judge to authorize a search warrant, which FBI agents executed at Mar-a-Lago on Aug. 8.

Trump has chosen a third of the Supreme Court’s nine justices, a body that has moved to the right on issues dear to conservatives, such as abortion, gun rights and religion. But the court has been a disappointment to the former president on issues that pertain to him personally.

The Supreme Court in July 2020 flatly rejected Trump’s bold claims of immunity from local law enforcement and congressional investigators. It turned aside multiple challenges to the 2020 election results brought by Trump and his allies. And post-presidency, the court turned down his request to keep certain White House documents from the congressional committee investigating the January 2021 riot at the U.S. Capitol, with only Justice Clarence Thomas indicating he would support Trump’s plea.

Harry Styles and Chris Pine deny ‘spitting’ rumour sparked by viral video from Don’t Worry Darling premiere

Representatives for Don’t Worry Darling star Chris Pine have said claims that his co-star Harry Styles “spat” on him at the Venice Film Festival are a “complete fabrication”.

On Monday 5 September, a brief yet puzzling interaction between the pair at the Venice Film Festivalwent viral on social media.

Styles and Pine were at the Venice screening of Don’t Worry Darling with co-stars including lead actor Florence Pugh and director Olivia Wilde when the moment was captured on video.

In the clip, posted by Twitter user JZMaclin, it was claimed that Styles “appears to spit” on Pine while taking his assigned seat next to the actor, who then looks down at his lap and stops clapping.

By Tuesday 6 September, the clip had received over 5.5 million views, with many fans claiming Styles “definitely did” spit on his co-actor.

Other viewers dismissed the “spitting” claim and said it was more likely that the pair were joking around.

Pine’s representative has now issued a statement to People,commenting: “This is a ridiculous story – a complete fabrication and the result of an odd online illusion that is clearly deceiving and allows for foolish speculation.”

They added: “Just to be clear, Harry Styles did not spit on Chris Pine. There is nothing but respect between these two men and any suggestion otherwise is a blatant attempt to create drama that simply does not exist.”

A source close to Styles also told The Independent that the alleged incident was “not true”.

The speculation surrounding the clip was likely fuelled by the controversies that have mired the press run for Don’t Worry Darling, including a dispute over the nature of actor Shia LaBeouf leaving the project, later being replaced by Styles.

Ahead of the film’s release, Wilde claimed she fired LaBeouf, who was initially cast opposite Pugh, in 2020 in order to create a “safe, trusting environment” on set, saying that his acting process “was not conducive to the ethos” that she demands in her productions.

However, LaBeouf, who is currently awaiting trial after being sued for “relentless abuse” by his former partner, the British musician FKA twigs, denied being fired. He sent Variety a video he claimed to have received from Wilde, which shows her asking him not to quit the project.

Shortly after the Venice Film Festival press conference for Don’t Worry Darling, Alex Ritman confirmed that he “just tried to ask Olivia Wilde a question about Shia LaBeouf” at the conference but “the festival wouldn’t let me”.

The festival organisers apparently suggested Ritman’s question had already “been answered” as part of Wilde’s comments on the alleged feud with Pugh, who skipped the press conference.

News that Pugh would not be attending the panel came amid reports of a feud between herself and Wilde that have been ongoing since earlier this year.

The Midsommar actor, 26, walked the red carpet for the film’s premiere, as it was reported that she would.

Sources close to Harry Styles have denied the singer and actor spat on co-star Chris Pine at the premiere of their film, Don’t Worry Darling, at the Venice film festival on Monday.

Speculation dominated sections of the internet overnight and through Tuesday after video footage emerged which appeared to show Styles depositing spittle into Pine’s lap as he took his seat for the world premiere.

“This is not true,” said sources close to Styles on Tuesday. Pine’s rep later released a statement saying: “This is a ridiculous story — a complete fabrication and the result of an odd online illusion that is clearly deceiving and allows for foolish speculation. There is nothing but respect between these two men and any suggestion otherwise is a blatant attempt to create drama that simply does not exist.”

The suggestion of such behaviour was fuelled by what appears to have been a tense press push for the film so far. Pine appeared disengaged at Monday’s press conference, during which Olivia Wilde, the film’s director, sought to downplay rumours of a rift between her and the film’s star, Florence Pugh.

Pugh did not appear at the press conference, but did show up for the premiere, at which she appeared to consciously avoid eye contact with Wilde.

A later question during the press conference about the departure of Shia LaBeouf from the film was shut down before Wilde had the chance to reply.

Don’t Worry Darling is a thriller set in a seemingly perfect US suburb. Styles and Pugh play a couple whose marriage comes under strain when Pugh’s character uncovers a secret about a neighbour’s disappearance.

Reviews of the film have been broadly unfavourable, with critics praising Pugh but suggesting Styles’s acting prowess may be lacking.

“I have no idea what I’m doing,” said Styles at Monday’s press conference.
