Fact check: Trump lawyers make multiple false claims in impeachment defense

Arguing that Trump did nothing to incite the insurrection at the US Capitol on January 6, the lawyers distorted the facts about both what happened that day and what happened in the past.

Trump lawyer Michael van der Veen highlighted comments from Democrats that he suggested had promoted or defended violence. Trump, he argued, is different than these Democrats.

“Contrast the President’s repeated condemnations of violence with the rhetoric from his opponents,” van der Veen said. He then played a video that juxtaposed clips of Trump condemning violence, and calling himself an “ally of all peaceful protesters,” with some selectively edited clips of Democrats.

Facts First: This argument and video were misleading by omission. Trump has indeed condemned violence and called for peaceful protest, but he has also repeatedly applauded or defended violence and aggressive behavior.

Among other things, Trump has done the following since he launched his presidential campaign in 2015: praised a Republican congressman for assaulting a journalist; urged police officers not to worry about injuring the heads of suspects they are arresting; said he would like to punch a protester in the face; urged supporters to “knock the crap out of” any protester they saw holding a tomato; said a kidnapping plot against Michigan Democratic Gov. Gretchen Whitmer might not be an actual “problem”; approvingly told a fake story about an early 20th century US general who massacred Muslim terrorists with bullets dipped in the blood of pigs; said it was a “beautiful sight” when the authorities tossed a journalist to the ground during unrest in Minneapolis; mocked a reporter who got shot with a rubber bullet; and applauded the Trump supporters who surrounded a Joe Biden campaign bus on the highway, an incident that prompted an FBI investigation.

Trump’s lawyer falsely claims Trump’s first two tweets during the Capitol attack urged calm

Van der Veen claimed that “the first two messages the President sent via Twitter once the incursion of the Capitol began” urged people to “stay peaceful” and called for “no violence.”

Facts First: This is not true.

Trump’s “stay peaceful” tweet at 2:38 p.m. and “no violence” tweet at 3:13 p.m. were his second and third tweeted messages after the Capitol was breached, not his first. Trump’s first tweet was at 2:24 p.m.: “Mike Pence didn’t have the courage to do what should have been done to protect our Country and our Constitution, giving States a chance to certify a corrected set of facts, not the fraudulent or inaccurate ones which they were asked to previously certify. USA demands the truth!”

Rioters had already entered the US Capitol building by the time of the Trump tweet about Pence.

No, the media wasn’t lying that there was hacking during the 2016 election

Van der Veen claimed that Washington officials other than Trump are the ones who used reckless and inflammatory rhetoric. He claimed: “The entire Democratic Party and national news media spent the last four years repeating without any evidence that the 2016 election had been hacked.”

Facts First: The Democratic National Committee and the Hillary Clinton campaign were indeed hacked during the 2016 election campaign; this is a fact, not a claim made “without any evidence.” The US intelligence community, special counsel Robert Mueller and the bipartisan Senate Intelligence Committee all concluded that the Russian government was responsible for stealing and leaking internal documents and emails.

If van der Veen was suggesting that the “entire Democratic Party and national media” spent four years falsely alleging that hackers altered actual votes or vote totals in the 2016 election, that would not be true either. We can’t speak for every word uttered by every Democrat or every journalist since 2016, but it is clearly inaccurate to say that the entire party or entire media spent four years pushing such a claim. The national discussion about hacking during the 2016 election focused on the actual, confirmed hacking that targeted the Democrats’ computer systems.

Eliza Dushku on Joss Whedon: Backs ‘powerful’ abuse claims

Charisma Carpenter has another high-profile co-star in her corner.

“Bring It On” star Eliza Dushku is the latest “Buffy the Vampire Slayer” alum to voice her support for Carpenter, 50, who alleged on Wednesday that “Buffy” creator, Joss Whedon, 56, “abused his power” and fostered an “increasingly volatile work environment.” 

“CC, my heart aches for you and I’m so sorry you have held this for so long,” Dushku, who is no stranger to workplace harassment battles, wrote on Instagram. “Your post was powerful, painful, and painted a picture we’ll collectively never un-see or un-know.”

Dushku played rogue vampire slayer Faith opposite Carpenter’s Cordelia Chase on both “Buffy” and its spinoff, “Angel.” She joins an increasing list of “Buffy” vets — including Sarah Michelle Gellar, Michelle Trachtenberg, Amber Benson and Emma Caulfield — to voice support on social media, telling Carpenter: “I admire, respect, and love you.”

The 40-year-old “Tru Calling” and “Dollhouse” actress has previously experienced toxic workplaces. In 2018, Dushku alleged that “True Lies” stunt coordinator Joel Kramer sexually abused her when she was 12 years old.

Then came the bombshell report that same year revealing Dushku was secretly paid $9.5 million by CBS in 2018 for claims she was retaliated against and written off “Bull” after complaining about alleged sexual harassment by lead Michael Weatherly on set.

“I frequently think of the saying, ‘we are as sick as our secrets,’” Dushku continued in her post. “Our secrets indeed make and keep us sick. What I’m learning more and more — and have personally found most valuable — is that profound healing can only come from naming and disclosing what actually happened, the necessary first step (once someone’s ready) to freeing ourselves from our secrets, untold truths which have kept us isolated, ashamed, and held hostage.”

Carpenter cited Ray Fisher’s unceremonious firing as Cyborg from the forthcoming “The Flash” flick as the catalyst for her coming out against Whedon. The “Justice League” actor had accused his director of being “gross, abusive, unprofessional and completely unacceptable” to him and others on the set of the Warner Bros. superhero film. The 33-year-old actor retweeted Carpenter’s emotional post and called her “one of the bravest people I know.” 

Carpenter and Fisher’s claims add to Trachtenberg’s allegations of “not appropriate behavior” by Whedon toward the then-teenager on the set of “Buffy,” and that “there was a rule saying he’s not allowed in a room alone” with her again.

Reps for Whedon — who “parted ways” with HBO’s “The Nevers” in November — have not responded to The Post’s requests for comment.

Buffy Aluim Eliza Dushku Posts Support For Charisma Carpenter’s Claims Against Joss Whedon – Deadline

Yet another veteran of Buffy the Vampire Slayer has publicly offered support for Charisma Carpenter after her allegations yesterday of abuse and “misconduct” by Joss Whedon on the supernatural series.

Like Carpenter herself, Sarah Michelle Gellar, Michelle Trachtenberg and Amber Benson, Eliza Dushku took to social media today to tell her co-star “I admire, respect, and love you.” In her Instagram post, the actress who played Faith on Buffy and its Angel spinoff said that she found Carpenter’s tale of Whedon’s “casually cruel” conduct to be “powerful, painful, and painted a picture we’ll never collectively never un-see or un-know” – as you can see below.

CAA and other reps for Avengers director Whedon have said nothing about the claims by both Carpenter and Trachtenberg, who damningly alleged Wednesday of “not appropriate behavior” by the Buffy creator towards her when she was a “teenager” on the 1998 – 2003 running series.

Unlike her co-stars, the ICM Partners repped Dushku had a post Buffy professional relationship with Whedon on the shuddersome Dollhouse, which ran on Fox for two seasons starting in 2009.

While having said nothing about wrongdoing by Whedon herself, Dushku made allegations of sexual abuse by True Lies stunt coordinator Joel Krammer in 1994, when the actress was 12 years old. Accused of similar impropriety by others, the former stunt double to Arnold Schwarzenegger denied the claims that Dushku made in 2018. Later that same year, after Les Moonves had been booted from his CBS perch, it was revealed that Dushku was secretly paid $9.5 million in early 2018 over claims she was retaliated against and written off Bull for complaining about sexual harassment by lead Michael Weatherly on the set of the prime time drama.

“It’s time for us to …say, “No, we’re going to stand in our truth, we’re going to stand in our power,’” Dushku told me in a 2019 interview with Deadline.

Carpenter and Trachtenberg’s claims, plus Benson’s tweet of a “toxic environment” at Buffy, follows months and months of allegations from Justice League actor Ray Fisher of Whedon being “gross, abusive, unprofessional and completely unacceptable” to him and others on the set of the Warner Bros superhero flick. That situation apparently came to a sputtering end on December 11 when the AT&T-owned studio put out a statement cryptically asserting their “investigation into the Justice League movie has concluded and remedial action has been taken.”

WarnerMedia never revealed what that action was, but soon afterwards, as he made more accusations of enabling against DC Entertainment president Walter Hamada and his predecessor Geoff Johns, Fisher was canned last month from a role as Cyborg in the forthcoming Flash movie.

Fisher tweeted his own POV on Carpenter, who had participated in the WB Justice League probe, earlier today:

The actor will appear in original Justice League director Zack Snyder’s cut of the 2017 film due to debut on HBO Max on March 18.

For Whedon, the producer was shown the door on his own The Nevers series by HBO last November. “We have parted ways with Joss Whedon. We remain excited about the future of The Nevers and look forward to its premiere in the summer of 2021,” a spokesperson for the premium cabler said at the time.

Cheerleaders In Netflix Show Face Sex Misconduct Claims

Robert Joseph Scianna Jr., 25, and Mitchell Ryan, 23, two cheerleaders who appeared in the Netflix docuseries Cheer, have separately been charged with alleged offenses relating to sexual misconduct with minors this week.

Ryan, a member of the Navarro College cheer team that was the focus of the Netflix series, was arrested in Texas on Wednesday. He was charged with aggravated sexual assault against a minor over an incident that allegedly took place in July 2020, the Dallas County Sheriff’s Office told BuzzFeed News.

His lawyer Jeremy Rosenthal did respond to BuzzFeed News’ request for comment, but Rosenthal told USA Today, “This has been a nightmare for Mitch and his family. We look forward to Dallas County hearing the truth and this case being over.”

Ryan posted bond on Friday morning and was released, the sheriff’s office said.

Scianna, whose website says he is an NCA Champion and a two-time World Champion, was also arrested on Wednesday by Chesterfield County Police in Virginia, USA Today reported.

He has been charged with indecent liberties with a minor and using a communication system to solicit sex, a spokesperson for the Chesterfield County Jail confirmed to BuzzFeed News.

Police said he allegedly arranged to meet a juvenile whom he met through a social media platform for sex, USA Today reported.

Scianna did not respond to a request for comment.

The United States All Star Federation (USASF), a network of youth athletes in cheerleading, said in a statement Friday that they are “outraged by the reports of sexual misconduct.”

The organization said it did not know about the allegations of sexual misconduct against Scianna prior to his arrest.

However, the USASF had been aware of the allegations against Ryan after receiving a complaint in late October, it said, and “immediately ensured that it had been reported to law enforcement and later began an investigation of our own, which was ongoing when he was arrested.”

The organization told BuzzFeed News that Scianna and Ryan have been placed on the “Unified Ineligibility List.”

The charges against the two cheerleaders involved in the Netflix docuseries comes after Jerry Harris, a star of the show, was charged additional child pornography charges in December.

Harris had been arrested in September on suspicion of producing child pornography, and prosecutors later claimed in a pretrial detention hearing that he could have allegedly victimized at least 10 boys.

In a statement to ABC News at the time of his arrest, a spokesperson for Harris said they “categorically dispute” the allegations against him. However, the initial criminal complaint filed against him stated that he admitted to investigators that he had sex with a minor at a cheer competition in 2019.

Subway tuna sandwiches and wraps contain no actual tuna, lawsuit claims

There’s something fishy about Subway’s tuna salad sandwiches and wraps, but the menu items don’t happen to include any actual fish, according to a lawsuit filed against the fast-food chain.

What Subway bills as tuna is a “mixture of various concoctions that do not constitute tuna, yet have been blended together by defendants to imitate the appearance of tuna,” according to the complaint.

Filed last week in the U.S. District Court for the Northern District of California on behalf of two California residents, Karen Dhanowa and Nilima Amin, the lawsuit contends the two “were tricked into buying food items that wholly lacked the ingredients they reasonably thought they were purchasing,” based on its labeling. 

“Consumers are consistently misled into purchasing the products for the commonly known and/or advertised benefits and characteristics of tuna when in fact no such benefits could be had, given that the products are in fact devoid of tuna,” the suit claims.

“Conducting tests”

Alex Brown, an attorney with the Lanier Law Firm who is representing Dhanowa and Amin in the case, said they are trying to determine what ingredients are used in Subway’s tuna. “We are conducting tests to figure out what it is. The lab tests thus far have only told us what it isn’t,” he said in an email to CBS MoneyWatch.

Subway did not respond to a request for comment. According to the company’s website, the tuna salad in the chain’s sandwiches is made with flaked tuna in brine, mayonnaise and a flavor-protecting additive.

If certified as a class-action, the suit could potentially represent thousands of Subway customers who bought tuna sandwiches or wraps after January 21, 2017, in California, where it has 2,266 locations. 

The suit isn’t the first legal dispute that raised questions about Subway’s products. Ireland’s Supreme Court in September ruled that the bread Subway uses in its sandwiches could not legally be called bread because of its high sugar content. And in 2017, an appeals court threw out a class-action settlement over claims the chain’s “footlong subs” where an inch shy of the length advertised.

Robinhood denies claims that it sold GameStop shares out from under its traders

No, Robinhood tells The Verge, it didn’t sell off full shares of GameStop, AMC, and other buzzy stocks without permission from its traders.

That contradicts the stories of twelve people who spoke with The Verge, saying that the app unexpectedly sold off their holdings in some of these companies. Quite a number of Robinhood users expressed their surprise on social media today that the app was selling off their stakes, and we tracked down a dozen of them. These traders didn’t believe they had prompted the sales, and they said they weren’t aware of anything on their account that would have automatically triggered them.

“I didn’t have any triggers to sell the stock whether it went up or down. I certainly wouldn’t have put it at $197 when it had just been almost $500,” Jett Flores, who said he was holding stock in GameStop and AMC through Robinhood, told The Verge.

A spokesperson for Robinhood said these small sellers are wrong about how their shares were sold. “I can confirm that claims that Robinhood proactively sold customers’ shares outside of our standard margin-related sellouts or options assignment procedures are false,” the spokesperson told The Verge.

On Wednesday, Robinhood warned some investors with options in GameStop and AMC that it may automatically sell off their stakes to reduce risk, the spokesperson said. But these investors told The Verge they didn’t have options in GameStop or AMC and hadn’t purchased the stocks on margin. They had purchased the shares outright, they said, and were planning to hold onto them.

Margin orders occur when an investor borrows money from the broker (in this case Robinhood) to complete a sale, and brokers can call in those shares if they’re worried the investor can’t pay up. According to Robinhood, most of its actions have been calling in options to purchase shares — a more aggressive move, but not unprecedented. But if users fully owned their shares, as these traders claim they did, selling the holdings would be far more unusual.

The Verge saw screenshots from six traders indicating that their purchase of GameStop or AMC stock had been filled within Robinhood. Six traders sent screenshots showing that their stock in these companies had been sold, with four clearly indicating that they had been sold today. Another trader sent screenshots showing a purchase of Naked Brand stock being filled and then sold within the app. The screenshots don’t indicate how the purchases were funded or how the sales were initiated, but in several of them the app displays a message saying, “We’ve received your order to sell [#] shares of [stock] at the best available price.”

Traders who spoke with The Verge said they were disappointed to lose their stake in these companies. The traders had been planning to keep the stock for longer, and several said they certainly wouldn’t have sold it at the point that they believe Robinhood pushed through the transaction, as GameStop’s stock was faltering from a nearly $500 high.

“It’s extremely dishonest trade on their part and unacceptable,” Ian Q., who said Robinhood unexpectedly sold his shares in GameStop this morning, told The Verge.

The surprise selloff isn’t happening to everyone — plenty of people on the r/WallStreetBets subreddit (and one person I know, who told me they purchased GameStop stock days ago) say they weren’t impacted. And though traders may be outraged by the surprise, Robinhood’s terms of service grant it permission to close a trader’s position under a number of circumstances.

While r/WallStreetBets has been at the center of the frenzy around GameStop and AMC stocks, Robinhood has been the tool of choice for many of the small-time and brand new traders jumping in to take part. But this morning, Robinhood blocked new purchases of stock from GameStop, AMC, BlackBerry, Nokia, and others that were spiking in large part because of purchases coming through the app. The company is now facing widespread backlash from users, celebrities, and politicians, and it’s announced plans to re-open purchases on a “limited” basis on Friday.

It’s still not clear what happened to cause these users’ stakes to be sold off today. But at the very least, it means Robinhood has even more unhappy customers.

Unemployment benefits: Another 847,000 Americans filed jobless claims in Joe Biden’s first week as president

On top of that, 426,856 workers filed for Pandemic Unemployment Assistance, a program designed to provide aid to those not eligible for regular state benefits, such as gig workers. PUA claims are not adjusted for seasonal swings.

Together, first-time claims stood at 1.3 million without seasonal adjustments.

Continued jobless claims, which count workers who have applied for benefits at least two weeks in a row, fell slightly to 4.8 million.

A year ago, jobless claims hovered around 200,000 each week. So America has a long path to get back to that healthy level.

To achieve that, Biden signed several executive orders aimed at creating new jobs, with a focus on green energy jobs that will help America prepare for the economy of the future. The White House has also proposed an increase in weekly emergency jobless benefits as part of a $1.9 trillion stimulus bill aimed at jump-starting the economy.

But Federal Reserve Chair Jerome Powell said Wednesday the priority must be getting the American population vaccinated against Covid-19. No programs will be able to help get the economy fully back to normal until we the pandemic is under control.

“There’s been a lot of adapting — but you can’t adapt hotels, sporting venues, movie theaters, restaurants, bars. That’s millions and millions of people,” Powell said at a press conference.

“And so you’re just going to have to defeat the pandemic. …That is really the main thing about the economy is getting the pandemic under control, getting everyone vaccinated, getting people wearing masks and all that,” he added. “That’s the single most important economic growth policy that we can have.”

US takes aim at China territorial claims as Biden vows to back Japan | Biden administration

Joe Biden has vowed to strengthen the US’s alliance with Japan to counter growing Chinese military activity in the volatile Asia-Pacific region, including a commitment to defend the Senkakus, a group of islands in the East China sea administered by Tokyo but claimed by Beijing.

The US president and Prime Minister Yoshihide Suga agreed during a phone call that their countries’ security alliance was “the cornerstone of peace and prosperity in a free and open Indo-Pacific”.

Biden’s vow to strengthen security arrangements in the region contrasted with the approach taken by Donald Trump, who publicly mulled withdrawing troops from Japan and South Korea, both key US allies.

Trump also complained that Tokyo and Seoul were not paying enough towards their own security and called on them to buy more US-made defence equipment.

“We managed to have substantial exchanges,” Suga said after his 30-minute call with Biden. “We agreed to strengthen our alliance firmly by having more phone calls like this.”

Biden reaffirmed the US commitment to provide “extended deterrence” to Japan, a reference to the US nuclear umbrella, the White House said in a statement.

They also agreed on the need for the complete denuclearisation of the Korean peninsula, as speculation mounts over how Biden intends to engage with the North Korean leader, Kim Jong-un, over his nuclear and ballistic missile programmes.

Japan is particularly concerned about frequent incursions by Chinese vessels into waters near the Senkaku islands, which are known as the Diaoyu in China.

Biden’s “unwavering commitment” to defending the Senkakus was expected, but has taken on extra significance, coming a week after Beijing passed legislation authorising coast guard vessels to use weapons against foreign ships deemed to be involved in illegal activities around the uninhabited island chain.

The two did not discuss the Tokyo 2020 Olympics, whose future is in doubt as the world continues to battle the Covid-19 pandemic, officials said.

Suga’s predecessor, Shinzo Abe, established a rapport with Trump during rounds of golf in Japan and the US, and was the first world leader to meet him after his 2016 election victory.

Suga said he hoped to “deepen my personal relationship with President Biden”, adding that he planned to visit Washington as soon as the coronavirus pandemic allowed.

Media reports in Japan said the two leaders had agreed to call each other Joe and Yoshi.

Biden’s secretary of state, Antony Blinken, had earlier told the Philippine foreign minister, Teodoro Locsin, that the US rejected China’s maritime claims in the South China Sea beyond what is permitted under international law.

Blinken said Washington stood with the Philippines and other south-east Asian countries resisting pressure from Beijing, which has laid claim to wide areas of the South China Sea.

“Secretary Blinken pledged to stand with south-east Asian claimants in the face of PRC [People’s Republic of China] pressure,” the state department said in a statement.

China claims almost all of the energy-rich South China Sea, which is also a major trade route. The Philippines, Brunei, Vietnam, Malaysia and Taiwan have overlapping claims.

The US has accused China of taking advantage of the distraction created by the coronavirus pandemic to advance its presence in the South China Sea.

Blinken, who joined Biden’s administration this week, “underscored that the United States rejects China’s maritime claims in the South China Sea to the extent they exceed the maritime zones that China is permitted to claim under international law”, the statement said.

US-China relations deteriorated under Trump over a host of issues, including trade, the pandemic, Beijing’s crackdown on the Hong Kong democracy movement and its persecution of Uighur Muslims.

The POOSH star has sparked romance rumours with the Blink-182 drummer after they were spotted hanging out together at Kris Jenner’s Palm Springs home over the weekend.

Both Kourtney and Travis posted pictures to their respective Instagram Stories which feature the same pool, suggesting they were together even though neither of them posted photos together.

According to E! News, Travis has also been spotted checking out Kourtney’s recent social media posts, including leaving a comment with a single rose emoji on the reality TV star’s recent flirty mirror selfie.

Earlier in January, he also added a tulip emoji to a photo of Kourtney walking into the ocean, and wrote ‘you’re so cool’ in response to some still she’d shared from the movie True Romance.

A source said: ‘Scott has been around Travis on several occasions and thinks he’s a great guy. He’s really happy for Kourtney and is not surprised they are dating. Kourtney has spent a lot of time with Travis and it’s not shocking to him that they developed a romantic relationship.

‘She hasn’t dated someone in a while and Scott wants her to be happy. Kourtney and Scott are in a great place and they have come to terms that they are strictly friends and co-parents. 

‘There’s no romance there and he couldn’t be happier that she’s moved on. As long as the kids are in a healthy situation and Kourtney’s in a good place, then Scott is happy for them.’
