He’s not wrong. Whether he’s feeling intimidated or suffering the ill effects of that bang on his head early doors, Foden has been a very peripheral figure, albeit one that sticks out like a sore thumb (or indeed a sore Phil Foden) with that beige bandage wrapped around his head.

Manchester City are looking to set up a Champions League semi-final with Real Madrid, but must get past Atletico Madrid in tonight’s quarter-final second leg first.

City hold a narrow 1-0 lead from the first leg thanks to Kevin De Bruyne’s goal, with Atletico playing extremely defensively to keep themselves in the tie. Diego Simeone insists Atletico will play differently in this second leg, using the home crowd at the Wanda Metropolitano to their advantage.

Pep Guardiola says Ruben Dias has travelled to Madrid, but won’t start in the game, while Cole Palmer was also in contention to travel. Gabriel Jesus is suspended after picking up a third Champions League booking of the campaign in the first leg, but Kyle Walker is back after serving a three match suspension in Europe.

After Real Madrid just about held off Chelsea’s brilliant comeback last night, Carlo Ancelotti’s side await in the semi-finals if City can progress. However, they know just how difficult Atletico will be and Guardiola said he expected a more open game than the one-sided first leg.

Philadelphia reinstates indoor mask mandate as COVID-19 cases rise across city

PHILADELPHIA (WPVI) — The City of Philadelphia will once again be under an indoor mask mandate.

The Department of Public Health made the announcement on Monday afternoon during a press briefing.

Health Commissioner Dr. Cheryl Bettigole said mask precautions begin Monday, but in order to provide a one-week education period for businesses, masks will be required in all indoor public spaces as of Monday, April 18.

“If we fail to act now, knowing that every previous wave of infections has been followed by a wave of hospitalizations, and then a wave of deaths, it will be too late for many of our residents,” said Bettigole, noting about 750 Philadelphia residents died in the wintertime omicron outbreak. “This is our chance to get ahead of the pandemic, to put our masks on until we have more information about the severity of this new variant.”

Starting April 18, masks will be required in all indoor public spaces, including schools and child care settings, businesses, restaurants, and government buildings.

At that time, residents will be asked to report any business not complying with the mandate to 311.

Bettigole cited a rise in COVID cases as the reason why the city is reinstating the mask requirements for indoor public spaces. Confirmed COVID-19 cases have risen more than 50% in 10 days.

The health department says the city will move to Level 2: Mask Precautions under its COVID-19 Response guidelines.

Level 2 is reached when the city meets two of the following three criteria:

  • Average new cases per day are less than 225
  • Hospitalizations are less than 100
  • Cases have increased by more than 50% in the previous 10 days.

Under Level 2, you must wear a mask when indoors in public places.

However, there is no vaccine or testing requirement for places that serve food or drink under Level 2.

The city had lifted its indoor mask mandate and moved to the All Clear Level 1 on Wednesday, March 2. Now, 41 days later, the city is bringing it back.

The restaurant industry pushed back against the mandate, saying workers will bear the brunt of customer anger over the new rules.

“This announcement is a major blow to thousands of small businesses and other operators in the city who were hoping this spring would be the start of recovery,” said Ben Fileccia, senior director of operations at the Pennsylvania Restaurant & Lodging Association.

Councilman Allan Domb said business owners have been calling his office to express concerns.

This spring was thought to be the comeback for many businesses, including restaurants that were lucky to survive after months of closures and restrictions during the pandemic.

Reinstating a mask mandate has some concerned that customers may just decide to go elsewhere, like New Jersey or the collar counties that haven’t had any restrictions in months.

“I’m hoping I can get to the health commissioner and try to convince her we should look at other options — maybe making it strongly recommended but not required,” said Domb.

PolicyLab at Children’s Hospital of Philadelphia said Friday that while it expects some increased transmission in the northern U.S. over the next several weeks, hospital admissions have remained low and “our team advises against required masking given that hospital capacity is good.”

Bettigole said requiring people to mask up will help restaurants and other businesses stay open, while a huge new wave of COVID-19 would keep customers at home. She said hospital capacity was just one factor that went into her decision to reinstate the mandate.

“I sincerely wish we didn’t have to do this again,” Bettigole said. “But I am very worried about our vulnerable neighbors and loved ones.”

Amazon plans ‘substantial’ objections to historic union vote at New York City warehouse

In its filing to the National Labor Relations Board, Amazon (AMZN) alleges how the independent federal agency’s regional office which oversaw the election at its Staten Island facility, known as JFK8, “unfairly and inappropriately facilitated the [Amazon Labor Union’s] victory.”

It claims the agency used an “artificially reduced number” of employees in the voting unit to calculate whether ALU had garnered enough support to even hold an election. It also claims the agency delayed investigating what it calls “frivolous” unfair labor practice charges that it says were “exploited” by the union. And it alleges that the agency failed to properly staff the polls during the election, which ultimately “produced chaos and hours-long lines to vote on the first polling day, discouraging other employees from voting.”

Amazon also outlines alleged misconduct on the part of ALU, the grassroots labor organization started by current and former employees of the facility. Among its claims about the ALU, it says the union unlawfully intimidated employees and “threatened violence against its detractors.”

Amazon spokesperson Kelly Nantel said in a statement Friday: “Based on the evidence we’ve seen so far, as set out in our objections, we believe that the actions of the NLRB and the ALU improperly suppressed and influenced the vote, and we think the election should be conducted again so that a fair and broadly representative vote can be had.”

The Staten Island election marked the first time a group of US workers have successfully voted to form a union in the company’s 27-year history. On Thursday, Amazon was granted a two-week extension on filing the proof to support its objections.

In its filing requesting the extension from the NLRB regional director, Amazon noted that the election at the facility “was one of the largest in the Board’s recent history” and said that its “objections are anticipated to be substantial, both in the number … and the scope of the conduct.”

Out of approximately 8,325 eligible voters, 4,785 votes were counted. There were 2,654 votes in favor of unionizing and 2,131 votes against it. Another 67 ballots were challenged and 17 were voided.

The ALU did not immediately respond to a request for comment.

The company first indicated last week that it was exploring filing objections over what it claimed was “inappropriate and undue influence” on the part of the NLRB. Kayla Blado, acting director and press secretary for the NLRB, said in a statement to CNN Business last week: “The NLRB is an independent federal agency that Congress has charged with enforcing the National Labor Relations Act. All NLRB enforcement actions against Amazon have been consistent with that Congressional mandate.”
Amazon said last week that it was “disappointed” with the Staten Island results. While Amazon has repeatedly said in statements that its “employees have always had the choice of whether or not to join a union,” it also spent $4.3 million last year on anti-union consultants and used a combination of texting, on-site signage and mandatory meetings to convince workers to vote against unionizing.

Last Thursday, the same day the public vote count began for the Staten Island election, the ballots of a do-over union election at an Amazon warehouse in Bessemer, Alabama, were also tallied, but the outcome remains too close to call. There are 416 ballots being challenged, which is enough to sway the result. The NLRB is expected to hold a hearing to review the contested ballots in the coming weeks.

In contrast to the bootstrapped Staten Island effort, the Bessemer drive was done in tandem with the Retail, Wholesale and Department Store Union, an 85-year-old labor union. The original election, held a year ago, favored Amazon, but the results were scrapped after an NLRB regional director determined that Amazon illegally interfered, a decision the company called “disappointing.”

The RWDSU this week filed objections to the do-over election, arguing that Amazon again interfered with its employees right to vote freely in a fair election and it called for the NLRB regional director to hold a hearing to determine if the results should be set aside once more. The RWSDU alleged there were instances of termination and retaliation of union supporters, intimidation and surveillance of employees engaged in organizing activities, and discrepancies with the list of eligible voters provided to the union. The RWSDU also alleged Amazon applied new rules to prohibit organizing, removed pro-union literature, and threatened to close the facility if the union succeeded.

“We’ve said from the beginning that we want our employees’ voices to be heard, and we hope the NLRB counts every valid vote,” said Amazon’s Nantel in a statement about the Bessemer vote.

The RWDSU previously filed several unfair labor practice complaints over Amazon’s conduct at the facility. One complaint took issue with required group meetings where Amazon representatives conveyed its anti-union stance to workers, which the union argued violated workers’ right to refrain from organizing-related activities.

While these required meetings are a common tactic similarly used by a number of other employers and one that is legally permitted, the union asked the NLRB to review the law. On Thursday, NLRB General Counsel Jennifer Abruzzo issued a memo calling for the agency to reconsider its stance on mandatory meetings of this nature.

Amazon, which previously told CNN Business the RWDSU’s complaint has no merit, declined to comment on Abruzzo’s memo.

The battle over treatment of workers inside Amazon’s facilities is widely viewed as central to the future of work in the United States. The company is the nation’s second largest private employer and is known for its heavy emphasis on automation and tracking of productivity. Its high turnover rates, on-the-job injuries and increased worker activism, have also drawn significant attention to its workplace conditions in recent years.
In late May, Amazon shareholders are expected to have the opportunity to vote on a resolution for an independent audit of the company’s warehouse working conditions, according to a Reuters report on Thursday.

Guardiola rates Manchester City v Liverpool as ‘biggest rivalry’ of his career | Manchester City

Pep Guardiola believes Liverpool are the greatest opponents of his career and has compared Manchester City’s rivalry with Jürgen Klopp’s side to some of sport’s finest in history, including Ali-Frazier and Nadal-Federer-Djokovic, as the two teams prepare for Sunday’s Premier League title showdown.

The reigning champions and league leaders are just a point ahead of Liverpool as Klopp’s challengers arrive at the Etihad. In the past four seasons the title has been claimed by the two clubs – City winning three and Liverpool one.

Guardiola was asked how long the rivalry can continue and if it was comparable to those of the heavyweight boxers Muhammad Ali and Joe Frazier in the 1970s and of the tennis players Rafael Nadal and Roger Federer in the last two decades. “Yeah – but Nadal, Federer and [Novak] Djokovic was 20 years and we are five years,” he said of the rivalries’ durations.

“Footballers run quicker and so to maintain success is more difficult than other sports. When I retire and watch and play golf I will remember the biggest rivalry was with Liverpool. When you achieve 100 points and 98 points [the tally in two of City’s title-winning seasons] you need someone to push from behind, to be so close. You have to make another step.”

Guardiola added: “The most credit I give is for consistency through the years. Both City and Liverpool have had four or five years [at the top]. That’s why Federer, Nadal, Djokovic have been at the top for so long – consistency.”

Klopp’s successes with Borussia Dortmund when Guardiola was at Bayern Munich mean the German has more victories against City’s manager than anyone else has, but he has none since November 2019. Guardiola, who also managed Barcelona for four years, insisted that he has always thrived on rivalries. “Real Madrid made Barcelona better,” he said. “Dortmund with Jürgen and [then Thomas] Tuchel. Here, Man United and Chelsea change their managers but Liverpool and Jürgen have always been here.”

Despite the high stakes of Sunday’s contest Guardiola will be relaxed, joking that the 4.30pm kick-off potentially clashes with coverage of Tiger Woods playing in the Masters. “I sleep like a baby this year,” City’s ,manager said. “I’m looking forward to Sunday … tomorrow [Saturday] would be better – I’m a little bit upset with the Premier League because they put the game when Tiger Woods is back.”

Guardiola also aimed a good-humoured jibe at Klopp when asked if the German might be asked for a post-match drink. “If we win I’d love it – I’ll invite him,” he said. “Jürgen makes world football a better place to live. His message, and he’s a huge competitor. He knows, we spoke together in Germany, about my admiration for what he does, the message and the way his teams play. He’s a good guy and I don’t have any problems with him, absolutely not. And he’s said many times that we’re a rich club so the wine will be perfect, high quality.”

Guardiola had earlier brushed off being described as the world’s best coach by Klopp. “I’m not, thank you so much, but I’m not,” he said. “I would like to tell him I’m the best, but I’m not. If we had success it is because of my staff, incredible teams, a lot of money – like our opponents like to hear – and a lot of work and talented players. Still I have the process of learning, and I became a manager to be on the pitch [only].”

Parents reach $250,000 settlement with Texas city after son, 3, dies after contracting brain-eating amoeba at splash pad

Bakari Williams died last September after spending five days in the hospital with primary amoebic meningoencephalitis, a rare and often fatal infection caused by an amoeba called Naegleria fowleri, according to previous reporting from CNN and affiliate KTVT.

Williams contracted the infection from a splash pad that officials later determined was improperly tested and maintained.

At a news conference, attorneys for Williams’ parents said the child’s death was preventable.

Family attorney Brian Hargrove said the $250,000 is the maximum economic recovery allowed against a city under the Texas Tort Claims Act, according to KTVT.

Arlington, in a statement, said the settlement will include a “significant investment in the installation of health and safety equipment and other improvements for our public pools and splash pads.”

The city will distribute a new policy manual, the Bakari Williams Protocol, that will guide staff on water treatment, according to Hargrove and the city. “We plan to share this information with other agencies in the aquatics industry so they can learn from our hard lessons,” the city said.

New technology will automatically shut off any splash pads where water readings are not in the acceptable ranges and the addition of QR codes will allow visitors to see real-time information about water quality, the statement, obtained by KTVT, said.

“We want you to know that Bakari was a sweet, beautiful and innocent child who did not deserve to die in the manner that he did. For us, this case has been about public awareness,” Williams’ mother, Kayla Mitchell, said at the news conference, according to the affiliate.

“We want to make certain that nothing like this ever happens again. We want to make certain that what happened to our son, what happened to our family, does not happen to anybody else,” said Mitchell.

Naegleria fowleri is commonly found in soil and in fresh warm water such as lakes, rivers and hot springs, according to the Centers for Disease Control and Prevention (CDC). It can also be found in poorly maintained or unchlorinated pools.
The organism infects people when water containing the amoeba enters the body through the nose, according to the CDC. The Naegleria fowleri amoeba then travels up the nose to the brain, where it destroys the brain tissue, the CDC says.

Investigation into the source of infection

City and Tarrant County officials were notified by the hospital September 5 of the child’s condition, according to a joint news release issued that month. The county health department started an investigation and determined two possible sources for the exposure to the amoeba — the family’s home in Tarrant County and the Don Misenhimer Park splash pad in Arlington.

The city immediately closed that splash pad, the news release says, and out of an abundance of caution closed the other three public splash pads for the remainder of the year.

On September 24, the CDC, according to the news release, determined the child was likely exposed to the organism at the splash pad after tests confirmed the presence of active Naegleria fowleri amoeba in water samples from the park.

“It breaks my heart. I’m a father of four, a grandfather of five kids from 2 to 7 years old. I cannot imagine having to bury a child or a grandchild like that,” Arlington Mayor Jim Ross told KTVT at the time

Low chlorine levels likely a factor

The city of Arlington conducted an investigation into the splash pad’s maintenance, equipment and water testing procedures. Officials determined the water quality testing data needed improvement.

“We have identified gaps in our daily inspection program,” Deputy City Manager Lemuel Randolph said in the 2021 news release. “Those gaps resulted in us not meeting our maintenance standards at our splash pads. All of the splash pads will remain closed until we have assurance that our systems are operating as they should, and we have confirmed a maintenance protocol consistent with city, county and state standards.”

Records from two of the splash pads, including the one at Don Misenhimer Park, showed employees did not consistently record, or in some cases did not conduct, water quality testing that is required before the facilities open each day, according to the news release. The testing includes checking for chlorine, which is used as a disinfectant.

A review of the logs determined that water chlorination readings were not documented two of the three days that the child visited the park in late August and early September, the news release said.

“Documents show that chlorination levels two days before the child’s last visit were within acceptable ranges,” reads the release. “However, the next documented reading, which occurred the day after the child visited, shows that the chlorination level had fallen below the minimum requirement and that additional chlorine was added to the water system.”

Florida: Over 160 arrested in Panama City beach as spring break crowds disrupt the area

Law enforcement officials have detained over 160 people in Panama City Beach following a spring break weekend that saw massive crowds of people disrupting the area, officials said. 

Bay County Sheriff Tommy Ford said that 161 people were arrested and jailed over the weekend and that officers seized 75 guns amid their clashes with these individuals, WRIC reported.

“What we saw this past weekend is absolutely unacceptable. Period,” said Police Chief J.R. Talamantez, who also confirmed that several businesses closed their doors on Friday as the crowds gathered and disrupted the normal flow of business, according to the report.

“The crowd that has been here this weekend, there is [sic] no words that can describe the way they have behaved themselves, conducted themselves, and the amount of laws they have broken,” he added.

A heavy police presence was then called into the area to assist these businesses, who did not wish to risk any inconvenience or harm to their customers or business, the Panama City chief said.

There were no reports of violence from the first day of the weekend, but a shooting incident on Saturday left one person injured, Talamantez explained, noting that many of the arrested people had firearms with them.

“I personally encountered an individual holding an AR-15 who is now in custody,” Talamantez said, according to the WRIC report.

“These are the type of individuals that we’re facing,” he added. “Throwing beer bottles at police officers. Shooting right down the road. There were blue lights up and down the road as these shootings took place. The blatant disregard for public safety that these individuals are having will not be tolerated.”

Mayor Mark Sheldon said the crime was not caused by the spring breakers, but by criminals who came out under the shroud of the crowds.

City says Eagle River avalanche-mitigation measures were successful; evacuated residents allowed to return

Update, 7:15 p.m.: City officials said Sunday evening that efforts to reduce further avalanche danger above Hiland Road were successful, and said residents who’d been evacuated earlier in the day would be allowed to return. The area was the site of a deep, wide avalanche late Thursday that buried the road, came close to hitting several dwellings and cut off more than 100 homes on the other side of the slide.

A helicopter dropped a series of explosive charges on snowpack above the road late Sunday afternoon. A Daily News photographer heard 10 explosions.

Mayor David Bronson’s office issued a statement Sunday evening saying:

Mitigation efforts for the Hiland Road avalanche are complete and were successful. Safety teams have assessed potential risks for reentry.

Significant risks remain in place until snow clearing operations are complete.

The public will be allowed back in the area affected by the evacuation order effective immediately. We do caution residents from returning to their homes until snow is removed.

Safety risks will be assessed daily until further notice.

Maintenance crews will begin work to remove snow starting tomorrow contingent on daily safety assessments. If conditions remain safe, we anticipate snow removal will take two weeks.

When pressed on details, spokesman Corey Allen Young said, “The incident commander has been given a degree of confidence from the avalanche experts that the area is safe to begin snow removal.”

Anchorage Mayor Dave Bronson on Sunday issued an evacuation order for residents in an Eagle River area near a massive avalanche that cut off about 100 homes since late Thursday. Officials began trying to trigger the remaining snowpack on the mountainside above Hiland Road with explosives from a helicopter late in the afternoon, though no additional slides were immediately reported.

Roughly half of the mountain’s snowpack came down in the avalanche, about seven miles up Hiland Road, Municipal Manager Amy Demboski said Sunday. The remaining snow was in danger of coming down on its own, officials said, and they were scrambled to get residents between Milepost 7.0 to 7.9 of Hiland Road out of the area before triggering the remaining snow with explosives dropped from a helicopter.

Snowmachines were used to ferry residents around the avalanche to safety.

As a helicopter flew over the area, a series of explosions were heard from the mountainside. No additional avalanches immediately resulted.

Officials said they hoped to start mitigation Sunday before 8 p.m., before the weather conditions change, said Incident Commander Alex Boyd, assistant chief with the Anchorage Fire Department.

Officials pushed to start the avalanche mitigation Sunday ahead of a storm that was expected to bring snow and increased winds at higher elevations starting in evening.

The mitigation process, using the helicopter and explosives, will most likely take several days, officials said. The city was being assisted by the state in the operation, officials said.

The avalanche, which the city says occurred Thursday around 11:30 p.m., is roughly 300-450 feet wide and about 60-80 feet deep, according to the Anchorage Office of Emergency Management. The mayor issued an emergency disaster declaration on March 26.

On Sunday the city posted the evacuation order and a fact sheet for residents of the area.

“The size of this avalanche is massive,” Demboski said. “It has been described by avalanche experts as a once-in-100-year event.”

Around 100 households remain cut off from main road access and many of these homes still do not have power.

Brendan Castello who was in bed when the avalanche happened said he woke up when the power went out but didn’t pay much attention to it. In the morning when the power didn’t come back he learned about the avalanche and went down to see it.

“I drove down and kind of crested the hill and came around and saw that it was, you know, 40 plus feet, right across the road and thought, ‘Oh, no, we are definitely not going to school today,’” he said. “I realized, ‘Oh, my gosh, it’s gonna be several days.”

Castello used his generator to heat the house and rode his snowmachine to Eagle River to make sure he and his family had supplies.

An emergency evacuation route from West River Drive remains in use with snowmachine support for transport, said in an email Misty Rose Nesvick, public information officer at the Municipality Of Anchorage Emergency Operations Center.

The Red Cross opened a shelter for evacuees at the Harry J. McDonald Memorial Center, but moved it to on-call status on Sunday evening, with volunteers available to reopen it and provide help to residents.

Nesvick said that shelter options for both humans and pets remain in standby mode at this time and are prepared to receive clients when needed.
