Kobe Bryant crash photos trial: Jury finds LA County must pay Vanessa Bryant $16 million and Chris Chester $15 million

LOS ANGELES (KABC) — A federal jury Wednesday ordered Los Angeles County to pay $31 million in damages over the actions of deputies and firefighters who took and shared gruesome photos from the scene of the 2020 helicopter crash that killed Kobe Bryant, his 13-year-old daughter Gianna and seven other people.

The damages were awarded to Bryant’s widow, Vanessa, and co-plaintiff Chris Chester, whose wife Sarah and 13-year-old daughter Payton also died in the Jan. 26, 2020, crash in Calabasas.

Vanessa Bryant was awarded $16 million and Chris Chester was awarded $15 million.

The jury deliberated for 4 1/2 hours before reaching the verdict. Vanessa Bryant cried quietly as it was read.

Chester and Bryant sued the county in federal court for negligence and invasion of privacy over photos of human remains taken at the scene and shared by first responders.

Bryant and Chester alleged mental anguish over the thought that one day in the future, those photos will turn up in public.

Bryant’s attorneys did not give jurors a dollar amount they thought their client deserved, but Chester’s attorney gave them suggested guidelines that would have meant tens of millions for each plaintiff.

After the verdicts were read, Bryant and Chester hugged in the courtroom. She also hugged her attorney.

Bryant did not speak after leaving court.

She later posted on Instagram a picture of herself, Kobe and Gianna with a caption that read: “All for you! I love you! JUSTICE for Kobe and Gigi! #Betonyourself #MambaDay 8-24-22 #MambaMentality.”

Along with Chester and Bryant’s loved ones, the crash killed Alyssa Altobelli, 14; Keri Altobelli, 46; John Altobelli, 56; Christina Mauser, 38; and pilot Ara Zobayan, 50.

Two other families separately settled with the county over the photos for $1.25 million each. All of the victims’ families reached a settlement with the helicopter company over the crash, but those terms remain confidential.

For 10 days jurors heard testimony from L.A. County firefighters and sheriff’s personnel — some accused of taking the photos, others of receiving them.

The county’s lead lawyer argued during her summation that the photos have not surfaced in public in the 2 1/2 years since the tragedy, which proves they have been permanently deleted.

“This is a photo case, but there are no photos,” the attorney told jurors in Los Angeles federal court. “There’s a simple truth that cannot be ignored — there’s been no public dissemination.”

Vanessa Bryant’s lawyer Luis Li told jurors that the close-up photos had no official or investigative purpose, and were mere “visual gossip” shared out of a gruesome curiosity.

County attorney J. Mira Hashmall argued during the trial that the photos were a necessary tool for assessing the situation.

She acknowledged that they should not have been shared with everyone who saw them. But she emphasized that the photos had never appeared publicly, and had never even been seen by the plaintiffs. She said that meant that Sheriff Alex Villanueva and other officials had taken decisive and effective action when they ordered those who had the photos to delete them.

L.A. County provided the following statement from Hashmall, its lead outside counsel in the case:

“We are grateful for the jury’s hard work in this case. While we disagree with the jury’s findings as to the County’s liability, we believe the monetary award shows that jurors didn’t believe the evidence supported the Plaintiffs’ request of $75 million for emotional distress. We will be discussing next steps with our client. Meanwhile, we hope the Bryant and Chester families continue to heal from their tragic loss.”

The jury returned its verdict on Kobe Bryant Day, which is celebrated on Aug. 24 because it uses both of his jersey numbers — 8 and 24 — and is the day after his birthday. Tuesday would have been Kobe’s 44th birthday.

West Chester University student tests positive for monkeypox

WEST CHESTER, Pennsylvania (WPVI) — A student at West Chester University has tested positive for monkeypox.

The student, who is a commuter student and does not live on campus, is currently isolating and is said to be doing well.

Nancy Santos Gainer, the vice president of university communications, said as soon as they found out they began working with local health departments to see if anyone in Chester County had been exposed.

At this time, there have been no reports of any close contact with the student, said Gainer.

There have been no other reports of monkeypox to the university.

“We want people to know that it’s coming in close intimate contact with someone with monkeypox. It’s not easily transferable,” explained Gainer.

It’s still unclear if the student came into contact with anyone outside of Chester County.

If that is the case, Gainer said your county’s health department would be giving anyone exposed a call.

According to medical experts, the monkeypox virus typically starts with generic virus symptoms like a headache, fever, pain and fatigue. But then that can increase and some may break out in rashes, or the pox marks as they’re known, all over their body.

It typically spreads through respiratory droplets, usually after prolonged contact, and also through other bodily fluids or other forms of close contact.

West Chester University released this statement to Action New:

“West Chester University health officials received confirmation this past weekend that a commuter student has tested positive for monkeypox. The student is currently isolating and doing well. According to the investigative efforts of the lead health department on the case, the University has been told that there are no close contacts in Chester County. There have been no other reports to the University and, according to the CDC and PA Department of Health, the risk of contracting monkeypox remains extremely low.”

Student stabbed during fight in Coatesville Area Senior High School in Chester County, Pennsylvania

COATESVILLE, Pennsylvania (WPVI) — Family members have identified the teen who was stabbed during a fight inside Coatesville Area Senior High School in Chester County, Pennsylvania.

According to family, 16-year-old Mickey Raynor Jr. was stabbed when a fight broke out between him and another student at about 7:30 a.m. Raynor is a sophomore at the school.

Raynor’s mother said he underwent surgery in the morning at Paoli Hospital and is currently in stable condition.

The Chester County District Attorney’s Office and Caln Township Police Department said the student who committed the stabbing has yet to be taken into custody.

“This is an extremely upsetting incident,” Dr. Rick Dunlap, Substitute Superintendent for Coatesville Area School District, said in a letter to families Tuesday morning. “I’m extremely sorry to report that at least one of the students was stabbed and was transported to the hospital.”

Raynor’s mother said her son has had problems with other students in the past at the school and their family is “fed up.”

Caln Township police confirmed to Action News the school, which consists of grades 11 and 12, was placed on lockdown.

School officials began the process of dismissing students shortly after the incident.

“CASH is now an active crime scene and we need to allow our police departments the time and space to complete their investigation while ensuring there are no further disruptions today,” Dunlap said.

The superintendent said students would be interviewed as they were being dismissed. He said the school will follow up with counseling for students and staff.

The district attorney’s office said police are still looking for the known suspect.

Chester County mother urges people to get vaccinated for COVID-19 after near-death experience

HAVERTOWN, Pennsylvania (WPVI) — Chester County native Marissa Fuentes has been fighting to stay alive after being diagnosed with COVID-19.

In April, Fuentes was about 32 weeks pregnant when she was diagnosed with the coronavirus.

Fuentes says she underwent an emergency C-section, delivering her baby boy, Enzo, prematurely, with a genetic disease.

Her husband could only see the two through FaceTime in the beginning.

“We got thrown this incredible curveball,” said her husband, Adrian Fuentes.

Fuentes was airlifted from Paoli Hospital to Lankenau Medical Center.

Fuentes had severe COVID pneumonia, which caused her lungs to fail.

That lead to her needing the assistance of a ventilator. When that couldn’t support her, she put on an ECMO machine.

The ECMO machine took blood out of her body, put oxygen into it, and cleared the carbon dioxide.

Her nurse, Elena Casanova, said most patients average 10-15 days on ECMO support. Fuentes lasted around five and half months.

Casanova called Fuentes a medical miracle.

“I feel like it,” said Fuentes.

Fuentes was not vaccinated because Casanova said at the time there was a lot of uncertainty about the effects of the vaccine on the fetus, so medical professionals were not strongly recommending it.

Now, she says the data is more convincing to get vaccinated, and patients who are vaccinated have a much lower risk of getting severely ill.

“If you can get the vaccine, get it,” said Fuentes. “Because it could save you, it could save your child’s life.”

Fuentes was able to see her newborn baby for the first time on her 29th birthday in September.

She just settled into Kindred Hospital, where she’s undergoing specialized pulmonary and general rehab in the hopes that she can get to a new rehab location.

“You can’t go through something like this, so intense for five and a half months, and not feel an eternal bond,” said Casanova.

Swamped in medical bills, Fuentes says she can’t wait to be home.

“Oh my gosh, I’m so excited. All I want to do is go see my babies, and love them and be the best mom I can be,” said Fuentes.

Fuentes hopes to be out of Kindred Hospital in about a month or so. She’s determined to get home and see her children.

It’s four years since Linkin Park lead singer Chester Bennington passed away at age 41.

And on Tuesday, his widow Talinda posted a quirky photo of her late husband to Instagram along with a lengthy heartfelt message.

‘You always had a way to make us all laugh. You always made everything better,’ she wrote. ‘And when you put this lettuce cup on your head to make us laugh because our food was taking forever, you made everything better once again.’

She went on: ‘When they were newborns, you wrote your hopes and dreams for them. God must have seen what you wrote because they are truly everything you wished for them to be. I know you can see them. I would give anything to have you back so they could see you.’
