Late LSU student Madison Brooks now victim of ‘smear campaign’: parents’ lawyer

The attorney for late Louisiana State University student Madison Brooks’ family blasted her accused rapists for making her the victim of a “smear campaign” — calling their claims that she consented to sex the evening of her death “absolutely shameful.”

Kerry Miller, an attorney for Brooks’ parents, ripped the accusers’ legal teams for basing the claims on apparent recordings that have yet to be made public — and which a judge suggested could even strengthen the case against the four charged rapists.

Miller trashed the rival attorneys for denying Brooks was too drunk to consent, despite authorities saying her blood-alcohol content was 0.319%, nearly four times the legal limit.

“To come out to mention evidence that they have and don’t show it, to contradict a gold standard blood alcohol test and not say on what basis they are doing it, it is a made-up smear campaign, absolutely shameful,” Miller told WAFB in an interview Saturday.

The accusers’ defense attorneys gave a press conference Friday in Baton Rouge claiming that Brooks had “consensual sex” with two of the four accused in the back of their SUV shortly before she got out and was fatally struck by another vehicle.

The phone videos were reportedly filmed by Kaivon Deondre Washington, 18, who is charged along with a 17-year-old — who cannot be identified because of his age — with the third-degree rape of Brooks, based on her being too drunk to give consent.

The other two in the car at the time — Everett Lee, 28, and 18-year-old driver Casen Carver — were each charged with principle to third-degree rape, meaning they witnessed it but did not participate.

Their defense attorneys at the Friday press conference disputed many of the findings in the case, based largely on footage from the night.

One of them, Ron Haley, had also shared a similar message in a series of earlier interviews.

Still, he claimed that they “do not intend to try this case in the media.”

“We do, however, intend to state the pertinent facts in this case while being as sensitive as possible to all parties involved,” he said.

That included the fact, he said, that “the two defendants who engaged in a consensual sexual act with Ms. Brooks did so after obtaining verbal consent.”

Rather than getting dumped, the video shows that Brooks then “left the car on her own volition, saying that she would get Uber,” Haley said.

“She is seen on video leaving the car, unharmed and in good health. This will be confirmed by video,” he said, while stressing that the videos did not show any of the sexual acts.

Another of the defense attorneys, Joe Long, said videos from that night — including one of Brooks running after the four men to get into their SUV — prove that she cannot have been as drunk as authorities claimed.

“If you have a .319, your motor skills shut your body down,” Long said.

“You can’t walk. You can’t talk. You’re lapsing in and out of blackout and you risk death,” he stressed, saying the videos “undermine” the accuracy of the police findings.

Although the legal teams have yet to release the videos, they were seen by District Judge Brad Myers — who told a bond hearing that they showed one of the suspects “callously” laughing at Brooks.

Myers also revealed that another video showed Brooks falling over and needing help standing up before the sexual encounter in the car.

“The evidence to me is clear,” Myers told a bond hearing.

District Attorney Hillar Moore told the same outlet that upgraded charges of first-degree rape have yet to be fully ruled out.

“At this point they are arrested for third-degree rape based on the lack of ability to consent to sex. First-degree rape is obviously a much more serious offense and is when somebody is raped by more than one person — by two people or more — and that’s obviously what the allegations are,” Moore said.

There is also a question of whether the 17-year-old charged in the case could be tried as an adult.

TikToker discovered dead in field after disappearing

A Brazilian TikTok influencer, who went missing for two days, has been found dead in her car after allegedly driving off a cliff.

Authorities reportedly discovered the deceased woman, 41-year-old Raquel da Silva Moura Medeiros, in an overturned vehicle near the BR-364 motorway in Ariquemes, Rondônia, on Oct. 18, Jam Press reported.

The Federal Highway Police deduced that her vehicle flipped over after plummeting off a cliff on the side of the road with no foul play suspected. They claimed that it took so long to find the dentist’s body because her car was hidden in a patch of vegetation, G1 Global reported.

This marked a tragic end to a harrowing saga that began after Medeiros went missing two days earlier on Oct. 16. The deceased had reportedly left the municipality of Ji-Paraná — her place of birth — at approximately 10 p.m. that day in a white Chevrolet Onix.

Authorities claimed Medeiros was hard to find because her vehicle was hidden in the grass.

Medeiros had reportedly driven off a cliff, whereupon her car flipped over and landed in a patch of vegetation.

She was last spotted on closed-circuit TV cameras arriving in Jaru, the last city en route to Ariquemes — 20 minutes after she had begun the drive.

After Medeiros didn’t return home, concerned family members subsequently posted a missing persons notice on social media, and alerted the authorities of her disappearance, Jam Press reported. This prompted a major search effort with authorities patrolling sections of the roadway between her starting point and where she was last seen with the aid of air support. That’s when they recovered her remains.

Medeiros was an accomplished dentist who specialized in orthodontics and hospital dentistry — which she regularly documented for her followers on TikTok. She also posted videos related to travel, friends and family, and going to the gym.

Co-workers at the basic health unit in Ariquemes, where she worked since 2017, claimed Medeiros “was liked by patients and co-workers.”

Medeiros will be buried on Oct. 20 in a church in Ariquemes, her family said.

NYPD car crashed into eight pedestrians after being cut off

An NYPD officer struck eight pedestrians — including a child and her grandmother — in The Bronx Thursday afternoon while responding to an emergency call, cops said.

The marked patrol car was responding to a grand larceny in progress just after 3:15 p.m. when it jumped the curb near Hoe and Westchester avenues and hit the pedestrians before crashing into a pole, according to police and law-enforcement sources.

Nurse Nicole Linton denied bail in fatal Los Angeles car crash case

The nurse charged with killing six in a fiery 130 mph crash in Los Angeles has been denied bail, the Post has learned. 

Nicole Linton appeared before a Los Angeles judge Monday morning but the judge denied a motion to let her out of the city’s Twin Towers Correctional Facility in order to seek treatment at a psychiatric hospital.

The traveling nurse will remain in custody under a “no bail” hold and will appear again in court for an arraignment Monday afternoon where she will plead not guilty, her attorney Jacqueline Sparanga told The Post.

“We are disappointed with the judge’s ruling,”  Sparanga said. “We believe that a psychiatric lock-down hospital— where Nicole would not have been able to simply walk out— is the most appropriate place for her to remain pending this case. There’s no question here that this is a mental illness-related car accident, and she should be housed at a psychiatric facility where she can receive treatment and undergo the testing necessary to determine what actually happened.”

Linton’s attorneys argued in their Aug. 29 bail motion the nurse lost consciousness as she drove her Mercedes into several cars, triggered by her bipolar disorder or a seizure. They asked that Linton be released with conditions so that she could be evaluated at the UCLA Resnick Neuropsychiatric Hospital. 

However, prosecutors claimed a psychiatric evaluation showed no indication of a seizure and the vehicle’s data and surveillance video indicated she had “complete control over steering,” adding “This NASCAR-worthy performance flies in the face of the notion that she was unconscious or incapacitated.”

Sparanga told The Post she will be asking another judge at a different hearing to sign an order allowing Linton to be moved to a hospital for mental health testing.

“We think she has bipolar disorder, and if she has something else, she needs to be properly tested and treated for it,” Sparanga said.

Nurse Nicole Linton was driving 130 mph when she allegedly killed six in fiery Los Angeles crash

The nurse facing murder charges for the fiery Los Angeles crash that killed five was going 130 mph – it was revealed on Sunday – 40 miles faster than previously thought.

Nicole Linton, 37, was initially thought to be driving her Mercedes at 90 mph, but court papers obtained by the Los Angles Times on Sunday said she floored the pedal for at least five seconds before deliberately speeding into La Brea and Slauson avenues on Aug. 4.

“Further analysis reveals that her speed at impact was in fact 130 mph and that she floored the gas pedal for at least the 5 seconds leading into the crash, going from 122 mph to 130 mph,” said the filing, which was released on Friday.

Prosecutors laid waste to the claims that she lost consciousness by citing surveillance video and data from her Mercedes. The documents said Linton had “complete control over steering, maintaining the tilt of the steering wheel to keep her car traveling directly toward the crowded intersection.”

4 dead after van overturns on Palisades Parkway

Four people were killed and eight others were injured when a passenger van carrying factory workers flipped over on the Palisades Interstate Parkway in New Jersey overnight, officials said.

The Ford Econoline E350 was driving through Englewood Cliffs around 1:25 a.m. when it rolled over and landed in the center median near Exit 2, reported ABC Eyewitness News.

The van’s 12 occupants found themselves trapped inside the mangled wreckage and had to be extricated by firefighters.

Four of the passengers were pronounced dead at the scene. The other eight were taken to area hospitals to be treated for injuries ranging from bruises to severe head trauma.

Five of the crash survivors were transported to Hackensack University Medical Center, one to Jersey City Medical Center, one to Holy Name Medical Center in Teaneck and another to Englewood Health.

The van was being used to shuttle employees from a factory in upstate New York to their homes at the end of their shift.

The Daily Voice reported that authorities believe the driver of the van may have fallen asleep at the wheel before the vehicle flipped over.

The southbound lanes of the Palisades Parkway were closed to traffic for hours, blocking access to the George Washington Bridge, but the road has since reopened.

Adrian Oswaldo Sura Reyes admits to plowing into crowd, killing mom with hammer

A deranged Pennsylvania man has admitted to plowing his car into a crowd of people, killing one and wounding 17 others, before he drove home and murdered his mother with a hammer.

Adrian Oswaldo Sura Reyes, a 24-year-old from Nescopeck, reportedly got into an argument with his mother before hopping into a vehicle and driving to neighboring Berwick, where the mass casualty crash occurred, according to a criminal complaint obtained by WYOU.

Cops said he drove by the Intoxicology Department bar where a crowd had gathered for a fundraiser for the families of 10 people who were tragically killed in a fire earlier this month. He turned around after he decided to drive into the crowd.

Reyes told police he was just tired of fighting with his mother.

He barreled into the crowd around 6:15 p.m., killing 50-year-old Rebecca L. Reese and sending 17 others to the hospital.

“I didn’t ram ’em, I just ran them over,” Reyes said to police, according to the affidavit.

After the crash, Reyes drove back home. When he arrived, he saw his mother standing outside in the street. Cops said he floored the gas and crashed into her with the front of his car.

He told police he got a hammer from his car and bashed his mother in the head four or five times with it. When police arrived on scene they found the woman dead and arrested Reyes.

“This is a complete tragedy in a community where there’s already been tragedy,” State Trooper Anthony Petroski told reporters.

“We are going to do our job to the best of our abilities to conduct a thorough investigation not only for the families but the community members. They’re already hurting.”

Reyes was denied bail and is facing two open counts of criminal homicide.

As he was being led to court by Pennsylvania State Police around 3 a.m. Sunday morning, the accused killer said “sorry,” WYOU reported.

Investigators say Reyes is facing two open counts of criminal homicide. He was denied bail and is currently lodged in the Columbia County Correctional Facility.

Of the 17 wounded victims, WYOU confirmed the condition of 15 of them.

Five are in critical condition and two are in fair condition at Geisinger Medical Center Danville, where five other victims have been treated and released.

One patient was treated and released from Geisinger Bloomsburg Hospital, and two others have been released from Geisinger Wyoming Valley Medical Center.

Volodymyr Zhukovskyy found not guilty of killing 7 motorcyclists

A commercial truck driver who took drugs on the same day he was part of a grisly New Hampshire crash that killed seven motorcyclists was acquitted Tuesday on all charges.

Driver Volodymyr Zhukovskyy told police at the time he caused the accident, but jurors in less than three hours found him not guilty of seven counts each of manslaughter and negligent homicide, as well as one count of reckless conduct.

Zhukovskyy, 26, had been in jail since the June 21, 2019 crash where he continuously swerved back and forth leading up to the head-on collision.

The Massachusetts resident cried as the verdict was read and pointed toward the sky as he left the Coos County courtroom.

“Our hearts go out to the victims and their families. Our trial team did an excellent job and we firmly believe that the State proved its case beyond a reasonable doubt,” New Hampshire Attorney General John Formella said in a statement.

The father of one of the victims was stunned by the verdict.

“Killing seven people and he gets off. That is unbelievable,” said Albert Mazza whose son Albert “Woody” Mazza Jr. died in the crash.

“It doesn’t make much sense,” the heart-stricken dad added. “There are seven people dead. There are seven families affected. It’s strange that he didn’t get something.”

But the defense team actually pointed the finger at Mazza Jr., saying he was drunk at the time of the crash. Lawyers for Zhukovskyy also argued Mazza wasn’t looking when he lost control of his motorcycle and slid in front of the truck.

The judge previously tossed eight charges connected to whether Zhukovskyy was impaired at the time of the crash.

The family of Zhukonskyy, who was born in Ukraine, was grateful for the “honest and fair trial.”

“Our family expresses its deepest condolences to the family and friends affected by this tragedy,” they said, adding he was “very honest and kind man. He would never have done anything to hurt anyone.”

US Immigration and Customs Enforcement issued an immigration detainer on Zhukovskyy following the crash, which was executed after the verdict, said Coos County Corrections Department official.

He was served papers to appear before an immigration judge and will remain in ICE custody before the hearing, ICE said.

Zhukovskyy’s commercial driving license was supposed to be revoked in Massachusetts when the crash occurred because of a drunken driving arrest in Connecticut two months beforehand.

But it wasn’t suspended due to a backlog of cases.

The killed motorcyclists, part of the Jarheads Motorcycle Club, were from New Hampshire, Rhode Island and Massachusetts and ranged from ages of 42 to 62.

Victims Mazza, couple Edward and Jo-Ann Corr, Michael Ferazzi, Desma Oakes, Daniel Pereira, and Aaron Perry were traveling in a larger group at the time of the crash.

Defense attorney Jay Duguay argued authorities ignored their own accident reconstruction unit that contradicted the assertion that Zhukovskyy crossed into the oncoming lane. He also mentioned inconsistencies from witnesses.

Prosecutor Scott Chase acknowledged the inconsistencies but noted witnesses on the stand were talking about “some of the most unimaginable chaos, trauma, death and carnage that we can even imagine three years later.”

He also argued Zhukovskyy continued to swerve “until he killed people.”

Woman ‘extremely fortunate’ to survive Anne Heche crash

The woman whose Los Angeles home was destroyed when Anne Heche drove into it and caused a fiery crash “was extremely fortunate” to survive — but has “lost her entire lifetime of possessions,” according to neighbors.

Lynne Mishele was in a different section of her Mar Vista home when the troubled actress crashed her Mini Cooper into it Friday, sparking a fireball that took nearly 60 firefighters more than an hour to tackle.

The professional organizer “was in shock” before she even noticed the crashed car, which had careened “almost all the way through” the house, her neighbor, Lynne Bernstein, told People.

“I don’t think she got what was going on. She said, ‘What happened? What happened?’” Bernstein told the mag, saying that her neighbor was “extremely fortunate” to escape.

Her neighbor and her pets — two dogs, Bree and Rueban, as well as a tortoise, Marley — were “extremely fortunate” to survive unscathed, their neighbor said.

An online fundraiser set up by neighbors also insisted that “Lynne and her family very narrowly escaped physical harm.”

“The home, however, was completely burned,” said the fundraiser, which shared images of the burnt-out ruins of the house.

The house was “immediately red-tagged” — meaning declared unfit to occupy — forcing Mishele to “leave the place she loves,” said the fundraiser.

“Even more distressing is that Lynne lost her entire lifetime of possessions, mementos, all equipment for her business including her laptop and iPad, all of her clothing and basic necessities, and all household items,” the neighbors said.

She had been filmed earlier crashing into a nearby garage, with video shared by TMZ catching the sound of her tires screeching as she ignored appeals to get out the car and instead raced off.

Alarming videos then appeared to catch the roar of Heche’s blue Mini racing through quiet suburban streets before the crash. Police confirmed Sunday that they will be investigating if drink or drugs played a role, stressing that it was routine in such cases.

Heche, 53, is in stable condition. A source close to her told CNN that the actress is also “lucky to be alive.”

“She has severe burns and has a long recovery ahead,” the source said.

“Her team and her family are still trying to process what led up to the crash.”

Staten Island car wreck kills three teens

Three teenage passengers inside a Ford Mustang were killed in a horrific crash that caused the vehicle to split in half on Staten Island Sunday night, police said.

The young victims, two girls, 15 and 16, and a 15-year-old boy, were in the muscle car traveling westbound on Hylan Boulevard when they collided with an SUV going eastbound that was attempting to turn left onto Richard Avenue at about 8:45 p.m., according to the NYPD.

The 16-year-old girl and the boy were pronounced dead on scene.

Police said the 15-year-old girl was taken to Staten Island University Hospital North, where she later died.

The driver of the red Mustang, a 16-year-old boy, was hospitalized in critical condition.

The sole occupant of the black SUV was the driver, who did not sustain life-threatening injuries, sources and police said.

It wasn’t immediately clear what caused the fatal wreck, which was being investigated by the NYPD’s Collision Investigation Squad.

The SUV was going eastbound attempting to turn left onto Richard Avenue before it crashed, according to NYPD.

Photos from the scene show the remnants of the mangled Mustang, which ended up in two pieces.
