Alec Baldwin’s initial interview after deadly shooting on set released by investigators

Baldwin was handling a gun while rehearsing a scene at the Bonanza Creek Ranch in New Mexico in October when a shot fired, killing cinematographer Halyna Hutchins and injuring director Joel Souza.

In the first moments of his interview, Baldwin asks a deputy if he is being charged with anything, to which the deputy responds he is not, the video shows. The deputy explains it is just an interview before reading Baldwin his read his Miranda rights prior to questioning.

Footage of the interview, conducted in a small interview room, shows Baldwin describing the process of handling weapons and the usual steps taken on set.

“Do you think someone would do this deliberately?” the interviewer asks.

“I can’t imagine who would,” Baldwin quickly responded.

The video is one of several files released Monday by the Santa Fe County Sheriff’s Office, including photos, recordings and reports related to its investigation, which is ongoing, officials said.

“Various components of the investigation remain outstanding including, FBI firearm and ballistic forensics along with DNA and latent fingerprint analysis, Office of the New Mexico Medical Examiner findings report and the analysis of Mr. Alec Baldwin’s phone data extracted by Suffolk County (New York) Sheriff’s investigators,” Santa Fe County Sheriff Adan Mendoza said in a news release.
During his interview, Baldwin told officers he did not know the last name of the film’s armorer — Hannah Gutierrez Reed — and that she handed the gun directly to him.

When asked if he physically checked the gun himself, Baldwin replied in generalities about the process where the armorer checks the gun. He also described how Gutierrez Reed and her team helped outfit Baldwin with a holster, knife and gun.

Speaking quickly, Baldwin explained the process of firing a gun with a blank which requires the actor to react to the shot as if the gun “kicked back,” as it would when firing a live round. Baldwin goes through the motions of the scene, reaching across his body and using his thumb and forefinger to simulate the gun being drawn across his body.

“Bang! It went off — the first time,” Baldwin said of the weapon used in the rehearsal. “It was the first time we were shooting that shot, we were rehearsing for that shot.”

Baldwin’s attorney said the actor welcomes the investigation and said some of the information released Monday corroborates his description of events.

“The information that has been revealed by the authorities demonstrates, once again, that Mr. Baldwin acted responsibly and did not have control over any production issues that were identified in the OSHA report,” Baldwin’s attorney, Luke Nikas, said in a statement.

“Additionally, the interviews and affidavits disclosed today continue to corroborate Mr. Baldwin’s description of the events — including an affidavit from the Detective stating that the cameraman, who was standing next to Ms. Hutchins and Mr. Souza at the time of the accident, confirmed that Mr. Baldwin was ‘very careful’ with guns on the set,” the statement continued.

Last week, Rust Movie Productions, LLC was fined nearly $137,000 and cited for having a culture of “plain indifference to employee safety” on set, according to a report from New Mexico Environment Department’s Occupational Health & Safety Bureau.

Gutierrez Reed’s attorneys told CNN last week she “was not provided adequate time or resources to conduct her job effectively, despite her voiced concerns.”

When reached for comment Monday, her attorney said they are reviewing the released material and not commenting at this time. Rust Productions LLC declined comment. CNN reached out to the supplier of the props used on set but has not heard back.

The family attorney for Matthew Hutchins, the widower of Halyna Hutchins, said in a statement they would not comment on the evidence release.

“We were surprised by the decision of the Santa Fe County Sheriff’s Office to release such a large amount of evidence today given that the investigation is still ongoing and active,” said attorney Brian Panish. “For this reason, we are not going to comment on the material released except to say we hope the press will exercise discretion in how they use the graphic images and videos of the fatal events of Oct 21, 2021.”

The Santa Fe County District Attorney’s Office will wait until the full investigation into the fatal shooting is complete before making a charging decision in the case, according to a statement obtained by CNN.

“The investigation is not complete,” a statement from DA Mary Carmack-Altwies read, adding that the sheriff’s office is still “awaiting essential reports and will not be completing their investigation until those reports have been submitted.”

“Once we receive the completed investigation and conduct a thorough and deliberate review of all evidence, a criminal charging decision will be made,” Carmack-Altwies’ statement read.

CNN’s Paul Vercammen, Julia Jones and Chloe Melas contributed to this report.

Nicolas Cage comments on Alec Baldwin’s deadly ‘Rust’ shooting: ‘Know what the procedure is’

Nicolas Cage commented on the deadly “Rust” shooting and shared his thoughts on an actor’s responsibility to be responsible with firearms on movie sets.

The death of cinematographer Halyna Hutchins on the New Mexico set of the indie-Western movie sparked a debate in Hollywood about whether real guns have any place on a movie set in an age where it is so easy to use fake guns and add things like muzzle flare in post-production.

Cage appeared in a roundtable discussion with fellow actors Peter Dinklage, Andrew Garfield, Jonathan Majors and Simon Rex for The Hollywood Reporter earlier this week. At one point, the moderator mentioned the tragic accident and asked the panel where they land on the debate about firearms on movie sets. That’s when Cage explained that he believes it is an actor’s responsibility to be educated in the use of guns as part of their craft.

“I don’t want to cast blame anywhere, but I do think, and I’m not talking about anybody, but people don’t like the word movie star. We want to be humble actors. But a movie star is a bit of a different kind of presentation because you need to know how to ride a horse,” he explained. “You need to know how to fight. You’re going to do fight scenes. You need to know how to ride a motorcycle. You need to know how to use a stick shift and drive sports cars, and you do need to know how to use a gun. You do. You need to take the time to know what the procedure is. Those are part of the job profiles.”

He continued by noting that there is a place in production for stunt people to take over and handle the really dangerous stuff that requires outside expertise.

“Now, the stuntman and the movie star are two jobs that co-exist, they co-exist,” he concluded. “Every stuntman needs to be a movie star and every movie star needs to be a stuntman. That’s just part of the profile… And that’s all I’m going to say about it.”

Alec Baldwin was holding a real gun on the set of “Rust” that he was led to believe was loaded with inactive dummy rounds. While setting up a scene with Hutchins and director Joel Souza, Baldwin drew the weapon and reportedly cocked back the hammer, causing it to go off and discharge a live round that should never have been on the set of the movie in the first place. In an interview with ABC’s George Stephanopoulos, Baldwin noted that he had worked with firearms on countless movie sets in the past and felt he knew how to handle them.

When he was finished speaking, Majors complimented Cage for making his point about actors and stunt people so eloquently and agreed with the sentiment himself.

Meanwhile, “Game of Thrones” and “Cyrano” star, Dinklage, noted that there is a responsibility on behalf of the industry to make sure something like this never happens again.

“It can be avoided because look at what you can do with movies,” Dinklage explained “You know that also calls into question, are there too many guns in movies? We’ve all held guns in movies, probably, and I always think about that being anti-gun myself, but the character isn’t. That’s a very complicated thing. But that made it very clear that there has to be change, like, now. One hundred percent.”

Authorities issue search warrant for Alec Baldwin’s cellphone in connection with fatal shooting

New Mexico wants to search his phone for information on the “Rust” shooting.

Authorities in New Mexico have issued a search warrant for actor Alec Baldwin’s cellphone as they probe the fatal shooting of cinematographer Halyna Hutchins on the set of “Rust.”

The cellphone is believed to be in the actor’s possession, according to the warrant, and authorities want to look at text messages sent from the presumed iPhone by Baldwin.

“We are confident that the evidence will show that Mr. Baldwin is not responsible civilly or criminally for what occurred on October 21, and he continues to cooperate with authorities,” Aaron Dyer. Baldwin’s civil attorney, said in a statement Thursday night. “We proactively requested that the authorities obtain a warrant so that we could take steps to protect Mr. Baldwin’s family and personal information that is clearly unrelated to the investigation.”

“A phone contains a person’s entire life, and personal information needs to be protected. While they evaluate the phone information, we hope that the authorities continue to focus on how the live rounds got on the set in the first place,” continued Dyer in the statement.

Investigators are also seeking to seize photos and videos, emails, internet browser histories, GPS data and more, according to the warrant.

Santa Fe County is investigating the shooting. No charges have been filed, though none have been ruled out, either.

Judge David A. Segura approved the search warrant on Thursday afternoon.

In her affidavit, Detective Alexandra Hancock said she asked Baldwin and his attorney for the phone and was “instructed to acquire a warrant.”

A search of Hutchins’ phone found conversations about the production dating back to July 14, according to the affidavit.

Hancock said she believes there may be information on the phone “material and relevant to this investigation,” and that gathering information prior to the film’s production “is essential for a full investigation,” the affidavit stated.

Baldwin shot Hutchins on Oct. 21 during a dress rehearsal for the Western, which he was producing and starring in. The movie was directed by Joel Souza, who was also injured in the shooting.

Baldwin thought he was handling a “cold gun” — one without ammunition — on set when it apparently went off, with a live bullet striking Hutchins.

“Someone put a live bullet in a gun, a bullet that wasn’t even supposed to be on the property,” Baldwin told ABC News earlier this month. “Someone is responsible for what happened, and I can’t say who that is, but I know it’s not me.”

Baldwin downplayed the possibility of any criminal charges during the interview.

“I’ve been told by people who are in the know, in terms of even inside the state, that it’s highly unlikely that I would be charged with anything criminally,” he said.

Last month, investigators searched an Albuquerque prop house as a potential source of the live ammunition found on the set, according to the search warrant affidavit. The owner of the prop house has denied providing live ammunition to the production.

ABC News’ Matt Fuhrman and Jen Watts contributed to this report.

Shooting Investigators Get Search Warrant for Alec Baldwin’s Phone

A judge on Thursday granted the police access to Alec Baldwin’s smartphone, nearly two months into the investigation around how a gun he was practicing with on the set of the film, “Rust,” fired a live round, killing the movie’s cinematographer and wounding its director.

Mr. Baldwin said in a police interview on Oct. 21, the day of the fatal shooting in New Mexico, that the gun discharged while he was preparing for a scene in which he takes the old-fashioned Colt revolver out of his shoulder holster and cocks the hammer, according to an affidavit filed in the application for the search warrant. Detective Alexandria Hancock asked Mr. Baldwin and his lawyer to hand over his phone, the affidavit said, but was told to obtain a warrant.

The application for the search warrant said that the detective “believes there may be evidence on the phone, due to individuals using cellular phones during and/or after the commission of crime(s).” Detective Hancock, according to the affidavit, “was also made aware there were several emails and text messages sent and received regarding the movie production ‘Rust’ in the course of the interviews.”

The search is meant to collect “all information and data from the cellular phone in relation to the production of ‘Rust,’ and any member working on the production.”

In a statement Thursday night, an attorney for Mr. Baldwin, Aaron Dyer, said: “We are confident that the evidence will show that Mr. Baldwin is not responsible civilly or criminally for what occurred on Oct. 21, and he continues to cooperate with authorities. We proactively requested that the authorities obtain a warrant so that we could take steps to protect Mr. Baldwin’s family and personal information that is clearly unrelated to the investigation.”

The application said that Mr. Baldwin was brought into an interview room at about 5:12 p.m. the day of the shooting and that he agreed to speak with detectives after being advised of his Miranda rights. “Alec advised in the scene he slowly takes the gun out of the holster, then very dramatically turns it and cocks the hammer, which is when the gun goes off,” it said. “He said it was supposed to be a ‘cold gun’ so no flash charge or anything should have gone off.”

In a television interview earlier this month, Mr. Baldwin said he did not pull the trigger of the gun he was practicing with when it fired a live round. He said he did not fully cock the hammer of the gun, but pulled it back as far as he could and let it go in an action that might have set it off.

“Someone put a live bullet in a gun, a bullet that wasn’t even supposed to be on the property,” Mr. Baldwin said in the interview with ABC News. “Someone is responsible for what happened, and I can’t say who that is, but I know it’s not me.”

Mr. Baldwin has been cooperating with investigators in the case; the affidavit said the actor had contacted Detective Hancock “numerous times” by telephone and text message.

Alec Baldwin’s cell phone requested by new search warrant in ‘Rust’ shooting investigation

Alec Baldwin’s cell phone has been requested in a new search warrant released Thursday by the Santa Fe Sheriff’s Department.

The sheriff’s department wants to search Baldwin’s phone for any evidence relating to the death of Halyna Hutchins.

“Affiant is requesting a warrant for the seizure and search of Alec Baldwins’ [sic] cell phone to search for any evidence relating to the death investigation of Halyna Hutchins,” the affidavit obtained by Fox News Digital said. “Affiant believes there may be evidence on the phone, due to individuals using cellular phones during and/or after the commission of crime(s).”

“Such information, if it exists, may be material and relevant to this investigation. Affiant was also made aware there were several emails and text messages sent and received regarding the movie production ‘Rust’ in the course of interviews.”

Reps for Baldwin did not immediately respond to Fox News’ request for comment.

Baldwin told police he had corresponded with armorer Hannah Gutierrez Reed via email discussing different types of guns to use during production. The actor had told police he requested a larger gun for filming, according to the search warrant.

Police found conversations regarding the “Rust” production on Hutchins’ phone dating back to July 14, 2021, as well as photos taken in the Santa Fe area dating to September 7, 2021.

“Affiant believes gathering information prior to the film start date of Rust is essential for a full investigation,” the affidavit said, adding that police requested Baldwin’s phone but were told to get a search warrant.

Baldwin recently sat down for his first tell-all interview since the Oct. 21 shooting.

The actor described the moment the gun was discharged during the interview. “I let go of the hammer of the gun,” Baldwin told ABC’s George Stephanopoulos. “And the gun goes off.”

Baldwin and Hutchins were setting up for a shot where the actor was supposed to draw the gun and point it at the camera. While standing next to the camera, the cinematographer was “guiding” Baldwin on where to point the gun, he said. “The gun wasn’t meant to be fired in that angle,” he confirmed.

Authorities have said Baldwin was told the gun was safe to handle but continue to investigate how a live round ended up in the weapon. Investigators have described “some complacency” in how weapons were handled on the “Rust” set. They have said it is too soon to determine whether charges will be filed, amid independent civil lawsuits concerning liability in the fatal shooting.
