Athena Strand affidavit: FedEx driver admitted strangling 7-year-old after hitter her with van, says warrant

A FedEx driver admitted to kidnapping and strangling 7-year-old Athena Strand after he hit the child with his van as he made a delivery at her Texas home, according to a newly released arrest warrant.

Tanner Horner told investigators that although Athena was not badly hurt when he backed into her, he panicked and grabbed her as he was afraid she would tell her father what had happened, according to the warrant, which was obtained by The Fort Worth Star-Telegram.

Mr Horner is accused of murdering the child on 30 November, while her body was recovered on 2 December from a location at the edge of the Trinity River in Wise County that he gave to police.

The arrest warrant states that video from inside the FedEx van the suspect was driving, confirmed that he had taken the child before her death.

Mr Horner then told investigators that he first tried unsuccessfully to break her neck, before strangling her to death with his bare hands in the back of his delivery van.

The 31-year-old from Fort Worth, Texas, was arrested on 2 December and is being held on a $1.5m bond in the Wise County Jail. He faces charges of capital murder of a person under 10 years old and aggravated kidnapping.

Wise County Sheriff Lane Akin has said that he and prosecutors have discussed pursuing the death penalty punishment if Mr Horner is convicted at trial.

Athena’s mother, Maitlyn Gandy, has said that the suspect was at the house of her ex-husband to deliver a package of Barbie dolls as a Christmas gift for Athena.

Investigators discovered during their hunt for the then-missing girl that FedEx had delivered a package around the time that the child had disappeared, the warrant states.

They worked with Big Topspin, a contractor for FedEx who the suspect worked for, and determined which FedEx van and driver had made the delivery.

Investigators then obtained video footage from cameras inside the van, which the warrant says showed the suspect talking to Athena after he grabbed her.

When a sheriff’s office investigator and a Texas Ranger interviewed the suspect he told them that she was dead, although she had been alive when he took her and gave him her name.

Saudi king admitted to hospital for colonoscopy

DUBAI, United Arab Emirates (AP) — Saudi Arabia’s octogenarian monarch underwent a colonoscopy on Sunday, state-run media reported, just weeks after he had the battery of his pacemaker changed.

The report in the official Saudi Press Agency first said only that King Salman, 86, was admitted to King Faisal Specialist Hospital in the Saudi port city of Jiddah for medical tests, without elaborating.

Later in the day, state-run media reported that he had a colonoscopy, and nothing abnormal was found. Doctors instructed King Salman to stay in the hospital for “some time” to rest, state-run media reported, without specifying how long.

The monarch’s health is closely watched because he holds absolute power in the kingdom.

King Salman ascended to the throne in 2015 and has appointed his 36-year-old son, Crown Prince Mohammed bin Salman, as his successor. However, he has also already empowered Prince Mohammed to lead day-to-day affairs.

Since his elevation to power, Prince Mohammed has upended the kingdom with dizzying social reforms, sidelined royal rivals and cracked down on perceived opponents, sparking controversy.

Earlier this year, state media reported that King Salman was hospitalized in Riyadh to have the battery of his heart pacemaker replaced. In 2020, he had surgery to remove his gallbladder after a stint in the hospital that revived speculation about the state of his health.

Starling Jenkins, a member of Depp’s security team, testified about the feces in the trial between Heard and Depp on Thursday.

Depp is suing Heard, alleging she defamed him when she described herself as a victim of domestic violence in a 2018 op-ed for the Washington Post, and that she in fact physically and verbally abused him. Heard has denied the allegations and countersued, alleging Depp beat her on multiple occasions while under the influence of drugs or alcohol.

Jenkins testified about the time surrounding Heard’s 30th birthday dinner, on April 21, 2016. Depp was late to the party in the couple’s shared Los Angeles penthouse apartment, the actor testified earlier in the trial because he was having an in-depth conversation with his business manager about the unexpectedly disastrous state of his finances. After the dinner, Depp alleged, Heard berated and hit him.

Depp left Heard in the apartment while he went to his house in Hollywood Hills. The next morning, after Heard left on a scheduled trip to Coachella, a housekeeper found fecal matter on Depp’s side of the couple’s shared bed.

“My initial response to that was, I laughed,” Depp testified earlier, describing the reaction to seeing a photo of the feces. “It was so outside, it was so bizarre and so grotesque that I could only laugh.”

Jenkins testified about accompanying Heard on the Coachella trip. Before he, Heard, her sister, and a friend of hers left for the music festival, Jenkins fetched Heard’s luggage and two dogs.

He later had “a conversation pertaining to the surprise she left in the boss’s bed,” Jenkins testified, which he referred to as “the defecation.”

Heard described it as “a horrible practical joke gone wrong,” Jenkins said.

Depp testified earlier in the trial that he didn’t speak to Heard until more than a month later, following his mother’s death.

Heard blamed the poop on her two dogs, an explanation Depp found unpersuasive since they were teacup Yorkies that he said weighed about 4 pounds each.

“I lived with those dogs. I picked up their funk. It was not the dogs,” Depp said.

New audio reveals McCarthy said Trump admitted bearing some responsibility for Capitol attack

A readout of that conversation, which took place on January 11, 2021, had been previously reported by CNN. But two New York Times reporters obtained an audio recording of the conference call for their upcoming book, “This Will Not Pass: Trump, Biden and the Battle for America’s Future,” and shared it with CNN.

“But let me be very clear to you and I have been very clear to the President. He bears responsibility for his words and actions. No if, ands or buts,” McCarthy told House Republicans on January 11, 2021, according to the audio obtained by CNN. “I asked him personally today, does he hold responsibility for what happened? Does he feel bad about what happened? He told me he does have some responsibility for what happened. And he needs to acknowledge that.”

On a separate call the day before, McCarthy said, “I had it with this guy. What he did is unacceptable. Nobody can defend that, and nobody should defend it.” The book’s authors say those comments were in reference to Trump.

CNN has reached out to McCarthy for comment.

The Times reporters also revealed another bombshell recording this week, in which McCarthy is heard telling other House Republican leaders in the days after January 6 that he planned to advise Trump that he should resign. McCarthy and his aides had vehemently denied that reporting before the audio was leaked.

A GOP member of leadership who called McCarthy this morning to discuss the audio file revealed by The New York Times on Thursday night said they didn’t get the impression McCarthy is worried that the recorded comments or revelations could hurt his political future in a significant way. The member told CNN that McCarthy told them Trump called McCarthy on Thursday night to discuss this and that there is a feeling as long as Trump is fine, McCarthy can manage any outrage from those on his right flank.

The member emphasized that it’s hard to argue McCarthy isn’t Trumpy enough if Trump is still with him.

“He doesn’t seem to be worried about” it, the member said of McCarthy. “He gets it needs to be addressed, but I don’t get the sense he’s worried about it.

The source also defended McCarthy and told CNN that on the days after January 6, there had been a fog about what would happen next. The member said there was a lot of talk that Republican senators would back removing Trump from office and their take was that McCarthy’s entertaining asking Trump to resign was coming from McCarthy trying to protect Trump from the disgrace of impeachment.

“My read on listening to that audio is McCarthy had some info that some top senators were contemplating impeaching the President … we were basically talking through the different options of what might happen,” the person said.

McCarthy has declined to cooperate with the House January 6 committee, which wants to question him about his communications with Trump, White House staff and others in the week after the insurrection. McCarthy has said he has nothing relevant to offer the panel since he’s already publicly revealed he had a phone call with Trump on January 6.

McCarthy made similar public comments in a little-noticed local radio interview one week after the insurrection, which CNN reported on earlier this year.

“I say he has responsibility,” McCarthy said on KERN, a local radio station in Bakersfield, California, on January 12 of last year. “He told me personally that he does have some responsibility. I think a lot of people do.”

Earlier this year, McCarthy evaded a question during a news conference about whether he remembers telling House Republicans that Trump took responsibility for the Capitol riot.

To date, Trump has never publicly accepted any responsibility for the attack. Trump’s state of mind — and whether he has privately admitted any culpability for the insurrection — has been of keen interest to the House select committee investigating the January 6 Capitol attack.

The select committee also wants to know why McCarthy has since changed his tune on Trump, and whether Trump or any of his associates asked McCarthy to change his tone about the President’s role in the attack and their private conversations.

Man admitted to hospital after rare masturbation injury

A 20-year-old patient was admitted to an intensive care unit in Switzerland after he suffered a rare lung injury while masturbating.

The Swiss citizen reported a “sudden onset of sharp chest pain followed by shortness of breath while lying in bed masturbating”, according to a study published in the May issue of the medical journal Radiology Case Reports.

The man, who has a history of mild asthma, rushed himself to Cantonal Hospital in Winterthur following chest pain.

A subsequent chest x-ray revealed that he was suffering from subcutaneous emphysema – or SPM– a rare condition triggered by violent coughing, excessive vomiting and strenuous physical exercise. It results in air leaks from the lung and getting trapped in the rib cage.

It is a condition “that mostly affects young men and generally follows a benign and self-limiting course”, said the authors of the study, Dr Nikola Rajic and Dr Christian Schandl.

“Specific therapy is not necessary, although supporting care and short-term observation for respiratory compromise are reasonable,” they added.

However, what makes this case unusual was that “there are only a few reports of SPM related to sexual activity”, the authors said, noting that they were not able to “find any cases associated with autoeroticism”.

The CT scan of chest and neck also showed that it had reached up until the base of his skull.

The patient was given paracetamol to deal with his chest pain and was kept in the ICU overnight, before being transferred to the general ward the day after, where he remained for three more days before being discharged.

Why Coinbase admitted Apple calls the shots

One of Web3’s benefits, according to boosters such as Jack Dorsey, is that it’s censorship-resistant. Because it is decentralized, this argument goes, it is impossible to censor anyone. But it isn’t true that cryptocurrency is decentralized. Right now, Web3 has a choke point: Big Tech.

Cryptocurrency has relied on points of centralization since the days of Mt. Gox. (That hack wouldn’t have mattered nearly as much if Mt. Gox hadn’t been processing 80 percent of all transaction volume in Bitcoin at times). As the ecosystem has expanded, so have the points of centralization, such as AWS and Google Cloud.

One problem with cryptocurrency is that the technology is fairly user-hostile, at least to normal users of the internet. And so centralized services have sprung up for the non-technical, such as Coinbase, OpenSea, Metamask, VeVe, and Rarible. Meanwhile, mainstream payment apps — Venmo, PayPay, and so on — have added cryptocurrency capabilities. This is likely how the general public will get involved with crypto, assuming they do so at all. These services may also be used by people who do understand cryptocurrency since even the savvy may appreciate user-friendly interfaces and protection from scams.

To get to these apps, users will go through the Google and Apple app stores. So if those centralized ways of accessing cryptocurrency want to stay in Apple’s and Google’s app stores, well, functionally, Apple and Google will be setting the terms of content moderation for Web3.

For the purposes of this piece, I am going to focus on Apple because I didn’t sit through the Epic Games v. Apple antitrust trial for nothing. (Epic Games v. Google has not yet taken place; when it does, I imagine we’ll get much more clarity about the Google store.) Apple’s public relations team did not respond to requests for comment.

As Coinbase CEO Brian Armstrong wrote on February 4th, “For any app to be listed in the Apple and Google App Stores, it needs to play by the rules of those two companies.” That means that whatever Apple and Google decide as their content policy, Coinbase will follow, Armstrong says. “Our approach is to be free speech supporters, but not free speech martyrs.” (Emphasis his.) So if a “critical partner” such as Apple or Google objects to something and requires its removal, Coinbase will remove it. Coinbase’s head of policy, Ian Plunkett, declined to comment for this story.

This position has been signaled before. In June 2020, a few employees walked out of work because they wanted an immediate response from Armstrong to the Black Lives Matter protests. Armstrong ultimately did post his support for BLM to Twitter, though those tweets have since been deleted. The following September, Armstrong made a blog post limiting political discussions at work.

In his September 2020 post, Armstrong describes the move as “mission focused.” After the departures, he noted in an email that “[w]e have just made a decision to not engage in broader activism as a company outside of our mission.” (How Coinbase’s attempts at a PAC fit with this framework of ideas is unclear to me.) He offered severance to anyone who objected, which wound up being about 5 percent of its employees. Clearly included in the company’s values were the notions that “broader societal issues” and “political causes” were minimally important.

This is fairly consistent with ceding moderation decisions to Apple — if you squint. Free speech maximalism is, after all, a political cause and thus on Coinbase’s “minimally important” list. One reason that Coinbase has stuck around as long as it has — while competitors have toppled — is pragmatism.

We have some sense of how Apple will moderate Web3 because we already know how it moderates in its little “walled garden”:

The blockchain has an inherent moderation problem: it’s immutable. So if someone encodes a text string that contains a URL for a website that, for instance, contains child porn, the text string is there forever. Extracting that data requires effort and technical ability, and the linked-to website itself might go down, but the text string remains. It’s also possible to harass people on the blockchain in messages that can’t be altered or deleted, though some level of technical ability is required for this also.

So Apple’s mores are perhaps less of a problem for pure cryptocurrency and more of a problem for NFTs, an area Coinbase is planning to get into this year. Nudity in an NFT? That’s a problem for anyone who displays the NFT and also wants to appear in the Apple App Store. I mean, we already know that the fine folks of Apple are terrified of naked bananas. God forbid they see an actual human titty.

What’s more, Apple can say what currencies it’s willing to support transactions in, and that’s trouble for companies that want to take payments in, for instance, Ethereum.

Fortunately for crypto enthusiasts, Apple has a pretty good incentive to let crypto apps — some, at least — stay in its App Store. One reason you can’t buy a Kindle e-book through the iPhone app is that Apple takes a 30 percent cut of any digital goods sold in apps that appear in its store. This means that anyone trying to buy an NFT — inarguably a digital good — through an iOS app is likely going to pay a premium since app designers can simply pass the charge along to users rather than sacrificing their own cut. (Amazon has chosen not to take this path, which is why you still can’t buy a Kindle e-book on the iPhone app).

The flip side here is that Apple can turn the faucet off at any time. Display an NFT titty? You might be out. Try to bilk Apple out of its cut? You’re definitely out.

Coinbase’s content moderation capitulation here is understandable: Apple, Google, and even Amazon are going to run the show if you’re trying to make Web3 a mass-market technology. Collectively, this group owns the stores where your app appears, the cloud servers you use for your service, the operating systems, and the devices. Say whatever you like about the distributed future of Web3, but for the time being, centralized Big Tech is going to continue calling the shots.

More vaccinated adults hospitalized with omicron, but fewer admitted to ICU

A higher proportion of adults hospitalized with COVID-19 during the period of omicron dominance were fully vaccinated compared to the period of delta dominance, according to a new analysis, but those people were also less likely to be severely ill or die.

The Centers for Disease Control and Prevention (CDC) analysis of a single hospital in Los Angeles found there were more hospitalizations during omicron compared to delta, but that among omicron-period patients, vaccination – particularly vaccination plus a booster dose – was associated with lower likelihood of admission to an intensive care unit.

“COVID-19 vaccination, particularly a booster dose, continues to be critical in mitigating the health care burden of the omicron variant,” the CDC concluded in its Morbidity and Mortality Weekly Report.

Among adults at least 65 years old hospitalized during omicron, vaccination was also associated with a lower likelihood of death while hospitalized.

Omicron-period hospitalizations overall were associated with a lower likelihood of ICU admission, mechanical ventilation and death while hospitalized, compared with delta-period hospitalizations.

However, the proportion requiring ICU admission and ventilation did not differ significantly when broken down by vaccination status, suggesting that much of the lower disease severity observed during omicron predominance might be driven by increased population-level vaccine-conferred immunity, the CDC said.

From mid-July through mid-December, the proportion of fully vaccinated adults in Los Angeles County increased nearly 20 percent, from approximately 65 percent to 77 percent, but the proportion of COVID-19 hospitalizations occurring in fully vaccinated adults increased almost 60 percent, from approximately 25 percent to 40 percent.

According to the CDC, the increases in infections among vaccinated persons during the period of omicron predominance were likely driven both by waning vaccine-derived immunity over time and by relative resistance to vaccine neutralization in the omicron variant compared with the delta variant.

There were 339 adults hospitalized during the delta predominant period of July 15 to Sept. 23, and 737 adults hospitalized during the omicron period of Dec. 21 through Jan. 27.

The CDC also noted that while some reports indicated omicron was causing less severe illness compared to delta, most patients hospitalized during the early omicron period still suffered from severe lower respiratory illness.

The agency also addressed the distinction between people admitted for COVID-19 and those diagnosed with COVID-19 after admission.

“Approximately 20 percent of SARS-CoV-2 admissions during early Omicron predominance were likely for reasons other than COVID-19, a proportion even higher among young and vaccinated adults. Given high rates of SARS-CoV-2 community transmission, this is not unexpected,” the CDC said.

One-third of patients classified as having been admitted for COVID-19 received no COVID-19-directed therapies.

“However, the pandemic health care burden is not limited to hospitalizations for symptomatic COVID-19,” the CDC noted in the study. “Even patients with positive SARS-CoV-2 test results admitted for non-COVID-19 conditions require isolation rooms and use of personal protective equipment and might transmit infection to health care workers, exacerbating staff shortages.”

Brian Laundrie admitted to killing Gabby Petito in notebook entry: FBI

Brian Laundrie admitted he killed girlfriend Gabby Petito in a notebook entry he wrote shortly before he took his own life, the FBI revealed Friday in its final report on the case.

Laundrie also sent text messages between his and Petito’s cellphone in the days after Petito was strangled to death last summer in an attempt “to deceive law enforcement by giving the impression Ms. Petito was still alive,” the FBI Denver said in its final investigative update on the case.

All “logical investigative steps have been concluded in the case,” FBI Denver Division Special Agent in Charge Michael Schneider said in a statement.

“The investigation did not identify any other individuals other than Brian Laundrie directly involved in the tragic death of Gabby Petito.

“The FBI’s primary focus throughout the investigation was to bring justice to Gabby and her family,” Scheider said. “The public’s role in helping us in this endeavor was invaluable as the investigation was covered in the media around the world. 

“On behalf of the FBI, I want to express my deepest appreciation to the public for the thousands of tips that were provided during the investigation, and to our local, state and federal law enforcement partners for their work throughout the investigation.”

Richard Stafford, an attorney for the Petito family, thanked the FBI and its victim services.

Steven Bertolino, the lawyer for the Laundrie family, issued a statement after the release of the FBI report.

“Gabby and Brian are no longer with their families and this tragedy has caused enormous emotional pain and suffering to all who loved either or both of them,” Bertolino wrote. “We can only hope that with today’s closure of the case each family can begin to heal and move forward and find peace in and with the memories of their children.

“May Gabby and Brian both rest in peace.”

Long Island native Petito, 22, vanished last summer during an ill-fated cross-country trip with Laundrie. She was reported missing Sept. 11, and her body was found Sept. 19 at a Wyoming camp ground, with an autopsy determining she’d been strangled.

When Laundrie, 23, returned to his parents’ North Port, Fla., home without her, he quickly became the sole person of interest in the case before he disappeared, too. A massive manhunt for him followed, until his remains were found at a nearby nature preserve Oct. 20.

A revolver, backpack and the notebook were found near his body, the FBI stated. Authorities determined he’d shot himself. Police had determined that between Aug. 30 and Sept. 1 Laundrie had used Petito’s debit card on his drive from Wyoming to Florida, the report said.
