Abby Zwerner, Virginia teacher shot by 6-year-old student, claims school “failed to act” on warnings that boy had a gun

An attorney for Abby Zwerner, the first-grade teacher shot and wounded by a 6-year-old student earlier this month in Newport News, Virginia, said that the administrators of Richneck Elementary School had multiple warnings that the unidentified boy was armed, but “failed to act” on those reports. 

In a news conference on Wednesday, Diane Toscano, a defense attorney representing Zwerner, said that Zwerner and several other teachers made reports on Jan. 6 — the day Zwerner was shot. The first report, Toscano said, was made between 11:15 and 11:30 a.m., when Zwerner told administrators that the 6-year-old had threatened to beat up another child. The school did not act on the report, Toscano said. 

Around 12:30 p.m., a second unidentified teacher went to school administrators and said that she searched the boy’s backpack, Toscano said, because the boy was suspected to have a gun. 

“The teacher then tells that same administrator that she believes the boy put the gun in his pocket before he went outside for recess,” Toscano said. “The administration could not be bothered. The administrator downplayed the report from the teacher and the possibility of a gun, saying, and I quote, ‘Well, he has little pockets.'”

Shortly after 1 p.m., a third teacher went to the administration and said that another student had been found crying and fearful, Toscano said. The third teacher told the administration that the other student said the 6-year-old had shown the gun to him at recess and threatened to shoot him if he told anybody. 

A fourth employee reportedly heard about the danger and asked administrators for permission to search the 6-year-old’s backpack, but was denied.

“He was told to wait the situation out, because the school day was almost over,” Toscano said. “Tragically, almost an hour later, violence struck Richneck Elementary School.” 

Toscano also said that she informed the Newport News school board that she intends to file a lawsuit on Zwerner’s behalf. She did not say what grounds the lawsuit would be on. 

Michelle Price, the director of public information for Newport News Public Schools, said that “since the school’s investigation is ongoing, I cannot comment on the statements presented by Ms. Zwerner’s lawyer at this time.” 

On Wednesday, the Newport News School Board voted in a special meeting 5-1 to remove Superintendent George Parker III. He will be relieved of his duties Feb. 1.

Zwerner was shot in front of her other first-grade students; police have described the shooting as “intentional.” She was able to evacuate her classroom and another school employee, who Toscano said was a teacher, restrained the 6-year-old boy.

The boy brought the gun from his home, police have said. His parents have said the gun was “secured,” and it’s not clear how he acquired the weapon. 

Zwerner was hospitalized with life-threatening injuries and has been recovering at home since Jan. 19. Toscano said that the bullet remains in Zwerner’s body, and said the teacher continues to undergo surgeries and physical therapy. 

It’s unclear what charges, if any, the 6-year-old will face. He is currently hospitalized.

Gun allegedly used by 6-year-old to shoot teacher kept on top shelf of mother’s closet, attorney says

The gun allegedly used by the first grader accused of shooting his teacher in Newport News, Virginia, was kept on the top shelf of his mother’s bedroom closet, James Ellenson, the attorney representing the child’s family, told CNN.

The gun had been secured by a trigger lock, the attorney told CNN in an email Sunday.

Ellenson has not yet specified how the 6-year-old was able to access the weapon.

This week, Newport News Police and ATF officials conducted their second round of searches at two homes belonging to the child’s family, Ellenson said.

No charges have been filed.

The gun was legally purchased by the child’s mother, who could face charges at the end of the investigation, according to Newport News Chief of Police Steve Drew. The child brought it to the school in his backpack, he said.

The teacher, 25-year-old Abby Zwerner, was released from the hospital last week. She was shot in the chest after the bullet passed through one of her hands, according to Drew.

On Thursday, the family of the boy released a statement, saying their child has an acute disability and they were praying for Zwerner, who “selflessly served our son and the children in the school.”

Richneck Elementary has been closed since the January 6 shooting, but students and parents have been invited back to the school Wednesday for a two-hour non-instructional activity period, according to a letter from a school administrator.

6-Year-Old Said He Wanted to Light Teacher on Fire Before Shooting: Report

Virginia school officials are alleged to have downplayed concerns about the six-year-old boy that went on to shoot a teacher, including that he said he wanted to light her on fire and watch her die, The Washington Post reported.

Police said the child eventually shot teacher Abigail Zwerner earlier this month as she taught her first-grade class at Richneck Elementary School in Newport News.

Authorities have said that the shooting was “intentional” and “not accidental” but have not provided further information. 

The Post obtained a message written by a Richneck teacher through the local teachers union that reveals alarming details about the boy’s alleged behavior.

The account claims that the boy wrote a note to Zwerner which said that he hated her and wanted to light her on fire and watch her die. When she reported the note to Richneck administrators, Zwerner was told to drop the matter, the account claims.

On one occasion, the boy threw furniture and other items around in class, which led to the other children hiding under their desks, per the account.

The account also claims that in another incident, the boy barricaded the doors to a classroom and prevented a teacher and students from leaving.

The boy’s family said that he had “an acute disability” and that one of his parents often went with him to class but did not do so the week of the shooting.

The teacher also alleged in her account that the boy was not receiving the educational services that he needed at the school.

The teacher declined to speak to the Post directly or reveal her identity publicly out of fear of retaliation.

The outlet also obtained text messages between school employees and Newport News Superintendent George Parker III following the shooting, which say that Zwerner had requested help to deal with the young student.

“She had asked for help,” one staffer wrote about Zwerner, with another school official responding in agreement that she had done so “several times.”

Other school officials responded by saying that she had requested help “two hours prior” as well as “all year.”

The messages do not provide any further details about Zwerner’s requests for assistance.

Since the shooting, other details have emerged suggesting that school officials might have fallen short in addressing concerns about the boy.

Superintendent Parker said that hours before the boy shot the teacher, a school administrator was told the child may have brought a gun to school. He said that workers at the school searched the boy’s backpack but did not find the 9mm semi-automatic pistol legally-owned by his mother.

After the shooting, Zwerner was taken to the hospital, where her condition went from life-threatening condition to stable, according to The Washington Post. The bullet went through Zwerner’s hand and into her upper chest, according to reports.

Richneck Elementary School did not immediately respond to Insider’s request for comment.
